WHAT IS NEEDED TO RECOGNIZE A MES (Yerushalmi Perek 16 Halachah 3 Daf 82b)

מתני' אין מעידין אלא על פרצוף פנים עם החוטם אף על פי שיש סימנין בגופו ובכליו

(a)

(Mishnah): Witnesses can testify only about (i.e. if they saw) the face, including the nose, even if there are Simanim on his body and clothing.

אין מעידים אלא לאחר שלשה ימים.

(b)

They can testify only after three days;

אפילו מגוייד וצלוב על הצלוב והחיה אוכלת בו אין מעידין אלא עד שתצא נפשו

(c)

Even if they saw him cut up, hanging on a crucifix, and a wild animal was eating him, they can testify only after he died.

ר' יודה בר בבא לא כל האדם ולא כל המקומות ולא כל השעות שוות:

R. Yehudah ben Bava says, it depends on the deceased, the place and the time.

גמ' רב יהודה אמר החוטם עם הלסתות

(Gemara - Rav Yehudah): [They must see] the nose with the jaws.

ואתיא דמר רבי ירמיה בשם רב [ישעי' ג ט] הכרת פניהם ענתה בם זה החוטם.

[Our Mishnah] is like R. Yirmeyah said in the name of Rav, "Hakaras Peneihem Onsah Bam" - this is the nose.

אמר רב חייא בר בא מאן דבעי דלא מתחכמא יהיב איספלני על נחיריה ולא מתחכם.

(R. Chiya bar Ba): One who wants that people not recognize him, he should put bandages on his nostrils, and he will not be recognized.

כהדא ביומי דארסקינס מלכא הויין ציפוראי מתבעין והוון יהבין איספלני על נחיריהון ואינון לא מתחכמין.

This is like in the days of King Arsakinas, people of Tzipori were summonsed [to the king]. They put bandages on their nostrils, and they were not recognized.

ובסיפא איתמר עליהון לישן ביש ואיתצידון כולהון (מן - חשק שלמה מוחקו) בידו.

In the end, people informed on them (that they did so), and all of them were caught.

כתיב [דברי הימים ב יג יז] ויכו בהם אביה ועמו מכה גדולה מאד. אמר רבי אבא בר כהנא שהעביר הכרת פניהם של ישראל [צ"ל זה החוטם - קרבן העדה]

(h)

"Va'Yaku Bahem Aviyah v'Amo Makah Gedolah Me'od" - R. Aba bar Kahana said, [Aviyah] removed from them Hakaras Peneihem of Yisrael (so the bodies would not be recognized, and their widows could not remarry). This is the nose.

(הדא הוא דכתיב הכרת פניהם ענתה בם וגו' זה) [צ"ל ותני כן אין מעידין אלא על פרצוף פנים עם - קרבן העדה] החוטם.

Support (Mishnah): Witnesses can testify only about the face, including the nose.

רבי אמי אמר שהושיב עליהם משמרות שלשה ימים עד שנתקלקל צורתן

(R. Ami): [He did not cut their noses. Rather, to prevent the widows from remarrying,] he guarded [the bodies and did not allow others to see them] for three days, until the form decayed;

הה"ד [ירמי' טו ח] עצמו לי אלמנותיך מחול ימים. (ותני כן אין מעידין אלא על פרצוף פנים עם החוטם - קרבן העדה מוחקו מכאן וגורסו לעיל)

Source: "Atzmu Li Almenosayich me'Chol Yamim" (they were hidden many days).

כתיב [דברי הימים ב יג כ] ולא עצר כח ירבעם עוד בימי אביה )ונגפהו( [צ"ל ונגפהו - קרבן העדה] י"י וימות. אמר רבי שמואל את סבור שהוא ירבעם אינה אלא אביה

(R. Shmuel): "V'Lo Atzar Ko'ach Yarav'am Od bi'Ymei Aviyah va'Yigfehu Hash-m va'Yamos" - you think that Yarav'am [was stricken], but really, it is Aviyah.

Question: Why was he stricken?

רבי יוחנן אמר על שחישד את ירבעם ברבים הה"ד [שם ח] ואתם המון רב ועמכם עגלי הזהב אשר עשה לכם ירבעם לאלהים.

Answer #1 (R. Yochanan): It is because he disgraced Yarav'am in public - "v'Atem Hamon Rav v'Imachem Eglei ha'Zahav Asher Asah Lachem Yarav'am lei'Lohim." (Even though he was a Rasha, one must show honor to a king.)

ריש לקיש אמר על שביזה את אחיה השילוני.

Answer #2 (Reish Lakish): It is because he disgraced Achiyah ha'Shiloni;

הדא הוא דכתיב [שם ז] ויקבצו אליו אנשים בני בליעל על דצווח לאחיה השילוני.

Source: "Va'Yikbetzu Elav Anashim Bnei Veliya'al" - he screamed at Achiyah ha'Shiloni (improperly, for Hash-m commanded Achiyah to appoint Yarav'am to be king over the 10 tribes).

ורבנין אמרין על ידי שבאת ע"ז לידו ולא ביערה

Answer #3 (Rabanan): It is because idolatry came to his hand, and he did not eradicate it;

הה"ד [שם יט] וירדוף אביה אחרי ירבעם וילכד ממנו ערים את בית אל ואת בנותיה וכתיב [מלכים א יב כט] וישם את האחד בבית אל ואת האחד נתן בדן.

Source: It says "va'Yirdof Aviyah Acharei Yarav'am va'Yilkad Mimenu Arim Es Beis Kel v'Es Benoseha", and (he did not destroy the golden calf there, for) it says "va'Yasem Es ha'Echad b'Veis Kel v'Es ha'Echad Nasan b'Dan."

אף על פי שיש בגופו ובכליו

(p)

(Mishnah): Even if there are Simanim on his body and clothing.

ולא כן תני מנין (לאחיך שטעה אתה מחזירו בין בגופו בין בכליו) [צ"ל לשור אחיך שטעה שאתה מחזירו בסימנין בין בגופו בין בכליו שנאמר עד דרוש אחיך אותו - קרבן העדה]

(q)

Question: Was it not taught, what is the source that if your colleague's ox strayed, you return it through Simanim, whether on its body or its Kelim? It says "Ad Drosh Achicha Oso" (this shows that mid'Oraisa, we rely on Simanim)!

שנייא היא שהסימנין דרכן להשתנות.

(r)

Answer: Here is different, for Simanim are prone to change. (It is an enactment mid'Rabanan to return based on Simanim. They enacted for money, but not to permit an Eshes Ish - SHIREI KORBAN.)

Our Mishnah should say "they can testify only until three days [from death]."

ר' (בריה ורב פפי רבי) [צ"ל אבא בריה דר' פפי ור' - שערי תורת ארץ ישראל] יהושע דסיכנין בשם רבי לוי כל תלתא יומין נפשא טייסא על גופה סברה דהיא חזרה לגווה

(R. Aba brei d'R. Papi and R. Yehoshua of Sichnin citing R. Levi): All three days [after death], the Nefesh hovers over the body. It thinks that it will return to it;

כיון דהיא חמית ליה דאישתני זיווהון דאפוי היא שבקא ליה ואזלא ליה

Once it sees that the appearance of his face changed, it abandons it and goes away.

ומן תלתא יומין ולהלן הכרס נבקעת על פניו ואומרת לו הילך מה שגזלת וחמסת.

From three days and onwards, the stomach splits towards his face, and tells it 'take what you stole and [what you] forcibly took [and paid for].'

רבי חגי בשם רבי יאשיה מייתי לה מהדא קרא [מלאכי ב ג] וזריתי פרש על פניכם ואפי' פרש חגיכם

(R. Chagai citing R. Yoshiyah): We learn from "v'Zarisi Peresh Al Peneichem [Peresh Chageichem." Peresh is repeated, to teach that even] excrement of [what you consumed on] your festivals (which were not the way Hash-m commanded, will return to his face).

באותה שעה [איוב יד כב] אך בשרו עליו יכאב ונפשו עליו תאבל:

At that time, "Ach Besaro Alav Yich'av v'Nafsho Alav Te'eval."
