A SUKAH AMONGST TREES, MESSENGERS AND THE SICK (Yerushalmi Halachah 5 Daf 10a)

משנה העושה סוכתו בין האילנות כשירה

(a)

(Mishnah): If a person builds a Sukah between the trees (using the trunks as walls), it is valid.

שלוחי מצוה פטורין מן הסוכה

(b)

Those travelling for the performance of a Mitzvah are exempt from Sukah.

חולי ומשמשיהן פטורין מן הסוכה

(c)

The sick and their aides are exempt from Sukah

אוכלין ושותין עראי חוץ לסוכה

(d)

One may snack outside of the Sukah.

גמרא רב חונה אזל לעייני טב למימנה

(e)

(Gemara): Rav Chuna once travelled to Ain Tav to join the Rabbanim there in declaring the month to be a full month (of 30 days).

מי אתי צחא גו איסרטא ולא קביל עלוי מיטעום כלום עד דעל ליה למטללתיה דר' יוחנן ספרה דגופתא

He became thirsty from the journey but refused to drink anything until he reached the Sukah of R. Yochanan the Scribe in Gufsa (even though he was travelling for the sake of a Mitzvah.)

א"ר מנא לא סוף דבר חולין של סכנה אלא אפי' חולין שאינן של סכנה

R. Mana: Not only does the Mishnah exempt a person who is dangerously sick from Sukah; even one who is not dangerously sick, such as one with a pain in his eye, is also exempt from Sukah.

תני אמר רשב"ג מעשה שהייתי חושש עיניי בקיסרין והתיר לי ר' יוסי ברבי לי ולכל משמשי לישן חוץ לסוכה

Beraisa (Rabban Shimon B"G): I once had a pain in my eye whilst in Kisarin and R. Yosi son of Rebbi permitted me and all of my servants to sleep outside the Sukah.

רבי בא בר זבדא אמר שושבינן וכל בני חופה פטורין מן הסוכה

(i)

R. Ba bar Zavda: Groomsmen and all of the wedding entourage are exempt from Sukah (as they are already involved in a Mitzvah).

תני שומרי העיר ביום פטורין מן הסוכה ביום וחייבין בלילה

Beraisa: People who guard the city in the daytime are exempt from Sukah in the daytime and obligated at night.

שומרי העיר בלילה פטורין מן הסוכה בלילה וחייבין ביום

People who guard the city at night are exempt from Sukah at night and obligated in the daytime.

שומרי העיר ביום ובלילה פטורין מן הסוכה בין ביום ובין בלילה

2.

People who guard the city in the daytime and nighttime are exempt from Sukah both in the daytime and at night.

הדא דאת אמר בשומר גייסות אבל בשומרי ממון עשו אותן כשומר גנות ופרדיסין

(k)

The Beraisa is referring to those who guard against enemy soldiers but those who guard money are the same as those who guard gardens and orchards.

אבודמא מלחא הוה דמך קומי חנותיה עבר רבי חייה בר בא אמר ליה איזיל דמך גו מטללתך

Avudama Malcha was sleeping on front of his shop. R. Chiya bar Ba passed by and told him, "Go and sleep in your Sukah!" (R. Chiya held that protecting money does not exempt a person from Sukah.)

ר' מנא הוה שושביניה דר' יעקב בר פליטי אתא שאיל לר' יוסי א"ל איזיל דמוך גו מטללתך

(m)

R. Mana was the groomsman of R. Yaakov bar Paliti. He asked R. Yosi if he is obligated in Sukah and R. Yosi told him, "Go and sleep in your Sukah!" (R. Yosi held that a groomsman is obligated in Sukah.)

רבי יצחק בר מריון הוה שושביניה דחד בר נש שאיל לרבי לעזר אמר ליה איזיל דמוך גו מטללתך

(n)

R. Yitschak bar Mariyon was someone's groomsman. He asked R. Elazar if he is obligated in Sukah and R. Elazar told him, "Go and sleep in your Sukah!" (R. Elazar also held that a groomsman is obligated in Sukah.)
