WHO MAY MARRY PESULEI KAHAL? (Yerushalmi Perek 8 Halachah 2 Daf 47a)

תמן תנינן כל האסורין לבוא בקהל מותרין לבוא זה בזה. רבי יודה אוסר

(a)

(Mishnah): All forbidden to enter Kehal [Hash-m] may marry each other; R. Yehudah forbids.

רבי ירמיה אמר כללא פצוע דכא ישראל מותר לו לישא ממזרת.

(b)

(R. Yirmeyah): The [first Tana's] general rule teaches that a Petzu'a Daka Yisrael may marry a Mamzeres.

אמר רבי יוסי בלבד פסול משפחה. הא פסול גוף לא בדא.

(c)

(R. Yosi): [No. The Klal applies] only to Pesulim due to lineage (Mamzer, Amoni....), but not to a bodily Pesul (e.g. Petzu'a Daka or Krus Shafchah).

Source: R. Yosi learns from R. Chilkiyah citing R. Simon citing R. Yehoshua ben Levi - [our Mishnah permits to a convert] only a Petzu'a Daka Yisrael, but not a Petzu'a Daka Kohen;

כמה דאת אמר תמן אם כהן ברור הוא פסול לו לישא גיורת. אף הכא ישראל ברור אסור לישא ממזרת

Just like you say there, that a Kohen [even if his body is Pasul] may not marry a convert - also here, a Yisrael [even if his body is Pasul] may not marry a Mamzeres.

על דעתיה דרבי יודה ממזר לא ישא ממזרת

(e)

Question: According to R. Yehudah [who forbids Pesulei Kahal to marry each other], may a Mamzer not marry a Mamzeres?

נישמעינה מן הדא דמר רבי אימי תני רבי יעקב גבליא קומי רבי יוחנן רבי יצחק בר טבליי בשם רבי שמעון בן לקיש דברי רבי יהודה ממזר לא ישא ממזרת [דף מז עמוד ב] כדי שיתכלו ממזרין מן העולם.

Answer: We learn from the following. R. Imi said that R. Yakov Gavliya taught in front of R. Yochanan, and R. Yitzchak bar Tavlai citing Reish Lakish, according to R. Yehudah, a Mamzer may not marry a Mamzeres, in order that [they not multiply, and] Mamzerim will cease from the world.

ודכוותה עמוני לא ישא עמונית.

Question: Similarly (i.e. regarding a couple of similar lineage, do we say that) an Amoni may not marry an Amonis?

אמר רבי יוסי בי ר' בון על דרבנין נצרכה.

(R. Yosi bei R. Bun): This question is according to Rabanan [who hold that converts are not called Kehal Hash-m. Do they forbid mid'Rabanan, just like R. Yehudah forbids a Mamzer to marry a Mamzeres?]

דאין יסבור רבי יודה גרין פסולין קהל ה' אינון.

[The one who asked] cannot hold like R. Yehudah, that [even] Pasul converts (i.e. Amon and Mo'av, from which the male converts are Pesulim, female converts) are Kehal Hash-m. (If so, surely she is forbidden to an Amoni, who may not enter Kehal Hash-m!)

לישא עמונית אינו יכול (שהוא קהל ה' אצלה) [צ"ל שהיא קהל ה' אצלו - מיכל המים]

(h)

Answer: [An Amoni] may not marry an Amonis, for she is considered Kehal Hash-m relative to him;

Note: Even though we ask according to Rabanan, who hold that converts are not called Kehal Hash-m, since she is permitted to Yisrael, we do not let her marry an Amoni, for then her sons would be Pesulim. Similarly, he may not marry converts of other nations, whose children are permitted.

לישא מצרית אינו יכול שהוא קהל ה' אצלה.

He may not marry a Mitzris [Rishonah], for he is considered Kehal Hash-m relative to her (his daughters are permitted to Yisrael, but all her children are forbidden).

i.

Note: He may not marry a Mitzris Sheniyah, for she is considered Kehal Hash-m relative to him (his sons are forbidden to Yisrael, but all her children are permitted. There is an implied question - will he not marry anyone?! We explained this like MEICHAL HA'MAYIM.)

אמר רבי מתניה (משחררין לו שפחה) [צ"ל משיאין לו שפחה ומשחררין לו זרעו - שיירי קרבן]

(i)

(R. Masniyah): We marry him to a Shifchah, and we free his children for him.

ודכוותה מצרי לא ישא מצרית.

(j)

Question: (R. Yehudah forbids a Mamzer to marry a Mamzeres.) Similarly, may a Mitzri not marry a Mitzris? (Here, the grandchildren will be permitted, so perhaps it is permitted.)

נישמעינה מן הדא תני רבי אבהו קומי רבי יוחנן אמר ר' יודה בנימן גר מצרי היה מתלמידיו של רבי עקיבה

Answer: We learn from the following. R. Avahu taught in front of R. Yochanan, R. Yehudah said, Binyamin the Mitzri convert was a Talmid of R. Akiva;

אמר אני גר מצרי נשוי לגיורת מצרית. בני בן גר מצרי ואני משיאו לגיורת מצרית נמצא בן בני כשר לבוא בקהל.

[Binyamin] said, I am a Ger Mitzri married to a Mitzris convert. My son is a Mitzri Sheni. I will marry him to a Mitzris convert. It turns out that my son's son will be Kosher to enter the Kahal.

אמר לו רבי עקיבה לא בני אלא אף אתה השיאו לבת גיורת מצרית כדי שיהו שלשה דורות מיכן ושלשה דורות מיכן.

R. Akiva told him, no my son - rather, marry him to the daughter of a Mitzris convert (a Mitzris Shenis), so [your grandson] will be a third generation Mitzri from here (the father's side) and from here (the mother's side. We infer that a Mitzri marry a Mitzris.)

THE LAW OF SAFEK PESULIM (Yerushalmi Perek 8 Halachah 2 Daf 47b)

רב יהודה בשם רב הלכה כרבי לעזר

(a)

(Rav Yehudah citing Rav): The Halachah follows R. Lazar [who permits Vadai Pesulim to marry each other, but forbids Safek Pesulim to marry Safek or Vadai Pesulim].

דברי חכמים.

(b)

Implied question: [What is the reason for] Chachamim's words? (They permit Safek Pesulim to marry Safek or Vadai Pesulim.)

רבי ירמיה בשם רבי שמואל בר רב יצחק כתיב [דברים כג ג] לא יבא ממזר בקהל ה'. בקהל ברור אינו בא. בא הוא בקהל ספק.

(c)

Answer (R. Yirmeyah citing R. Shmuel bar Rav Yitzchak): It is written "Lo Yavo Mamzer bi'Kehal Hash-m" - he does not enter a Vadai Kahal, but he enters Kehal Safek.

תמן תנינן ספק בן תשעה לראשון. בן שבעה לאחרון יוציא והוולד כשר וחייבין אשם תלוי.

(d)

(Mishnah): If it is a Safek [whether the baby was born] nine months [after conception] from the first (the deceased), or seven months after conception from the latter (the Yavam), the child is Kosher (not a Mamzer), and they are obligated Asham Taluy.

תני הראשון כשר להיות כהן גדול. והשני ממזר בספק.

(Beraisa): The first [son born after Yibum] is proper to be Kohen Gadol [no matter who his father is, he is Kosher]. The second son (i.e. any child from a later pregnancy) is a Safek Mamzer;

R. Eliezer ben Yakov says, there is no Mamzer amidst Safek.

R. Eliezer ben Yakov agrees about Safek Kusim and Safek Chalalim (that they are forbidden. He permits only Safek Mamzerim, due to Chachamim's Drashah above.)

כההיא דתנינן תמן עשרה יוחסין עלו מבבל.

(h)

Question (Mishnah): Ten lineages ascended from Bavel. (Among them are Asufim (babies found deserted) and Shetukim (we know the mother, but not the father). They are Safek Mamzerim!)

על דעתיה דרבי ליעזר בן יעקב שמונה. על דעתיה דרבן גמליאל ורבי ליעזר תשעה. על דעתין דרבנן עשרה.

Answer: According to R. Eliezer ben Yakov there are eight (Asufim and Shetukim are just like Yisrael, for Safek Mamzerim are permitted.) According to R. Gamliel and R. Eliezer there are nine (they hold that a Shetuki is Kosher, for his mother is believed to say that his father is Kosher.) According to Rabanan there are 10.

אמר רבי חיננה מתניתא דלא כרבי יודה. דרבי יודה אמר ארבעה קהילות אינון קהל. קהל כהנים. קהל לווים. קהל ישראלים. קהל גרים.

(j)

(R. Chinenah): That Mishnah [which permits converts to marry Mamzerim] is unlike R. Yehudah, for R. Yehudah says that there are four Kehilos (corresponding to the four times it says Kehal Hash-m) - Kehal Kohanim, Kehal Leviyim, Kehal Yisraelim and Kehal Gerim.

Question (against R. Yehudah): [There is a fifth Kahal -] "Lo Yavo Petzu'a Daka [u'Chrus Shafchah] bi'Kehal Hash-m"!

Answer: That is a bodily Pesul. (R. Yehudah counts only Kehal Hash-m written about lineage.)

והכתיב [שם ט] בנים אשר יולדו להם דור שלישי יבא להם בקהל ה'.

Question: [There is a fifth Kahal -] "Banim Asher Yivaldu Lahem Dor Shelishi Yavo Lahem bi'Kehal Hash-m"!

Answer: That is written about an Aseh. (R. Yehudah counts only Kehal Hash-m written about Lavim.)

דרבנין אמרין שלשה קהילות אינון. קהל כהנים קהל לווים קהל ישראלים. לא יבא. לא יבא לא יבא.

Rabanan say that there are three Kehilos - Kehal Kohanim, Kehal Leviyim, Kehal Yisraelim (corresponding to three times that it says Kehal Hash-m regarding Lo Yavo; we do not learn from a fourth Kahal from the first time, for it is needed for the simple meaning. Therefore, Kehal Gerim is not called Kahal.)

WHOSE DAUGHTERS ARE FORBIDDEN TO KEHUNAH? (Yerushalmi Perek 8 Halachah 2 Daf 48a)

דלמה רבי (יהושעיה) [צ"ל יהושעיה - חשק שלמה] רובה ורבי יודה נשייא הוון יתיבין רהט ר' יוחנן ולחש ליה באודנא דרבי הושעיה רובה פצוע דכא כהן מהו שישא בת גרים.

(a)

A case occurred in which R. Hoshayah Rabah and R. Yehudah ha'Nasi were sitting. R. Yochanan ran and whispered in the ear of R. Hoshayah Rabah - may a Petzu'a Daka Kohen marry a daughter of converts?

אמר ליה מה אמר לך.

R. Yehudah ha'Nasi (to R. Hoshayah Rabah): What did he say to (ask) you?

אמר ליה מילה דנגר בה נגרין לא מפריק ליה. לא אמר לי גיורת שהיא כזונה אצלו. ולא בת ישראל שהיא כחללה. לא אמר לי אלא בת גרים.

R. Hoshayah Rabah: It is a matter that a Chacham ben Chacham cannot answer! He did not ask me about a convert, who is like a Zonah to [a Kohen]. He did not ask me about a Bas Yisrael, who [due to Bi'ah with a Petzu'a Daka] is like a Chalalah. He asked me only about a daughter of converts!

ובת גרים לא כישראל היא.

Question: Is a daughter of converts not like a Yisrael?!

פתר לה כרבי יודה דר' יודה אומר בת גר זכר כבת חלל זכר.

Answer: He asked according to R. Yehudah, for R. Yehudah says that the daughter of a male convert is like the daughter of a male Chalal. (However, she is not an absolute Chalalah - therefore, perhaps she is permitted to a Kohen Petzu'a Daka, who does not have full Kedushas Kohen. We explained this like PNEI MOSHE.)

כהן שבא על גרושה והוליד בת ובת בת מהו.

(b)

Question: If a Kohen had Bi'ah with a divorcee, and fathered a daughter, what is the law of the daughter's daughter [from a Yisrael]?

רבי חיננא ורבי מנא חד אמר כשירה וחד אמר פסולה.

(c)

Answer: R. Chinena and R. Mana argued about this. One said Kosher [to Kehunah], and one said Pasul.

מתיב מאן דאמר כשירה למאן דאמר פסולה. בת חלל זכר אינה חללה מכהונה. אינה מישראל מה את פוסלת.

(d)

Question (the one who said Kosher, to the one who said Pasul): [The Mishnah disqualifies only] the daughter of a male Chalal [but not the granddaughter. The granddaughter] is not a Chalalah from Kehunah. Is her father not a Yisrael?! Why do you disqualify her? (We explained this like PNEI MOSHE.)

ר' יעקב בר אידי בשם ר' יהושע בן לוי מעשה במשפחה אחת (ברודוס) [צ"ל בדרום - קרבן העדה] שהיו קורין עליה ערער

(e)

(R. Yudah bei R. Ilai): A case occurred of a family in the south about which there were accusations [that it is Pasul];

ושלח רבי את רבי רומנוס לבודקה ובדק ומצא שנתגיירה זקינתה פחות מבת שלש שנים ויום אחד והכשירה לכהונה.

Rebbi sent R. Rumnus to check it. He checked it, and found that the grandmother converted before three years and a day, and he was Machshir it to Kehunah.

רב הושעיה אמר כרבי שמעון הכשירה.

(f)

Opinion #1 (R. Hoshayah): He was Machshir it like R. Shimon. (Since she converted before three years, she was Kosher for Kehunah.)

אמר רבי זעירה דברי הכל הוא.

(g)

Opinion #2 (R. Ze'irah): All agree [that it is Kosher];

(הכא) [צ"ל כהדא - קרבן העדה] דאמר ר' זעירא בשם רב אדא בר אחווא. רבי יודן מטי בה בשם רב. רבי אבהו בשם רבי יוחנן ולד בוגרת כשר שהיא בלא תעשה שהוא בא מכח עשה. [ויקרא כא יג] והוא אשה בבתוליה יקח ולא בוגרת.

This is like R. Ze'irah said in the name of Rav Ada bar Achava, and R. Yudan leaned to say so in the name of Rav, and R. Avahu citing R. Yochanan - the child of a Bogeres [who married a Kohen Gadol] is Kosher [to Kehunah], for [his mother] was forbidden due to a Lav that comes from an Aseh - "v'Hu Ishah bi'Vsuleha Yikach", and not a Bogeres;

כל לא תעשה שהוא בא מכח עשה עשה הוא.

i.

Any Lav that comes from an Aseh is [considered] an Aseh.

[דף מח עמוד ב] ודכוותה [ויקרא כא יד] כי אם בתולה מעמיו יקח אשה ולא (בוגרת) גיורת. כל לא תעשה שהוא בא מכח עשה עשה הוא.

Similarly, "Ki Im Besulah me'Amav Yikach Ishah", and not a convert - any Lav that comes from an Aseh is an Aseh.

התיב רבי הושעיה הרי שני למצרי שהוא בלא תעשה שהוא בא מכח עשה עשה הוא.

(h)

Question (R. Hoshayah): A Mitzri [or Mitzris] Sheni [is forbidden due to] a Lav that comes from an Aseh "Banim Asher Yivaldu Lahem Dor Shelishi Yavo Lahem bi'Kehal Hash-m", which is an Aseh (and her children are Pasul to Kehunah)!

חזר רב הושעיא ואמר לא דומה עשה שבישראל לעשה שבכהנים. עשה שבישראל אסור בכל. עשה שבכהנים. אסור בכהנים ומותר בלוים ובישראל:

Answer (R. Hoshayah): An Aseh of Yisrael is unlike an Aseh of Kohanim. An Aseh of Yisrael is forbidden to everyone. An Aseh of Kohanim is forbidden to Kohanim and permitted to Leviyim and Yisrael (so it is more lenient).
