AVOIDING DISGRACE TO THE MIKDASH (Yerushalmi Perek 9 Halachah 5 Daf 67b)

פיסקא לא יקל אדם את ראשו וכו'

(a)

(Mishnah): One may not act lightheadedly [when facing the eastern gate...].

תני המטיל מים הרי זה הופך פניו כלפי צפון. המיסך את רגליו הרי זה הופך פניו כלפי דרום

(Beraisa): One who urinates, he turns his face to the north. One who moves his bowels, he turns his face to the south. (CHAREDIM - he may not face east or west, lest he expose himself facing the Shechinah in the west. One may not expose his backside to the south, which is the 'right' of the world.)

אמר רבי יוסי בי רבי בון הדא דאמר מתניתא מן הצופים ולפנים.

(c)

(R. Yosi bei R. Bun): The Beraisa discusses one who is from Tzofim (a place from which Har ha'Bayis can be seen) and inside (closer).

רבי עקיבה אומר בכל מקום. ובלבד במקום שאין שם כותל

(d)

R. Akiva says, [it is forbidden] in every place (even in Chutz la'Aretz), but only if there is no wall there (between him and the Mikdash).

תני המיסך את רגליו לא יתן פניו למזרח ואחוריו למערב אלא לצדדין

(e)

(Beraisa): One who moves his bowels, he may not turn his face to the east and his back to the west, rather, to the sides (north or south. This is unlike the previous Beraisa, which forbids facing north.)

ר' יהודה אומר בשעת המקדש

R. Yehudah says, this is at a time while the Mikdash stands.

רבי יוסי אומר מן הצופים ולפנים.

(g)

R. Yosi says, it is from Tzofim and inside.

רבי עקיבה אומר בכל מקום ובלבד במקום שאין בו כותל.

(h)

R. Akiva says, it is in every place, but only if there is no wall there.

[דף צד עמוד א (עוז והדר)] אמר רבי עקיבה נכנסתי אחר רבי יהושע לראות המעשה

R. Akiva: I entered after R. Yehoshua [to the privy] to see [how he does] the act.

אמרו לו מה ראיתה אמר להן ראיתיו יושב וצידו כלפי מערב ולא פירע עד שישב ולא ישב עד ששיפשף ולא קינח בימין אלא בשמאל.

They asked him, what did you see? He said, I saw him sit, and his side was to the west (he faced north or south). He did not uncover himself until he sat. He did not sit until he cleaned (the area where he would sit - HA'GAON RAV C. KANIEVSKY, SHLITA). He did not clean [his anus] with the right hand, rather, with the left.

אף שמעון בן עזאי היה אומר כן נכנסתי אחר רבי עקיבה לראות את המעשה אמרו לו מה ראיתה וכו'.

Also Shimon Ben Azai said so - I entered after R. Akiva to see the act. They asked him, what did you see? ...

תני לא יכנס אדם בהר הבית במנעלו ובאבק שעל רגליו ומעותיו צרורין בסדינו ואפונדתו עליו מבחוץ.

(k)

(Beraisa): One may not enter Har ha'Bayis with his shoe, or dust on his feet, or his coins wrapped in his cloth, or his moneybelt on him outside (his garment).

מה טעם [קהלת ד יז] שמור רגליך באשר תלך אל בית האלהים.

What is the source [regarding duist]? "Shemor Raglecha Ka'asher Telech El Beis Elokim"?

רבי יוסי בר יהודה אומר הרי הוא אומר [אסתר ד ב] ויבא עד לפני שער המלך כי אין לבא אל שער המלך בלבוש שק.

(m)

R. Yosi bar Yehudah says "va'Yavo Ad Lifnei Sha'ar ha'Melech Ki Ein Lavo El Sha'ar ha'Melech bi'Levush Sak;

(אמר) [צ"ל אם - ר"ש סיריליו] לפני ליחה סרוחה כן. על אחת כמה וכמה לפני שער המקום.

If in front of [a mortal king, who comes from] a putrid [drop of semen], it is so (one may not wear sackcloth, even though it is not repulsive), all the more so in front of Hash-m's gate [one may not spit - SEDEI YEHOSHUA].

לא יעשנו קפנדריא ורקיקה מקל וחומר.

(n)

(Mishnah): One may not use Har ha'Bayis as a shortcut. Spitting [is forbidden] from a Kal v'Chomer.

מה אם נעילה שהוא של כבוד את אומר אסור. רקיקה שהוא של בזיון לא כל שכן.

(o)

Wearing shoes, which is honorable (to cover the foot), you say that it is forbidden. Spitting, which is disgraceful, all the more so!
