WHEN ONE IS LIABLE FOR TRAPPING (Yerushalmi Perek 13 Halachah 5 Daf 73a)

(a)

(Mishnah - R. Yehudah): If one trapped a bird in a cabinet or a deer in a house, he is liable;

וחכ''א צפור למגדל וצבי לגינה ולחצר ולביברין

(b)

Chachamim say, he is liable for a bird in a cabinet or a deer in a garden, Chatzer or Biver (an enclosure of game);

רשב''ג אומר לא כל הביברין שוין

(c)

R. Shimon ben Gamliel says, not all Bivrin are the same.

זה הכלל כל המחוסר צידה פטור ושאינו מחוסר צידה חייב:

(d)

The general rule is, if it still needs to be trapped (this will be explained) he is exempt; if not, he is liable.

גמ' א''ר חיננא מתני' דלא כר' יהודה. דתנינן הצד צפור למגדל וצבי לבית חייב. הא לגינה ולביברין פטור. (מחלפה שיטתיה דרבי יהודה דתנינן) [צ''ל ותנינן - קרבן העדה] תמן אין צדין דגים מן הביברין ואין נותנין לפניהם מזונות. הא לגינה ולביברין פטור.

(Gemara - R. Chinena): The Mishnah (Beitzah 3:1), is unlike R. Yehudah. [Here, R. Yehudah] teaches that if one trapped a bird to (i.e. in) a cabinet or a deer to (in) a house, he is liable. This implies that if he trapped it to a garden or Biver, he is exempt [for it is not considered trapped there], and there the Mishnah says that one may not trap fish from a Biver [on Yom Tov], and one may not put food in front of them. This implies that that if he trapped them to a Biver, he is exempt [for they are not considered trapped there]!

מחלפה שיטתין דרבנן. דתנינן וחכמים אומרים צפור למגדל וצבי לגינה ולחצר ולביברין. ותנינן תמן אבל צדין חיה ועוף מן הביברין ונותנין לפניהן מזונות. הא (לגינה ולחצר) [צ''ל מגינה ומחצר - קרבן העדה] לא.

Question: Rabanan contradict themselves! In our Mishnah, Chachamim say [that one is liable for trapping] a bird to (i.e. in) a cabinet or a deer to (in) a garden, Chatzer or Biver. The Mishnah there says "but one may trap a Chayah or bird from a Biver, and put food in front of them.'' This implies that one may not trap them from a garden or Chatzer!

Answer #1: Here [our Mishnah] discusses a roofed Chatzer [they are trapped there], and [the Mishnah in Beitzah] discusses a Chatzer without a roof.

והא תנינן גינה. אית לך מימר גינה מקורה.

Question: Our Mishnah teaches [also] a garden. Can you say that a garden has a roof?!

אלא כאן בגדולה כאן בקטנה.

Answer #2: Rather, [the Mishnah in Beitzah] discusses a big (garden or Chatzer), and [our Mishnah] discusses a small one.

ר' עולא אמר בעון קומי רבי אחא מה ניתני כל המחוסר צידה חייב ושאינו מחוסר צידה פטור.

R. Ula: They asked R. Acha, should we teach [in the Mishnah in Beitzah like our Mishnah,] "anything Mechusar Tzeidah [it was not trapped yet] one is liable, and anything not Mechusar Tzeidah one is exempt''?

אמר לון ולא (במנפל לתוכה) [צ''ל ביו''ט - הגר''ח קניבסקי שליט''א] אנן קיימין. אלא כל המחוסר צידה אסור ושאינו מחוסר צידה מותר.

(R. Acha): [No -] does it not discuss Yom Tov?! Rather, [teach there] "anything Mechusar Tzeidah is forbidden, and anything not Mechusar Tzeidah is permitted.''

Note: HA'GAON RAV C. KANIEVSKY, SHLITA explains that there is no Chiyuv Chatas for Yom Tov. Some explain that there is no Torah Isur of Ochel Nefesh on Yom Tov, just Chachamim decreed about matters such as trapping which are normally done at once for many days. And if it is already trapped, it is totally permitted to take from there to eat.

א''ר שמואל אחוי דרבי ברכיה כל שהוא מחוסר נשבים מחוסר צידה. ושאינו מחוסר נשבים אינו מחוסר צידה.

(R. Shmuel, the brother of R. Berachiyah): Anything Mechusar traps [to catch it] is Mechusar Tzeidah. Anything not Mechusar traps is not Mechusar Tzeidah.

We may slaughter from Nigrin (grazing areas next to rivers). We may not slaughter from caves [in which traps were set] and traps.

(R. Yosi bei R. Bun citing R. Ami): This refers to big traps.

שמואל [צ''ל אמר - פני משה] צד הוא בפיתם.

(n)

(Shmuel): One may trap [fish] from a big barrel.

רב אמר סכרא דנהרא שרי.

(o)

(Rav): [One may trap fish] from a dammed river.

EXEMPTIONS FOR TRAPPING (Yerushalmi Perek 13 Halachah 6 Daf 73b)

מתני' צבי שנכנס לבית נעל אחד בפניו חייב אם נעלו שנים פטורין

(a)

(Mishnah): If a deer entered a house and one locked the door, he is liable. If two people locked the door, they are exempt;

לא יכול אחד לנעול ונעלו שנים חייבין ור''ש פוטר:

If one could not lock it and two people locked it, they are liable. R. Shimon exempts.

גמ' בעשותה היחיד שעשה חייב. שנים ג' שעשו פטורין.

(b)

(Gemara): "B'Asosah'' - an individual who did [an Aveirah] is liable. Two or three who did are exempt.

רב חינא אמר היה אחד בריא ואחד תש נעל החולה כל צורכו ולא נעל הבריא כל צורכו החולה חייב והבריא פטור.

(c)

(R. China): If one of them was healthy, and one was weak, if the Choleh (weak one) locked with all his strength, and the Bari did not lock with all his strength, the Choleh is liable and the Bari is exempt.

ר' יוסי בי ר' בון בשם רב חינא היה צבי רץ כדרכו ונתכוון לנעול בעדו ונעל בעדו ובעד הצבי מותר.

(d)

(R. Yosi bei R. Bun citing R. China): If a deer was running normally and one intended to lock [the door] in order to guard his house,] and he locked to guard [his house] and the deer, it is permitted.

ר' יוסי בי ר' בון בשם רב חונה ראה תינוק מבעבע בנהר ונתכוון להעלותו ולהעלות נחיל של דגים עמו מותר.

(e)

(R. Yosi bei R. Bun citing R. Chunah): If one saw a child floundering in the river (he is in danger of drowning), and he [cast a net on Shabbos] and intended to raise him and fish with him, it is permitted.

(R. Yosi bei R. Bun citing R. Chunah): If one was excavating a collapsed house (on Shabbos), and he intended to raise (save a person buried under the rubble) and raise bound gold coins with him, it is permitted.
