READING KESUVIM ON SHABBOS (Yerushalmi Perek 16 Halachah 1 Daf 79a)

אף על פי שאמרו אין קורין בכתבי הקודש אלא מן המנחה ולמעלה אבל שונין ודורשין בהן. צרך דבר נוטל ובודק

(a)

Even though they said that one may read in Kesuvim only from Minchah and onwards (after the Rav's lecture), however one may learn [Midrashim about] them and expound in them. If he needs [to check a verse in them], he takes them and checks.

. דלמא רבי ורבי חייא רבא ור' ישמעאל בי רבי יוסה היו יושבין ופושטין במגילת קינות ערב תשעה באב שחל להיות בשבת מן המנחה ולמעלה. ושיירו בה אל''ף בי''ת אחד.

(b)

A case occurred in which Rebbi, R. Chiya Raba and R. Yishmael bei Rebbi Yosah were sitting and elucidating Megilas Kinos (Eichah) on Erev Tish'ah b'Av that fell on Shabbos, after Minchah, and one Aleph-Beis was left. (I.e. the last Perek. Since the first four Perakim are in the order of the Aleph-Beis, also the last Perek, which has 22 verses but is not in the order of the Aleph-Beis, is called Aleph-Beis - HA'GAON RAV C. KANIEVSKY, SHLITA.)

אמרו (למה) [צ''ל למחר - ספר המכריע לא] אנו באין וגומרין אותה. עם כשהיה נפטר לביתו נכשל באצבעו וקרא על גרמיה [תהילים לב י] רבים מכאובים לרשע.

They said, tomorrow we will finish it. When [Rebbi] was going home, he bruised his finger. He applied to himself "Rabim Mach'ovim la'Rasha.''

א''ל ר' חייא בחובינו מטתך כן דכתיב [איכה ד כ] רוח אפינו משיח ה' נלכד בשחיתותם.

R. Chiya: This happened to you due to our sins - "Ru'ach Apeinu Mashi'ach Hash-m Nilkad bi'Shchisosam.''

אמר לו רבי ישמעאל בי רבי יוסי אילו לא היינו עוסקין בעניין כך היה לנו לומר. על אחת כמה וכמה שהיינו עוסקין בעניין.

R. Yishmael b'Rebbi Yosi: [Even] had we not been engaged with [that verse] we should have said so - all the more so that we were engaged with it [it is a sign from Shamayim that you were punished due to us! Since they left over one Perek, this was only two verses before the last verse that they expounded.]

ועלה לביתו ונתן עליה ספוג יבש וקשר עליה גמי מבחוץ.

Rebbi went to his house and put on it a dry sponge and tied it with a reed on the outside.

א''ר ישמעאל בי ר' יוסי ממנו למדנו ג' דברים ספוג אינו מרפא אלא משמר. גמי שהוא מן המוכן. ואין קורין בכתבי הקודש [דף עט עמוד ב] אלא מן המנחה ולמעלה.

R. Yishmael b'Rebbi Yosi: We learned three things from him - a sponge does not heal, it merely guards. A reed is considered prepared (it is not Muktzah). And we read Kisvei ha'Kodesh [on Shabbos] only from Minchah and onwards. (If not, they would have started earlier.)

i.

Note: They were expounding Eichah. Above, we permit this! Perhaps they were stringent, lest people think that they merely read them. Alternatively, perhaps Rebbi holds like R. Nechemyah below, and forbids expounding before Minchah. PNEI MEIR sustains our text, which holds that even R. Nechemyah permits from Minchah and onwards. Perhaps the coming question refers to this episode. On Erev Tish'ah b'Av, we do not learn from midday, so there is no Bitul Beis Medrash. They could have started earlier! However, Bitul Beis Medrash could apply to matters that we may learn then, e.g. Hilchos Tish'ah b'Av.

מעתה במקום שיש בית המדרש אל יקראו. במקום שאין בית המדרש יקראו.

(d)

Question: If so (the Isur to read in them is due to Bitul Beis Medrash), where there is Bitul Beis Medrash we may not read in them, but where there is no Bitul Beis Medrash, we may read in them!

לית לך אלא כהדא דתני ר' נחמיה.

Answer: You must say like R. Nechemyah taught;

דתני ר' נחמיה מפני מה אין קורין בכתבי הקודש (אלא מן המנחה ולמעלה - קרבן העדה מוחקו) מפני שטרי הדיוטות שאם אומר את לו שהוא מותר אף הוא אומר מה בכך (שנתעסק בשטרותיו) [צ''ל אם אתעסק בשטרותי - תוספות קטז:ב ד''ה וכ''ש]

(Beraisa - R. Nechemyah): Why do we not read Kisvei ha'Kodesh [on Shabbos]? It is due to secular documents. If you tell [someone] that [Kisvei ha'Kodesh] are permitted, even he will say "what is wrong if I engage with my documents?!''

מתוך שאת אומר לו שהוא אסור. אף הוא אומר כתבי הקודש אסור שטרי הדיוטות לא כל שכן.

[Rather,] since you tell him that [Kisvei ha'Kodesh] are forbidden, even he will say "Kisvei ha'Kodesh are forbidden - all the more so secular documents!''

הדא אמרה שהמשנה קודמת למקרא.

(f)

Inference: [Our Mishnah] teaches that Mishnah has priority over Mikra. (One may not read Mikra, but one may learn Mishnah!)

ודא מסייעא לההוא דתני ר''ש בן יוחי. דתני ר''ש בן יוחי העוסק במקרא מידה שאינה מידה. העוסק במשנה מידה שנוטלין ממנה שכר. [דף צז עמוד א (עוז והדר)] העוסק בתלמוד אין לך מידה גדולה מזו.

(g)

This supports R. Shimon ben Yochai. R. Shimon ben Yochai taught that engaging in Mikra is a [good] Midah, but it is not [the greatest] Midah. Mishnah is a great Midah, and one receives reward for it. One who engages in Talmud, there is no greater Midah.

לעולם הוי רץ אחר המשנה יותר מן התלמוד.

Question: [He also taught that] always one should run to Mishnah, more than to Talmud!

א''ר יוסי בי ר' בון הדא דאת אמר עד שלא שיקע (בי ר' רוב) [צ''ל רבו - מיכל המים] משניות. אבל מששיקע (בי ר' רוב) [צ''ל רבו - מיכל המים] משניות לעולם הוי רץ אחר התלמוד יותר מן המשנה.

Answer (R. Yosi bei R. Bun): This is before he is expert in most of the Mishnayos, but once he is expert in most of the Mishnayos, he should always run to Talmud more than to Mishnah.

WRITING TORAH (Yerushalmi Perek 16 Halachah 1 Daf 79b)

ברכות [צ''ל וקמיעין - קרבן העדה] שכתוב בהן עניינות הרבה מן התורה אין מצילין אותן מפני הדליקה. מיכן אמרו כותבי ברכות שורפי תורה.

(a)

Brachos and amulets in which are written many matters from the Torah, we may not save them from a fire. From here they said that people who write Brachos, they burn Torah.

מעשה בא' שהיה כותב ברכות והלך ר' ישמעאל לבודקו כיון שהרגיש בקול פעמותיו של ר' ישמעאל נטל תכריך של ברכות וזרקן לתוך ספל של מים כלשון הזה אמר לו גדול עונש האחרון מן הראשון.

(b)

A case occurred with a man who used to write Brachos. R. Yishmael came to check him. When he sensed [R. Yishmael's] footsteps, he took a wrapped bundle of Brachos and threw them into a basin of water. [R. Yishmael] said these words to him - "the punishment for the latter [Aveirah of throwing them in water] is greater than the first [Aveirah of writing them]!''

א''ר יהושע בן לוי הדא אגדתא הכותבה אין לו חלק. החורשה מתחרך השומעה אינו מקבל שכר.

(c)

(R. Yehoshua ben Levi): One who writes Agada has no share [in the world to come]. One who [reads it and] ponders it will be burned. One who hears [someone read] it, he receives no reward.

א''ר יהושע בן לוי אנא מן יומוי לא איסתכלית בספרא דאגדתא אלא חד זמן איסתכלית אשכחית כתוב בה מאה ושבעים וחמש פרשיות שכתוב בתורה (דבר אמירה ציווי) [צ''ל דיבור אמירה - שערי תורת ארץ ישראל] כנגד שנותיו של אבינו אברהם דכתיב [תהילים סח יט] לקחת מתנות באדם. וכתיב [יהושע יד טו] האדם הגדול בענקים.

R. Yehoshua ben Levi: In my entire life, I looked at a Sefer of Agada only once, and I found written there "there are 175 Parshiyos in the Torah in which is written "Dibur'' or "Amirah'' [to Moshe, i.e. excluding Sefer Devarim. There are 76 in Shmos, 35 in Vayikra, and 64 in Bamidbar - SHA'AREI TORAS ERETZ YISRAEL, based on Osiyos d'R. Akiva (Tzadi).] These correspond to the years of Avraham Avinu. It says [about Moshe receiving the Torah] "Lakachta Matanos ba'Adam'', [and Avraham is] "ha'Adam ha'Gadol ba'Anakim.''

מאה וארבעים ושבעה מזמורות שכתוב בתהילים כנגד שנותיו של אבינו יעקב.

There are 147 Mizmorim written in Tehilim, corresponding to the years of Yakov Avinu. (Our Tehilim has 150 Perakim. Brachos 10a holds that "our'' Perek 2 ("Lamah Ragshu...'') is not a new Perek, rather, the continuation of Perek 1. Maseches Sofrim (20:7) says so about "our'' Perek 115 ("Lo Lanu...'', in Hallel). Tosfos (Pesachim 117a) says that a Perek cannot have only two Pesukim. He must hold that our Perek 117 is part of the previous or next Perek. Piskei Tosfos (Ta'anis Perek 3, 55) and Eliyahu Rabah (575:11) say so about our Perek 135. See Yerushalmi to Match Ta'anis 25 - 3. WHAT IS THE GREAT HALLEL?)

מלמד שכל הקלוסין שישראל מקלסין להקדוש ב''ה כנגד שנותיו של יעקב שנאמר [תהילים כב ד] ואתה קדוש יושב תהלות ישראל.

This teaches that all the praises that Yisrael praise Hash-m correspond to the years of Yakov Avinu - "v'Atah Kadosh Yoshev Tehilos Yisrael.''

מאה ועשרים וג' פעמים שישראל עונין הללויה. כנגד שנותיו של אהרן. [שם קנ א] הללויה הללו אל בקדשו. לאהרן קדושו [שם קו טז] לאהרן קדוש ה'.

Yisrael answer Hallelukah 123 times [in Hallel], corresponding to the years of Aharon. (This is practice of Teimanim even nowadays. Sidur Tichlal shows where to answer them, often twice in one verse.) "Hallelukah Hallelu Kel b'Kadsho'' - [corresponding to] Aharon, [Hash-m's] Kodesh - "l'Aharon Kedosh Hash-m.''

אפי' כן אנא מתבעי בליליא.

R. Yehoshua ben Levi: Even though [I looked only once, to this day] I am afraid [of punishment for this Aveirah] at night.

ר' חייא בר בא חמא חד ספר דאגדה אמר אי מה כתיב טבאות תקטע ידה דכתבתה.

(d)

R. Chiya bar Ba saw one Sefer of Agada. He said "if what is written in it is correct, the hand of the one who wrote it should be cut off!'' (However, if it is wrong, he did not transgress this Aveirah.)

אמר ליה חד אבוי דההוא גברא כתבה. א''ל כן אמרת תקטע ידה דכתבתה. והוית ליה כן [קהלת י ה] כשגגה שיוצא מלפני השליט.

A man said to him "if that man's (i.e. your) father wrote it [would you say so?!'' R. Chiya] said "so I said, the hand of the one who wrote it should be cut off!'', and so happened, "ki'Shegagah she'Yotzei mi'Lifnei ha'Shalit.''

הגיליונים וסיפרי מינין. אית תני קורא אזכרותיהן ושורפן. אית תניי תני שורפין הן ואזכרותיהן.

(e)

Margins and Seforim of heretics [are the same. We may not save them from a fire.] Some teach that we tear out the Azkaros (names of Hash-m, from the Sifrei Minim) and burn [the rest], and some teach that we burn them with their Azkaros.

א''ר טרפון אקפח את בניי שאם יבואו לביתי שאני שורפן הן ואזכרותיהן.

R. Tarfon: I will cut off my son [if what I say is not true]! If they will come to my house, I will burn them with their Azkaros!

שאם יהיה הרודף רודף אחריי שאני נמלט לתוך בתיהן של ע''ז ואיני נמלט לתוך בתיהן של מינין. שעכו''ם אינן מכירין אותו וכופרין בו. אבל המינין מכירין אותו וכופרין בו.

If someone pursues me [to kill me], I would flee to the house of idolaters, and I would not flee to the house of heretics, for idolaters do not recognize [Hash-m] and they deny Him. Heretics recognize Him and they deny Him!

ועליהן אמר דוד [דף פ עמוד א] [תהילים קלט כא] הלא משנאיך ה' אשנא וגו'.

David said about them "ha'Lo Mesan'echa Hash-m Esna...''

זה מדרש דרשו ומה אם להטיל שלום בין איש לאשתו אמר הכתוב השם שנכתב בקדושה ימחה על המים. סיפרי מינין שמטילין איבה ותחרות ומחלוקת בין ישראל לאביהן שבשמים אינו דין שישרפו הן ואזכרותיהן:

[Chachamim] expounded - if to make Shalom between a man and his wife, the Torah said that Hash-m's name written in Kedushah will be erased onto the water - Seforim of heretics, who make enmity, rivalry and quarrels between Yisrael and their Father in Heaven, all the more so should we not burn them with their Azkaros?!

TO WHERE WE MAY SAVE KISVEI HA'KODESH (Yerushalmi Halachah 2 Daf 80a)

(Mishnah): We may save the case of a Sefer or Tefilin with the Sefer or Tefilin, even if there are coins inside;

Answer #1: We may take them to a Mavuy (alleyway) that is not Mefulash (open. This will be defined);

(Gemara): Our Mishnah discusses when [the Sefer] is not in the case. If it is in the case, it is like the Sefer (there is no need to teach that one may save it with the Sefer)!
