12th CYCLE DEDICATION

ME'ILAH 3 (26 Nisan) - dedicated by Mr. Avi Berger of Queens, N.Y./Passaic, N.J. in memory of his mother, Leah bas Michel Mordechai, in honor of her Yahrzeit.

1)

DOES THE LAST LIQUID ABSORBED EXPEL THE FIRST? (Yerushalmi Orlah Perek 2 Halachah 7 Daf 15a)

îúðé' ëìéí ùñëï áùîï èîà åçæø åñëï áùîï èäåø àå ùñëï áùîï èäåø åçæø åñëï áùîï èîà øáé ìéòæø àåîø àçø äøàùåï àðé áà [ãó ì òîåã á (òåæ åäãø)] åçëîéí àåîøéí àçø äàçøåï:

(a)

(Mishnah): Kelim that one anointed with Tamei oil, and he returned and anointed them with Tahor oil, or he anointed them with Tahor oil, and he returned and anointed them with Tamei oil, R. Eliezer says, I follow the first one (if it was Tahor, what exudes is Tahor, and vice-versa). Chachamim say, [we follow] the last one.

(b)

(Gemara) Question: What is R. Li'ezer's reason?

[ö"ì äàçøåï îåöéà àú äøàùåï - äâø"à]

(c)

Answer: The last expels the first.

[ö"ì îä èòîà ãøáðï - äâø"à]

(d)

Question: What is Rabanan's reason?

äøàùåï îåöéà àú äàçøåï.

(e)

Answer: The first expels the last.

àîø øáé éåçðï øáé éäåãä åøáé ìéòæø ùðéäï àîøå ãáø àçã

(f)

(R. Yochanan): R. Yehudah and R. Li'ezer said the same matter;

ãúðéðï úîï öìåçéú ùôéä öø èåáì åîòìä ëãøëå

1.

(Mishnah): A flask [of Mei Chatas] whose mouth is narrow, one immerses [the hyssop in it] and raises it (takes it out) normally (without concern lest when pressed against the mouth, liquid of the hyssop was pressed out, and part of what he sprinkles is not Mei Chatas. This is like Chachamim, who hold that the first expels the last, so liquid of the hyssop never exudes);

øáé éåãä àåîø äæéä äøàùåðä.

2.

R. Yehudah says, the first Haza'ah [is Kosher, but not subsequent Haza'os. When the hyssop was removed from the flask, presumably, it pressed against the mouth. Perhaps water was pressed into the hyssop, and liquid of the hyssop exuded, and it is part of the liquid remaining on it, and a Shi'ur of Mei Chatas does not remain on it. The first Haza'ah is Kosher, for surely it has a Shi'ur];

i.

Note: If he dries it and immerses it again, he may sprinkle again (CHAZON ISH 8:7). The argument is to sprinkle again without doing so. In a Tosefta (Nega'im 8:2), R. Yehudah permits using the same cedar branch to be Metaher different Metzora'im. He is not concerned lest the blood is mixed with sap that exuded when he immersed it for the previous Metzora! Below, we say that R. Yehudah is stringent even for Kelim with a wide mouth. (PF)

ëîä ãøáé éåãä àåîø äøàùåï îåöéà àú äàçøåï ëï øáé ìéòæø àåîø (àåó äëà - äâø"à îåç÷å) äøàùåï îåöéà àú äàçøåï.

3.

Just like R. Yehudah says that the last expels the first, so R. Li'ezer says, the last expels the first. (We explained this like GRA.)

òã ëãåï ëùñê îéëï (åîöà áöã äùðé) [ö"ì åîéëï - äâø"à] ñê îéëï åîöà îéëï [ãó èå òîåã á] îä àîø áä øáé ìéòæø.

(g)

Question: [Perhaps R. Li'ezer said so] only when he anointed [the first time] from here and from here (both sides of the Kli). If he anointed from here, and [anointed the second times and] found here (on the other side), what does R. Li'ezer say? (Does he say even then that the last expelled the first?)

ðùîòðä îï äãà ãàîø øáé àáäå áùí ø' éåçðï ìà ñåó ãáø öìåçéú [ãó ìà òîåã à (òåæ åäãø)] àìà àôéìå ñôì. åàîø øáé éåçðï øáé éåãä åøáé ìéòæø ùðéäï àîøå ãáø àçã.

(h)

Answer: We learn from the following. R. Avahu, citing R. Yochanan, said 'this is not only a flask, rather, also a Sefel (a Kli with a wide mouth, so the hyssop is not pressed), and R. Yochanan said that R. Yehudah and R. Li'ezer said the same matter;

àéú ìê îéîø úîï (ëùñê îéëï åîöà áöã äùðé. ìà ëùñê îéëï åîöà) [ðøàä ùö"ì ëùèáì îéëï åîæä áöã äùðé ìà ëùèáì îéëï åîæä îëàï] àåó äëà ëùñê îéëï åîöà îéëï:

1.

Can you say there that he immersed here and sprinkles on the other side (that was not immersed?! Surely not!) Rather, he immersed here and sprinkles here (on the same side, and R. Yehudah is concerned lest hyssop liquid exuded here). Also here, [only] when he anointed from here and found here (on the same side, R. Li'ezer says that the last expelled the first. I based this Perush on GRA, with additions. - PF)

2)

ISURIM THAT JOINED TO FERMENT (Yerushalmi Orlah Perek 2 Halachah 8 Daf 15b)

(a)

(Mishnah): If Se'or of Terumah and of Kil'ai ha'Kerem fell into a dough, and this one is not enough to ferment it, and this one is not enough to ferment it, and they joined and fermented it, it is forbidden to Zarim and permitted to Kohanim;

ø"ù îúéø ìæøéí åìëäðéí.

(b)

If spices of Terumah and of Kil'ai ha'Kerem fell into a pot, and this one is not enough to season it, and this one is not enough to season it, and they joined and seasoned it, it is forbidden to Zarim and permitted to Kohanim;

øáé ùîòåï îúéø ìæøéí åìëäðéí:

If this one is enough to ferment it, and this one is enough to ferment it, and they joined and fermented it, it is forbidden to Zarim and to Kohanim;

ø' ìòæø áø' ùîòåï îúéø [ö"ì ìëäðéí åàåñø - äâø"à] ìæøéí.

1.

R. Elazar b'Ribi Shimon permits to Kohanim and forbids to Zarim.

(e)

Question (R. Avahu citing R. Yochanan): What is the difference between Terumah to Zarim, and Shevi'is to Kohanim? Is Terumah forbidden to Zarim, and Shevi'is permitted to Kohanim?! (Just like R. Elazar b'Ribi Shimon forbidden to Zarim, he should forbid to Kohanim!)

[ãó ìà òîåã á (òåæ åäãø)] çæø åàîø øáé éåçðï úéôúø ùðôì ùàåø ùì úøåîä úçéìä ìà áàú ùáéòéú àìà ìôâåí.

(f)

Answer #1 (R. Yochanan): The case is, Se'or of Terumah fell in first. The Shevi'is came only li'Fgam (harmed the taste, so it remains permitted to Kohanim).

øáé ìòæø áé ø' ùîòåï áùéèú àáéå.

1.

R. Elazar b'Ribi Shimon holds like his father.

2.

Question: How is this like his father?

3.

Answer #1: Just like R. Shimon says that Nosen Ta'am li'Fgam is permitted, R. Elazar b'Ribi Shimon says that Nosen Ta'am li'Fgam is permitted.

4.

Answer #2 (R. Aba Mari): How is this like his father? Just like R. Shimon says that all Sefichim (things that grow by themselves) are permitted [in Shemitah], so, R. Elazar b'Ribi Shimon says that says that all Sefichim are permitted. (Therefore, Se'or of Shevi'is is permitted to all.)

ëìåí àîø øáé ùîòåï àìà áñôéçé éø÷ ãìîà áñôéçé æøòéí.

5.

Question: R. Shimon [permitted] only Sefichim of vegetables. Did he permit Sefichim of Zera'im (crops grown to eat the seeds, e.g. grain, from which is made Se'or)?!

å÷îú äéà ñôéçé éø÷ äéà ñôéçé æøòéí.

6.

Answer: [Indeed, R. Elazar b'Ribi Shimon] equates Sefichim of vegetables and Sefichim of Zera'im (he permits both of them).

øáðéï ã÷éñøéï àîøéï àçú áùéèú àáéå åàçú áùéèú çëîéí.

7.

Observation (Rabanan of Kisarin): In one way he holds like his father, and in one way he holds like Chachamim;

áùéèú àáéå îùåí ðåúðé èòí ìôâí îåúø. áùéèú çëîéí îùåí ùîåú îöèøôéï:

i.

He holds like his father, that Nosen Ta'am li'Fgam is permitted. He holds like Chachamim, that Shemos (different Isurim) join. (This is why he forbids in the Reisha, when neither can ferment by itself.)
