BRINGING KADOSH MATTERS FROM CHUTZ LA'ARETZ (Yerushalmi Chalah Perek 4 Halachah 5 Daf 28a)

àðùé àìëñðãøéàä äáéàå çìåúéäï îàìëñðãøéàä åìà ÷áìå îäï.

(a)

(Mishnah): People of Alexandria brought their Chalos from Alexandria, and they did not accept from them.

à"ø áà îøé (åìà øáé çééä øåáà äéà. òåã äåà àéú ìéä åâæøå) [ö"ì òåã äåà úðé øáé çééä øåáà âæøå - ùòøé úåøú àøõ éùøàì] òìéäï åäçæéøåí:

(b)

(R. Ba Mari): Also about this, R. Chiyah Ruba taught that they decreed on them, and they returned [the Chalah to their place. We explained this like SHA'AREI TORAS ERETZ YISRAEL.]

àðùé äø öáåòéí äáéàå áéëåøéí ÷åãí ìòöøú åìà ÷éáìå îäï.

(c)

(Mishnah): People of Har Tzevu'im brought their Bikurim before Shavu'os, and they did not accept from them.

úðéðï úîï àéï îáéàéï áëåøéí îù÷éï.

(d)

(Mishnah): We do not bring liquid Bikurim [except for what comes from olives and grapes].

øáé äéìà áùí øáé ìòæø ëéðé îúðéúà àéï òåùéï áëåøéí îù÷éï àôéìå îùæëå áäï (áòìéí) [ö"ì äëäï - äâø"à]

(e)

(R. Heila citing R. Lazar): Our Mishnah means that we do not make liquids from Bikurim (i.e. squeeze them for their juice, except for what comes from olives and grapes. However, we do not bring liquid Bikurim even from olives and grapes. We explained this like GRA.)

åäúðé ãøê áéëåøéí îù÷ä ìäáéàï. îðééï ùéáéà úìîåã ìåîø úáéà.

(f)

Question (Beraisa): If it is normal to make a [species from which we bring] Bikurim into a liquid, what is the source that we bring [the liquid]? It says "T\avi".

úéôúø ùì÷èï îùòä äøàùåðä òì îðú ëï. åëàï ìà ì÷èï îùòä øàùåðä òì îðú ëï:

(g)

Answer: That is when he picked [the Bikurim] from the beginning with that intent. Here (R. Heila) discusses when he did not pick them from the beginning with that intent.

[ãó îè òîåã à (òåæ åäãø)] åàúééà ëîàï ãàîø ôñçï ùì ðùéí øùåú.

(h)

(Our Mishnah says that Yosef ha'Kohen brought his sons and household to do Pesach Katan, and they returned him.) It is like the opinion that it is Reshus (optional) for women to fulfill [Korban] Pesach [Rishon, and they may not do Pesach Sheni at all].

úðé äàùä òåùä ôñç äøàùåï ìòöîä åäùðé èôéìä ìàçøéí ãáøé øáé îàéø.

1.

(Beraisa): A woman may do Pesach Rishon by herself, and the Sheni she may be secondary to others (if men offer it, she may join them, but women by themselves may not offer it). R. Meir says so;

øáé éåñé àåîø äàùä òåùä ôñç ùðé ìòöîä àôéìå áùáú åàéï öøéëä ìåîø äøàùåï.

2.

R. Yosi says, a woman may do Pesach Sheni by herself, and even on Shabbos (offering it overrides Shabbos), and there is no need to say [that the same applies to] the first;

[ãó ëç òîåã á] øáé ùîòåï áï àìòæø àåîø äàùä òåùä ôñç øàùåï èôéìä ìàçøéí åàéðä òåùä ôñç ùðé.

3.

R. Shimon ben Elazar says, a woman may do Pesach Rishon secondary to others, and she does not do Pesach Sheni.

îä èòîà ãøáé îàéø [ùîåú éá â] àéù ùä ìáéú àáåú àí øöå ùä ìáéú.

4.

What is R. Meir's reason? "Ish Seh l'Veis Avos" - if they want, Seh (a kid or lamb) l'Bayis (for a woman).

îä èòîà ãøáé éåñé àéù ùä ìáéú àáåú ëì ùëï ìáéú.

5.

What is R. Yosi's reason? "Ish Seh l'Veis Avos" (family), and all the more so l'Bayis (one's wife is like himself; it is obligatory - MAHARA FULDA).

îä èòîà ãøáé ùîòåï áï àìòæø àéù åìà àùä.

6.

What is R. Shimon ben Elazar's reason? "Ish", and not a woman.

îä î÷ééîéï øáðéï àéù ôøè ì÷èï.

7.

What do Rabanan (R. Meir and R. Yosi) learn from "Ish"? It excludes a minor.

àîø øáé éåðä åàôéìå ìîàï ãàîø (çåáä) [ö"ì øùåú ìîä äçæéøåäå - äâø"à]

(i)

Question (R. Yonah): Even according to the opinion that [Pesach Rishon is] Reshus, why did they return him?

ùðééà äéà ùäãáø îñåéé' ùîà é÷áò äãáø çåáä.

(j)

Answer: He was distinguished. Perhaps they would fix the matter to be a Chiyuv.

ìà ëï (ñáøðï îéîø) [ö"ì úðéðï - ø"ù ñéøéìéå] ÷åãí ìùúé (çìåú) [äìçí] ìà éáéà åàí äáéà ëùø.

1.

Question: Did a Mishnah not teach that before Shtei ha'Lechem, one may not bring (Menachos from the new grain), and if he brought it is Kosher?! (If so, why did they return Yosef ha'Kohen?)

ùðééà äéà ùäãáø îñåééí ùîà é÷áò äãáø çåáä.

2.

Answer: Here was different. He was distinguished. Perhaps they would fix the matter to be a Chiyuv.

[ãó îè òîåã á (òåæ åäãø)] åìà ëï úðéðï àí áàå úîéîéï é÷øáå.

3.

Question: Did a Mishnah not teach that if they brought Tam [Bechoros from Chutz la'Aretz], they are offered?

ùðééà äéà ùäãáø îñåééí ùîà é÷áò äãáø çåáä.

4.

Answer: Here was different. He was distinguished. Perhaps they would fix the matter to be a Chiyuv.

àøéñèåï äáéà áéëåøéå îàôîéà å÷éáìå îîðå.

(k)

(Mishnah): Ariston brought his Bikurim from Apamya, and they accepted from him.

úîï úðéðï àéï îáéàéï úøåîä îçåõ ìàøõ ìàøõ.

(l)

(Mishnah): We do not bring Terumah from Chutz la'Aretz to Eretz Yisrael.

(åéáéàå áéëåøéï) [ö"ì îàé ùðà îáéëåøéï - äâø"à]

(m)

Question: Why [is Terumah] different than Bikurim?

àîø øáé äåùòéà áéëåøéí áàçøéåú äáòìéí. úøåîä àéðä áàçøéåú äáòìéí. àí àåîø àú ëï àó äï îøãôéï (ìàçøéä) [ö"ì ìàçøéä àçøéäï - äâø"à] ìùí:

(n)

Answer (R. Hoshayah): Bikurim, the owner has responsibility to bring them [to the Mikdash]. Terumah, the owner has no responsibility to bring them [to Eretz Yisrael]. If you will say [that he may bring], even they (Kohanim) will pursue after them to there (which is forbidden, for Chachamim decreed Tum'ah on Chutz la'Aretz, including Surya. We explained this like GRA.)
