THE LAW OF ONE WHO REBELS (Yerushalmi Perek 5 Halachah 8 Daf 37b)

מתני' המורדת על בעלה פוחתין לה מכתובתה שבעה דינרין בשבת

(a)

(Mishnah): If a woman rebels against her husband (this will be explained), we reduce her Kesuvah by seven Dinarim every week;

רבי יהודה אומר שבעה טרפעיקין

(b)

R. Yehudah says, [we deduct every week] seven Tarpa'ikin.

עד מתי הוא פוחת עד כנגד כתובתה

Until when does he deduct? It is up to her Kesuvah (until it is depleted);

רבי יוסי אומר לעולם הוא פוחת והולך שאם תפול לה ירושה ממקום אחר יגבה אותה ממנה

R. Yosi says, we decrease indefinitely (and record how much she owes to him). Perhaps she will inherit money from elsewhere, and he will collect [her debt to him] from it!

וכן המורד על אשתו מוסיף לה על כתובתה שלשה דינרין בשבת רבי יהודה אומר שלשה טרפעיקין:

R. Yehudah says, [we add each week] three Tarpa'ikin.

גמ' הכא את מר שבעה והכא את מר שלשה

(Gemara) Question: Why here (when she rebels), you say [that we deduct each week] seven, and here (when he rebels), you say [that we add each week only] three?

אמר רבי יוסי בר חנינה היא על ידי שהיא חייבת לו שבע הוא פוחת ממנה שבע והוא על ידי שהוא חייב לה שלשה הוא מוסיף לה שלשה

Answer #1 (R. Yosi bar Chaninah): She, since she is obligated to him seven [labors], he deducts from her seven. He, since he is obligated to her three (She'er Kesus v'Onah), he adds to her three.

הגע עצמך שהכניסה לו עבדים הרי אינה חייבת לו כלום

Question: Exert yourself [and you will find the answer]! If she entered slaves to him, she is not obligated to do any [labors] for him! (Why do we deduct from her Kesuvah if she rebels?)

הגע עצמך שהתנה עמה לא שאר ולא כסות ולא עונה הרי אינו חייב לה כלום

Question: Exert yourself! If he stipulated with her, that [he is not obligated in] She'er Kesus v'Onah, he has no obligation to her! (Why do we add to her Kesuvah if he rebels?)

Question: How can we answer this?

Answer #2: It is like R. Yochanan said - a man's pain (when he is denied Onah) is greater than a woman's.

הדא הוא דכתיב [שופטים טז טז] ויהי כי הציקה לו בדבריה כל הימים ותאלצהו מהו ותאלצהו

Source - Question: "Va'Yhi Ki Hetzikah Lo vi'Devareha Kol ha'Yamim va'T'altzehu" - what is "va'T'altzehu"?

Answer (R. Yitzchak bar Lazar): [Delilah] would slip away from under [Shimshon, in the middle of Bi'ah].

ותקצר נפשו למות הוא קצרה נפשו למות היא לא קצרה נפשה למות

"Va'Tiktzar Nafsho Lamus" - he was close to death (from the pain). She was not close to death.

ויש אומרים שהיתה עושה צורכה באחרים

Rebuttal: Some say that [there is no source from here. She was not close to death, for] she did her needs (satisfied her desire) through others (i.e. Zenus).

Rejection: [If so,] all the more so she would demand [to have Bi'ah with Shimshon]!

דאמר (רב נחמן בשם רב נחמן) [צ"ל ר' נחמן בשם רבי מנא - שערי תורת ארץ ישראל] האבר הזה שבאדם הרעיבתו השביעתו השביעתו הרעיבתו

(R. Nachman citing R. Mana): This Ever (of Bi'ah) in man - if he starves it (uses it infrequently, his lust is decreased and) it satiates him. If he satiates it (engages in Bi'ah often) it makes him hungry (lustful for Bi'ah).

Question: According to R. Eliezer [who said that Onah is different according to one's job], how much does he deduct? (Perhaps it is based on how many times he misses Onah due to her rebellion!)

Answer: We learn from the following;

תני רבי חייה ארוסה וחולה נדה ושומרת יבם כותבין לה איגרת מרד על כתובתה

(R. Chiyah - Beraisa): An Arusah, Cholah, Nidah or Shomeres Yavam - we write against them Igeres Mered (a letter of rebellion, to deduct) against her Kesuvah.

מה אנן קיימין

Question: What is the case?

אם בשמרדה עליו והיא נדה התורה המרדתה עליו

If when she rebelled, she was Nidah - the Torah made her rebel against (forbade her to) him! (Why do we fine her?!)

אלא כן אנן קיימין שמרדה עליו עד שלא באת נידה ובאת לנידה הרי אינה ראויה למרוד ואת אמר כותבין וכא פוחת

Answer: Rather, she rebelled before she became Nidah, and she became Nidah. She is not proper to rebel (she is forbidden to him now), and you say that we write [Igeres Mered, for he lacks Pas b'Salo, i.e. expectation of intimacy afterwards]. And [also] he deducts (even if he is a sailor, and Onah is only six months from now, for he lacks Pas b'Salo).

Question: Do we deduct from her Nichsei Melug?

נישמעינה מן הדא רבי יוסי אומר לעולם הוא פוחת והולך שמא תפול לה ירושה ממקום אחר ויחזור ויגבה ממנה

Answer: We learn from [our Mishnah]. R. Yosi says, we decrease indefinitely. Perhaps she will inherit money from elsewhere, and he will collect from it!

לא אמר אלא ירושה דבר שאינו מצוי הדא אמרה אפילו לפחות מפרא פרנון דידה פוחת

He said (argues with Chachamim) only about inheritance, which is not common. This teaches that [all agree that] he deducts from Nichsei Melug.
