A TREE THAT IS PARTIALLY OBLIGATED (Yerushalmi Orlah Perek 1 Halachah 1 Daf 2b)

(a)

(Beraisa): If a tree is partially in Eretz Yisrael, and partially in Chutz La'aretz, since part is planted in Eretz Yisrael, it is as if it is totally in the land (Ma'aser applies to all of it). Rebbi says so;

R. Shimon ben Gamliel says, the part planted in Eretz Yisrael is obligated. The part planted in Chutz La'aretz is exempt.

(R. Avahu citing R. Yochanan): It is considered like Tevel and tithed mixed together. (All the Peros are obligated according to the portion that nurtures from Eretz Yisrael - OHR YAKOV.)

(R. Ze'ira citing R. Yochanan): An exempt root [totally] exempts.

Question: Is this like Rebbi? Rebbi says that roots live from each other (so we do not give different laws to different parts of the tree).

Limitation: You say that an exempt root [totally] exempts regarding an old root that went from his [property] to another's, but if took root from Chutz la'Aretz to Eretz Yisrael, about this it was not said that an exempt root [totally] exempts.

Question (Mishnah - R. Yosi): Even if the inner is for food, and the outer for a fence, the inner is obligated and the outer is exempt;

Limitation (R. Ze'ira): You say that roots have no significance when [a tree in] Chutz la'Aretz sent out roots to Eretz Yisrael, but when [a tree in] Eretz Yisrael sent out roots to Chutz la'Aretz, roots have significance (to exempt it. We explained this like R. ISAR ZALMAN MELTZAR.)

If one was Mesapek (grafted a young vine) onto an old vine, it is exempt; to [a vine in] Chutz la'Aretz, it is exempt (mid'Oraisa); to Hekdesh, it is liable; to the bottom side [of a tree that is for a fence] or to the top side [of a tree that is for a fence], it is obligated;

To Hekdesh, it is liable, for it is proper to redeem it and obligate it. To the [bottom or] top side, it is obligated, for it is proper to intend [that it be for food] and obligate it.

Question: Does R. Yosi [in our Mishnah, who obligates the side for food and exempts the side for a fence, the inner is obligated and the outer is exempt] hold like R. Shimon ben Gamliel [who obligates the side in Eretz Yisrael, and exempts the side in Chutz La'aretz]?
