IS TEVEL BATEL IN A MAJORITY? (Yerushalmi Chalah Perek 3 Halachah 5 Daf 19b)

(a)

Question (R. Bun bar Chiyah, to R. Ze'ira): If a Minchah became mixed with Chulin, can he take a Kemitzah, and permit eating the Shirayim? (Perhaps some of the Kometz is Chulin, so it does not permit. Or, the Chulin is Batel to the Minchah, so the Kometz is valid.)

Answer (R. Ze'ira): (Yes!) I apply to it "veha'Noseres Min ha'Minchah l'Aharon u'Vanav"!

Question (R. Bun bar Chiyah): If Tevel became mixed with Chulin, do I apply to it "u'Nesatem Mimenu Es Terumas Hash-m l'Aharon ha'Kohen"! (Can one tithe from it as if it is all Tevel?!)

(d)

Answer (R. Ze'ira): (Our Mishnah says that when Chulin became mixed with a Tevel dough, if he has no other Tevel dough, he takes one Chalah for everything.) Did I tell you that he separates from [the mixture] only on it (the mixture itself), and not on another place?!

1.

If it is obvious to you that he cannot separate from it on another place, even from it on it (the mixture itself) he cannot separate!

2.

Our Mishnah says that he can separate on it itself, for we learned 'if not, he takes one Chalah for everything'!

Rebuttal: R. Ze'ira's answer to R. Bun bar Chiyah is not proper!

(f)

Question: (Why is it improper?) What is the difference between separating from it on itself, and separating from it on another place?

(g)

Answer: When he separates from it on itself, since that Tevel cannot become [all] Terumah (there must be a remnant of Chulin), the Chulin in [the mixture] cannot be Mevatel [the Tevel, for it is like Min b'Mino; our Sugya holds like R. Yehudah, that Min b'Mino is not Batel);

áùòä ùäåà îåöéà îîðå ìî÷åí àçø äåàéì åàåúå äèáì éëåì ìäòùåú (çåìéï ëéåöà áå ìà) [ö"ì úøåîä ëéåöà áå - äâø"à] [ãó ë òîåã á] áèì.

1.

When he separates from it on elsewhere, since that Tevel can become [all] Terumah, [the Tevel], which is like [Terumah, since there need not remain any Chulin, it is Min b'Eino Mino], and it is Batel (in the Chulin).

[ãó ìã òîåã à (òåæ åäãø)] àîø øáé éåñé äãà àîøä èáì ùðúòøá' áúøåîä (äåàéì åàåúå äèáì éëåì ìäòùåú ëúøåîä ëéåöà áå ìà áèì) [ö"ì îåúø ìäåöéà îîðå òì î÷åí àçø - äâø"à]

2.

Inference (R. Yosi): This teaches that Tevel that became mixed with Terumah, one may separate from it on another place. (We explained this like GRA.)

Question: R. Bun bar Chiyah's question against R. Ze'ira was not difficult!

îä ðôùê àí ùìîòìï áèì àó ùìîèï áèì

1.

No matter what you will say - if what is above (the Kometz that he takes off) is Batel [in a majority of Chulin, for it is Min b'Mino], also what is below is Batel (there is no Kedushah to the Shirayim, and Kohanim may eat them)!

àí ùìîèï ìà áèì àó ùìîòìï ìà áèì ùëáø ÷éãùúðå.

2.

If what is below (the Shirayim) is not Batel, also what is above (the Kometz) is not Batel (and it permits the Shirayim to Kohanim), for he already was Mekadesh it!
