WHAT IS CONSIDERED AN ACTION? (Yerushalmi Halachah 9 Daf 38a)
רבי שמואל בר נחמני בשם רבי הושעיה האומר לו אלי אתה מחלוקת (רבי) [צ"ל ר"ע - קרבן העדה] וחכמים.
(R. Shmuel bar Nachmani citing R. Hoshayah): If one says to an idol "you are my god", R. Akiva and Chachamim argue about this. (R. Akiva holds that one is Chayav Chatas for blasphemy b'Shogeg, for speech is considered an action - Bavli Kerisus 3b).
השתחוה לה מהו
Question: If one bowed to an idol, what is the law? (Is this considered an action to be Chayav Chatas b'Shogeg?)
רבי יוחנן אמר דברי הכל מודין בכפיפת קומה שהוא חייב.
Answer #1 (R. Yochanan): All agree that if he bends his stature, he is liable.
מה בין המעלה והמוריד קומתו ומה בין המעלה והמוריד שפתותיו
Question (R. Aba bar Zimna, to R. Zeirah): What is the difference between lifting and lowering his stature, and lifting and lowering his lips? (Chachamim exempt for the latter!)
ר' יוחנן אמר (במחלוקת) [צ"ל הועיל וישנו בלב - קרבן העדה]
Answer (R. Yochanan): [All agree that speech is an action. Chachamim exempt Megadef] because it depends on intent.
ריש לקיש אמר במחלוקת.
Answer #2 (Reish Lakish): They argue [about bowing just like they argue about blasphemy. We explained the Sugya like KORBAN HA'EDAH.]
אמר רבי זעירא קרייא מסייע לריש לקיש תורה אחת יהיה לכם לעושה בשגגה. אין לי אלא דבר שהוא מעשה המגדף והמשתחוה שאינן מעשה מניין:
(R. Zeirah): [A Drashah on] a verse supports Reish Lakish. "Torah Achas Yihyeh Lachem la'Oseh bi'Shgagah" refers only to an action. What is the source for Megadef and bowing, which are not an action? (This shows that there is an opinion that does not consider bowing to be an action.)
