THE EXTENT OF THE HETER OF PASEI BIRA'OS (Yerushalmi Perek 2 Halachah 1 Daf 15a)

היתה באר אחת גדול לחצייה עשה ולחצייה לא עשה לחצייה שעשה מותר ולחצייה שלא עשה אסור


If there was one big well, and one made [Diyumdin] for half, and for half he did not make, the half for which he made is permitted, and the half for which he did not make is forbidden.

היו שתים האמצעי מהו שידון לכאן ולכאן

If a Chatzer is open to Pasim, one may carry from the Chatzer to the Pasim, and from the Pasim to the Chatzer.

הא שתים אסור


Inference: If there were two Chatzeros [open to Pasim, and a wall is between the Chatzeros, and one may not carry from one Chatzer to the other], it is forbidden [to transfer from a Chatzer to the Pasim].

א"ר בא לא סוף דבר שתי חצירות אלא אפילו חצר אחת ובה שני בתים


(R. Ba): [It is forbidden] not only when there are two Chatzeros - rather, even one Chatzer and two houses [in the Chatzer that may not transfer from one to another, one may not transfer from the Chatzer to the Pasim].

סבריא מימר בשלא עירבו הא אם עירבו מותרין


Assumption: This is when they were not Me'arev, but if they were Me'arev, they are permitted.

רבי דניאל בריה דרב קטינה בשם רב חונא אפי' עיריבו אסורות שאין עירוב עושה אותן אחת


Rejection (R. Daniel brei d'Rav Katinah citing Rav Chunah): Even if they were Me'arev, they are forbidden, for an Eruv does not make them one [regarding carrying between the Pasim.]

רב הונה כדעתיה דאיתפלגון מבוי שצידו אחד עכו"ם וצידו אחד ישראל


Observation: Rav Huna teaches like he taught elsewhere. There was an argument about a Mavuy that has Nochrim on one side and Yisraelim on one side;

רב הונה בשם רב אמר [דף טו עמוד ב] אם עיריבו דרך פתחים העכו"ם אוסר עליהן


(Rav Huna citing Rav): If they were Me'arev through the openings [to the Mavuy], the Nochrim forbid them [and all the more so if they were Me'arev through windows between the houses, the Nochrim forbid them in the Chatzer];

אבא בר בר חנה בשם רבי יוחנן אפילו עיריבו דרך חלונות אין העכו"ם אוסר עליהן


(Aba bar Rav Chanah citing R. Yochanan): Even if they were Me'arev through windows, the Nochrim do not forbid them. (Due to the Eruv, the Yisraelim are like one. Chachamim decreed that a Nochri forbids only in a common case, when at least two Yisraelim are with him.)

ואפי' דיסבור רב הונא כר' יוחנן תמן מותר מודה הוא הכא שהוא אסור


Rejection: Even if Rav Huna held like R. Yochanan that it is permitted there, here he could agree that it is forbidden [to transfer between the Chatzeros and the Pasim];

תמן שמא למחר תחרב הבאר אף הוא סבור לומר שמא עירוב מועיל בפסי ביראות ואין מועיל עירוב בפסי ביריות


There (regarding Pasim), perhaps in the future the well will be inoperative, and he will think that an Eruv helps for Pasei Bira'os, and [really], an Eruv does not help for Pasei Bira'os. (If there is not a working well, there is no Heter. We explained this Sugya like PNEI MOSHE.)

א"ר יוסי בי ר' בון לא התירו פסי ביריות אלא למלאות בהן מים בלבד


(R. Yosi bei R. Bun): They permitted Pasei Bira'os only to draw water in them.
