THE OATH ON THE GARMENT (Yerushalmi Halachah 1 Daf 1b)

כיצד נשבע

Question: What is the text of the oath (in our Mishnah)?

רב הונא אמר שבועה שיש לי בה ואין לי בה פחות משוה פרוטה

Rav Huna: "I swear that I own a part of this garment and it is not less than the value of a peruta.''

אמר רבי יוחנן [דף ב עמוד א] [דף א עמוד ב (עוז והדר)] אם מזו שבועת תקנה היא.

Rejection of proof to R. Chiyah from our Mishnah by R. Ila (R. Yochanan): (This cannot be the correct understanding of the Mishnah, because just as we say that for one person, holding half of it is as if he has witnesses, the same thing applies to the other person with the other half. If so, why not divide it without an oath?!) Rather, the oath discussed in the Mishnah is a Rabbinic enactment to prevent a person coming and grabbing someone's garment and claiming that it is his!
