DOES ONE BRING BIKURIM FROM HAVRACHAH? (Yerushalmi Bikurim Perek 1 Halachah 1 Daf 1a)

(a)

(Mishnah): Some bring Bikurim and recite [the Parshah]. Some bring and do not recite. And some do not bring.

àìå ùàéðï îáéàéï äðåèò áúåê ùìå åäáøéëå áúåê ùì éçéã àå áúåê ùì øáéí. åëï äîáøéê îúåê ùì éçéã àå îúåê äøáéí ìúåê ùìå.

(b)

The following do not bring - one who plants in his [land] and was Mavrich (inserted a branch into the ground, and a new growth comes out of the ground elsewhere) into [land] of [another] individual or Rabim, or one who is Mavrich from [land of] an individual or Rabim into his own;

äðåèò áúåê ùìå åäîáøéê áúåê ùìå åãøê äéçéã åãøê äøáéí áàîöò äøé æä àéðå îáéà.

One who plants in his and was Mavrich into his, and an individual's path or a public path is in the middle, he does not bring;

(c)

R. Yehudah says, he brings.

îàéæä èòí àéðå îáéà îùåí ùðàîø [ùîåú ëâ éè] øàùéú áëåøé àãîúê úáéà òã ùéäå ëì äâéãåìéí îàãîúê:

Why does he not bring [according to Chachamim]? It is due to "Reishis Bikurei Admasecha Tavi" - all the growth must be from your land.

âî' éù îáéàéï ëå'. äðåèò áúåê ùìå åäáøéê áúåê ùì éçéã àå ìúåê ùì øáéí àôéìå îï äæ÷éðä àéðå îáéà.

(e)

(Gemara): Some bring.... one who plants in his and was Mavrich into an individual's or Rabim, he does not bring even from the old (original tree).

äîáøéê îúåê ùì éçéã àå îúåê ùì øáéí ìúåê ùìå àôéìå îï äéìãä àéðå îáéà.

(f)

One who is Mavrich from [land of] an individual or Rabim into his own does not bring even from the young (the new tree that emerged from the ground).

äãà àîøä ëùí ùäéìãä çéä îï äæ÷éðä ëê äæ÷éðä çéä îï äéìãä.

(g)

Inference: Just like the young lives (nurtures) from the old, so the old lives from the young. (This is why he may not bring even from the part in his land.)

(h)

Opinion #1 (R. Yochanan): All of these [do not bring] because they entered [others' land] in the status of a Gazlan (robber).

Opinion #2 (R. Yosi): Our Mishnah gives the reason why he does not bring, for it says "Reishis Bikurei Admasecha" (it is not your land. We explained this like GILYONEI HA'SHAS.)

(Beraisa): If he was Mavrich with permission, he brings and recites.

Limitation (R. Yosi citing R. Imi): This is if [the owner] gave to him permission [to leave it there] permanently. If it was temporary, no.

(R. Yonah citing R. Imi): It is even if it was temporary.

Source (for R. Yonah - Mishnah): If one was digging a Bor, Si'ach or Ma'arah (pits of different shapes, and he encountered roots of another's tree), he cuts and descends, and the wood is his.

Is the wood not temporary (it is only until the neighbor digs a pit, and still, he brings and recites?! The same applies to Havrachah!)

Question: How does R. Yosi explain this?

Answer: Normally, roots always regenerate. Since they grow back (and he has permission for them to be in his neighbor's land), this is permanent. (Havrachah will not grow back. We explained this like RIDVAZ.)

(R. Mana): R. Yochanan's teaching supports my father (R. Yonah);

(R. Yochanan): All of these [do not bring] because they entered in the status of a Gazlan.

Here, since he gave to him permission, even temporarily, he is not a Gazlan!
