R. YEHUDAH'S OPINION (Yerushalmi Bikurim Perek 1 Halachah 1 Daf 1b)

(a)

Question (R. Zerikan, to R. Ze'ira): Is our Mishnah like Rebbi? Rebbi says that [if a tree has roots on both sides of a border, both sides of the tree] live (nurture) from each (roots on both sides. Therefore, one who was Mavrich does not bring even from what is in his property.)

àîø ìéä ãáøé äëì äéà. äëà äúåøä àîøä [ùîåú ëâ éè] øàùéú áëåøé àãîúê òã ùéäå ëì äâéãåìéí îàãîúê.

Answer (R. Ze'ira): It is like everyone. Here, the Torah said "Reishis Bikurei Admasecha" - all the growth must be from your land.

Question: According to R. Yehudah, what is the difference between one who plants in his and was Mavrich into an individual's, and one who plants in his and was Mavrich into his, and an individual's path is in the middle? (He argues only about the latter!)

Answer #1 (R. Acha citing R. Maisha): The case is, he was Mavrich through a pumpkin or pipe (so it does not nurture from the individual's path).

Objection: If he was Mavrich through a pumpkin or pipe, he should bring and recite (why did R. Yehudah say only that he brings)? And even according to Rabanan, he should bring and recite!

Answer #2 (R. Yonah): R. Yehudah is unsure about one who sold a path (over his Havrachah) to his friend. Did he sell a place to walk, or did he sell [also the ground underneath] until the depth?

If you will say that he sold a place to walk (he still owns the ground underneath, so) he brings and recites. If you will say that he sold until the depth, he does not bring at all. Amidst Safek, he brings and does not recite. (We explained this like R. SHLOMO SIRILIYO.)

Rabanan hold that clearly, he sold until the depth (so he does not bring at all).

(g)

Limitation: When do they argue? It is about one who sold a path to his friend, but if he sold a field to him and left a path for himself, all agree that he left over for himself until the depth.

(Mishnah): One may not make a hollow under Reshus ha'Rabim, e.g. a Bor, Si'ach or Ma'arah;

R. Eliezer permits, [if it is covered strongly] enough that a wagon laden with intent rocks can pass over it.

Answer (R. Yosi): R. Shmuel bar Rav Yitzchak holds that R. Eliezer permits doing so (digging), and it is his forever. (He errs!) Rather, R. Eliezer permits doing so, and whoever comes first [to acquire it], merits (to use it. Since it is not totally his, he brings and does not recite.)
