THE ISUR OF AMONI AND MO'AVI (Yerushalmi Perek 8 Halachah 3 Daf 48b)

מתני' עמוני ומואבי אסורין ואיסורן איסור עולם אבל נקבותיהן מותרות מיד

(a)

(Mishnah): (Male) Amonim and Mo'avim are forever forbidden. Females are permitted immediately;

מצרי ואדומי אינן אסורין אלא עד שלשה דורות אחד זכרים ואחד נקיבות

(b)

Mitzriyim and Edomim are forbidden until three generations, males and females;

אמר רבי שמעון קל וחומר הדברים מה אם במקום שאסר הזכרים איסור עולם התיר את הנקיבות מיד מקום שלא אסר את הזכרים אלא עד שלשה דורות אינו דין שנתיר את הנקיבות מיד

R. Shimon: A Kal va'Chomer [permits females immediately]. When males are forbidden forever (Amon and Mo'av), the females are permitted immediately. When the males are forbidden only for two generations, all the more so females are permitted immediately!

אמרו לו אם הלכה נקבל ואם לדין יש תשובה

Chachamim: If you have a tradition for your law, we accept it. If not, we can challenge your Kal va'Chomer.

אמר להן לא כי הלכה אני אומר

R. Shimon: I have a tradition.

ממזרין ונתינין אסורין ואיסורן איסור עולם אחד זכרים ואחד נקבות:

Mamzerim and Nesinim are forbidden forever, both males and females.

גמ' עמוני ולא עמונית מואבי ולא מואבית.

(Gemara): Amoni [is forbidden], but not an Amonis. Mo'avi [is forbidden], but not a Mo'avis.

ודכוותה אדומי ולא אדומית. מצרי ולא מצרית.

Suggestion: Similarly, we should say Edomi [is forbidden], but not an Edomis. Mitzri, but not a Mitzris!

כתיב [דברים כג ה] על דבר אשר לא קדמו אתכם בלחם ובמים.

Answer #1: (Regarding Amon and Mo'av, there is a reason to forbid only the males.) It says "Al Devar Asher Lo Kidmu Eschem b'Lechem uv'Mayim" (it is normal for men to go out to greet, but not for women).

היה להם לנשים לקדם.

Question: The women should have gone out to greet [the women of Yisrael]!

כתיב [דברים כג ה] (אשר) [נראה שצ"ל ואשר] שכר עליך ואשר יעץ. מי דרכו לשכור האיש ולא האשה. מי דרכו ליעץ האיש ולא האשה.

Answer #2: It says "va'Asher Sachar Alecha" and "Asher Ya'atz" - who normally hires? A man, and not a woman. Who normally counsels? A man, and not a woman. (This applies only to Mo'av. We learn from Mo'av to Amon - CHESHEK SHLOMO.)

Note: The verse "Asher Ya'atz" is from Navi, and it does not say that this is why they are forbidden. OHR YAKOV (39) - it teaches why we should not say that the women are forbidden, for seducing Bnei Yisrael, for their fathers forced them.

כתיב [דברי הימים א ח ח] ושחרים הוליד בשדי מואב מן שלחו אותם חושים ואת בערא נשיו. שחרים זה בועז שהיה משוחרר מן העונות. הוליד בשדה מואב שנשא את רות המואביה.

It says "v'Shacharim Holid bi'Sede Mo'av Min Shilcho Osam Chushim v'Es Ba'ara Nashav" - Shacharim is Bo'az, who was free from sin. "Holid bi'Sede Mo'av" - he married Rus the Mo'aviyah;

מן שלחו אותם שהיה משבטו של יהודה דכתיב ביה [בראשית מו כח] ואת יהודה שלח לפניו וגו'. חושים ואת בערא נשיו. וכי יש לך אדם שהוא מוליד את נשיו. אלא שחש כנמר וביאר את ההלכה.

"Min Shilcho Osam" - he was from Shevet Yehudah, about whom it says "v'Es Yehudah Shalach Lefanav." "Chushim v'Es Ba'ara Nashav" - is there a man who gives birth to his wives?! Rather, he was Chash (quick) like a leopard and Bi'er (explained) the Halachah;

ויולד מן חודש אשתו לא צורכה דלא ויולד מן בערה נשיו

Question: [The next verse says] "va'Yoled Min Chodesh Ishto" - it should have said rather that he fathered [children] from [Chushim and] Ba'ara, his wives!

אלא על ידיה נתחדשה הלכה עמוני ולא עמונית מואבי ולא מואבית.

Answer: Rather, through [Rus] a new Halachah was taught - Amoni, but not an Amonis. Mo'avi, but not a Mo'avis.

כתוב אחד אומר [שמואל ב יז כה] ושמו יתרא הישראלי. וכתוב אחד אומר [דברי הימים א ב יז] יתר הישמעאלי.

Question: One verse says "u'Shmo Yisra ha'Yisraeli", and one verse says "Yeser ha'Yishmaeli"!

רבי שמואל בר נחמן אומר ישמעאלי היה ואת אמרת ישראלי. אלא שנכנס לבית דינו של (ישעיה) ישי. ומצאו יושב ודורש [ישעיה מה כב] פנו אלי והושעו כל אפסי ארץ. ונתגייר ונתן לו את בתו.

Answer #1 (R. Shmuel bar Nachman): He was a Yishmaeli, and you say Yisraeli?! Rather, he entered Yishai's Beis Din and found him sitting and expounding "Penu Elai v'Hivash'u Kol Afsei Aretz [Ki Ani Kel v'Ein Od", i.e. abandon your idols and believe in Me and you will be saved, for everything is in My hands]. He converted, and [Yishai] gave his daughter to him [to marry].

ורבנין אמרין ישראלי היה ואת אמרת ישמעאלי. אלא שחגר מתניו כישמעאלי ונעץ את החרב בבית דין או נהרוג או נהרג או נקיים דברי רבי

Answer #2 (R. Shmuel bar Nachman): He was a Yisraeli, and you say Yishmaeli?! Rather, he girded his loins like a Yishmaeli, inserted his sword in Beis Din [and said] 'we will kill or be killed, or we will fulfill Rebbi's words' (i.e. we will fulfill Shmuel ha'Navi's words, or we will fight mortally - CHESHEK SHLOMO);

כל מי שהוא עובר על הלכה זו בחרב זו אני הורגו. עמוני ולא עמונית מואבי ולא מואבית.

Anyone who transgresses (disputes) this Halachah, I will kill him with this sword - Amoni, but not an Amonis. Mo'avi, but not a Mo'avis. (ALEI TAMAR - this was a Hora'as Sha'ah. Alternatively, Do'eg and those who forbade a Mo'avis were rebelling against Malchus Beis David.)

Note: I.e. this was his intent. Even after this, David accepted Avigayil's claim that Naval is not Mored Malchus, for David's Malchus was not known.

א"ר שמואל בר נחמן אני אין לי אלא (משנה) [צ"ל משבה - הגר"ח קניבסקי שליט"א, עלי תמר] [רות א כב] ותשב נעמי ורות המואביה כלתה עמה השבה משדי מואב זו היא ששבה משדה מואב תחלה.

(R. Shmuel bar Nachman): I know this Drashah from "Shavah" (and not from the Yud at the end of Amoni and Mo'avi) - "va'Teshev Na'ami v'Rus ha'Mo'aviyah Kalasah Imah ha'Shavah mi'Sede Mo'av" - [Rus] was the first to return from Sede Mo'av [to enter Kehal Hash-m; only now they taught that Amonis and Mo'avis are permitted].

אחורי אמר לה [שם ב יא] ותעזבי אביך ואמך אמר לה אילו באת אצלינו מאתמול שלשום לא היינו מקבלין אותך.

Others learn from "va'Ta'azvi Avich v'Imech... [El Am Asher Lo Yadat Temol Shilshom]" - [Bo'az] told [Rus], had you come to us earlier, we would not have accepted you. (We explained this like HA'GAON RAV C. KANIEVSKY, SHLITA.)

תנא רבי זכיי קומי רבי יוחנן בת גר עמוני כשירה בת גיורת עמונית פסולה.

R. Zakai taught in front of R. Yochanan 'the daughter of an Amoni convert is Kosher. The daughter of an Amonis convert is Pasul.

אמר ליה רבי יוחנן בבלייא עברת בידך תלתא נהרין ואתבדת.

R. Yochanan: Babylonian! You crossed three rivers, and falsified [the Halachah]!

אלא היא בת גר עמוני. היא בת גיורת עמונית כשירה.

Rather, the daughter of an Amoni convert is the same as the daughter of an Amonis convert - she is Kosher.

רבי יוסה בשם ר' יוחנן [דף מט עמוד א] (לא כן) [צ"ל לכן - שערי תורת ארץ ישראל] צריכה כשהיתה אמה מישראל. שלא תאמר כשם שנתחללה אמה כך נתחללה בתה.

(R. Yosah citing R. Yochanan): It is needed to teach about when the mother is from Yisrael. Do not say that just like the mother became a Chalalah, so her daughter became a Chalalah.

רבי אבהו בשם רבי יוחנן כשירה אפילו לכהן גדול.

(R. Avahu citing R. Yochanan): [The daughter of an Amoni convert and a Bas Yisrael] is Kosher even to a Kohen Gadol.

Question: What is the reason?

[ויקרא כא יד] (בעמיו) [צ"ל מעמיו - חשק שלמה] עם שהן עשויין שני עממין. זכרים אסורין ונקיבות מותרות.

Answer: It says [a Kohen Gadol will marry a Besulah] "me'Amav" - [he is permitted even from] a nation made of two nations - the males are forbidden and the females are permitted (Amon or Mo'av).

ר' חגיי בשם ר' פדת רבי שמעון בן לקיש לא אמר כן אלא בת גר עמוני פסולה שהיא באה מטיפה פסולה.

(R. Chagai citing R. Pedas): Reish Lakish did not say so. Rather, the daughter of an Amoni convert is Pasul, for she comes from a Pasul drop [of semen, i.e. the Bi'ah was forbidden].

אמר רבי יוחנן ותני כן עממין זה בזה עד שלא נתגיירו זכרים אסורין איסור עולם. ונקיבותיהן מותרות מיד.

(R. Yochanan - Beraisa): If [forbidden] nations married (PNEI MOSHE - an Amoni u'Mo'avi married a Mitzris or Edomis) before they converted, male [children] are forbidden forever, and female [children] are permitted immediately;

נתגיירו זכרים אסורין איסור עולם ונקיבותיהן מותרות לאחר שלשה דורות.

[If they married] after they converted, male [children] are forbidden forever, and female [children] are permitted after three generations.

Note: The Reisha teaches that before conversion, the children are like the father. The coming Beraisa supports this.

רבי חזקיה בשם אחא מתניתא אמרה כן מניין אתה אומר אחד מכל משפחות הארצות שבא על אחת מן הכנענים וילדה ממנו בן מותר לקנותו עבד.

Support (R. Chizkiyah citing Acha - Beraisa) Question: What is the source that if one of any of the nations had Bi'ah with a [female] from a Kena'ani nation, and fathered a child from her, one may buy him for a slave (he need not be killed, for he is not a Kena'ani)?

Answer: "V'Gam mi'Bnei ha'Toshavim ha'Garim Imachem" [you may buy slaves].

יכול אפילו אחד מן הכנענים שבא על אחת מן האומות].

Suggestion: Perhaps this applies even to a Kena'ani who had a child from a Nochris!

Rejection: "Asher Holidu b'Artzechem" - those that fathered in your land (i.e. the father is from elsewhere, and the mother is from your land), and not from those [men] who live in the land [and fathered children from Nochriyos elsewhere].

Question (Shmuel bar Aba): Do generations count for slaves (e.g. if a Mitzri became an Eved Kena'ani, and his grandson was freed, is he considered a first generation Mitzri convert, or a Mitzri Shelishi)?

Answer: A convert who was [initially] an Amoni slave, married a converted Mitzris slave;

אין תימר עבדים [נראה שצ"ל לא] עלו להם דורות [נראה שצ"ל הזכרים אסורים איסור עולם, ונקיבות] מותרין מיד ואין תימר (לא - נראה שצריך למוחקו) עלו להם דורות זכרים אסורין איסור עולם ונקיבות מותרות לאחר שלשה דורות.

If you will say that generations do not count for slaves (they are considered Nochrim, and the child is like the father, so) female [children] are permitted immediately. If you will say that generations count for slaves, (they are considered like converts, and the child has the Pesulim of both parents, so) males are forbidden permanently, and females are permitted after three generations.

Note: Since the Yerushalmi did not establish the question simply about a Mitzri slave, this shows that whether or not generations count, this also determines whether we follow only the father, or Pesulim of both parents. We explained this based on OHR SOMAYACH, Hilchos Isurei Bi'ah 12:19 and SEFER NIR, but changed the text slightly differently.

THE ISUR OF MITZRI AND EDOMI (Yerushalmi Perek 8 Halachah Daf)

אמרו לו אם הלכה נקבל. אם לדין יש תשובה.

(a)

(Mishnah - Chachamim (to R. Shimon)): If you have a tradition [to permit Mitzris or Edomis immediately], we accept it. If you learn from a Kal va'Chomer, we can challenge it.

מה היה להם להשיב.

(b)

Question: What rebuttal could they give?

ר' אבהו בשם רבי יוסי בי רבי חנינה [צ"ל עריות יוכיחו - קרבן העדה] הרי בת בנו ובת בתו הרי הן אסורין עד שלשה דורות אחד זכרים ואחד נקיבות.

(c)

Answer (R. Avahu citing R. Yosi bei R. Chaninah): Arayos disprove this. The daughter of his son and the daughter of his daughter, they are forbidden until three generations. The same applies to males and females.

רבי אבהו אמר ר"ש בן לקיש בעי משיבין דבר שהוא ממזר על דבר שאינו ממזר.

(d)

Question #1 (R. Avahu citing Reish Lakish): Do we challenge from something that [produces] a Mamzer (Arayos) against something that does not [produce] a Mamzer?!

רבי חגיי אמר ר' אבהו בעי משיבין דבר שהוא כרת על דבר שאינו כרת.

Question #2 (R. Chagai citing R. Avahu): Do we challenge from something that has Kares against something that does not have Kares?!

אמר להון לא כי הלכה אני אומר ומקרא מסייעיני. [דברים כג ט] בנים לא בנות.

R. Shimon answered them, I say a tradition, and a verse supports me - "Banim", and not Banos.
