JOINING HALF-SHI'URIM (Yerushalmi Halachah 6 Daf 71a)

מתני' הכותב שתי אותיות בשני העלמות א' בשחרית וא' בין הערבים רבן גמליאל מחייב וחכמים פוטרין:

(a)

(Mishnah): If one wrote one letter in the morning and one in the evening, in two Ha'alamos, R. Gamliel obligates, and Chachamim exempt.

גמ' וקשיא על דרבן גמליאל אילו קצר כגרוגרת בשחרית. וכגרוגרת בין הערבים (בהעלם אחד שמא אינו חייב. כשם שאין העלמות) [צ''ל בשתי העלמות שמא אינו חייב. כשם שהעלמות - רידב''ז] חולקות כך לא יצרפו.

(b)

(Gemara) Question: R. Gamliel contradicts himself! If one reaped k'Grogeres in the morning and k'Grogeres in the afternoon in two He'elamos, is he not liable [twice]?! Just like He'elamos separate, they should not join!

ר' מנא אמר לה סתם רבי אבון בשם רבי יוחנן טעמא דרבן גמליאל תמן אין ידיעה לחצי מלאכה.

(c)

Answer (R. Mana, and R. Avun citing R. Yochanan): R. Gamliel holds that Yedi'ah does not apply to half a Melachah (so it cannot divide the He'elamos).

ודכוותה אין זדון לחצי זית.

(d)

Question: [May we infer that] similarly, Mezid does not apply to a half-k'Zayis?

אכל חצי זית בזדון וחצי זית בשגג' מהו שיצטרפו:

Question: [If so,] if one ate a half-k'Zayis b'Mezid, and a half-k'Zayis b'Shogeg, do they join?

LIABILITY FOR WEAVING (Yerushalmi Perek 13 Halachah 1 Daf 71a)

מתני' ר' אליעזר אומר האורג ג' חוטין בתחילה ואחד על האריג חייב

(a)

(Mishnah - R. Eliezer): If one wove three threads at the beginning, or added another thread onto something woven, he is liable;

וחכ''א בין בתחילה בין בסוף שיעורו שני חוטין:

Chachamim say, whether he wove at the beginning or at the end, the Shi'ur is two threads.

גמ' א''ר עולא טעמא דר' אליעזר על ידי שלישי מלאכתו מתקיימת.

(c)

(Gemara - Ula): R. Eliezer's reason is because through three threads, his Melachah lasts (it is an amount that people sometimes do).

מה ר' ליעזר כר' יודה. דתנינן תמן ר' יהודה אומר עד שישלש. והשק והקופה מצטרפין בכלאים.

(d)

Question: Does R. Eliezer hold like R. Yehudah? In a Mishnah there, R. Yehudah says that [garments are connected regarding Sha'atnez] only through three [stitches], and Sak and a basket join for Kil'ayim.

א''ר סימון טעמא דר''א תמן על ידי שלישי מלאכתו מתקיימת. ברם הכא פחות מיכן [דף עא עמוד ב] מיסתתר הוא.

(e)

Answer (R. Simon): There (i.e. weaving on Shabbos), R. Eliezer holds that through three, his Melachah lasts. However, here (Kil'ayim), less than [three], does it come apart?! (Even two stitches do not come apart. R. Yehudah holds that the Torah forbids only a total connection of three.)

אשכחת אמר על דר' אליעזר [דף פז עמוד ב (עוז והדר)] פעמים שלשה בתחילה. פעמים שנים ע''ג אחד ארוג מאתמול. פעמים (שנים ע''ג אחד) [צ''ל אחד ע''ג שנים - רשב''א קה:א] ארוגים מאתמול.

We find that according to R. Eliezer, sometimes one is liable for three at the beginning, sometimes for two through [adding to] one woven from yesterday (before Shabbos), and sometimes for one through [adding to] two woven from yesterday.

רבנן דקיסרין בעיין מהו אחד על האריג אחד ע''ג שנים אחד ע''ג ג'.

(g)

Question (Rabanan of Kisarin): What does it mean "one added to Arig'' - is it one added to two (for the added stitch makes it a lasting Melachah), or [even] for one added to three [even though it was already a lasting Melachah]?

רבנן דהכא אמרי אחד על גבי שנים.

(h)

Answer (Rabanan here (in Eretz Yisrael)): It is [only] one added to two. (We explained this like SEFER NIR.)

היתה טלית אחת גדולה בתחילה עד שיארוג בה שנים חוטין ובסוף אפי' כל שהוא.

(i)

[Rabanan hold that] if it was one big Talis, at the beginning [or in the middle, he is not liable] until he weaves two threads, and at the end [when he finishes the Talis] even any amount.

Note: I cannot explain why it says one big Talis. Perhaps the word "one'' should be deleted, or it should say "Afilu'' (even), or "Achas Gedolah v'Achas Ketanah'' (whether it is big or small).

האורג שני חוטין ע''ג (הגב) [צ''ל הגס - פני מאיר] ע''ג אימרא אפילו כל שהוא חייב. למה הדבר דומה לצילצול קטן שארג בו שני חוטים על רוחב ג' בתים חייב.

(j)

One who weaves two threads of the thick threads [to make the upper brim] or the lower edge of a garment, he is liable for any amount. This is like a small belt, that he wove in it two [widthwise] threads for a width of three Batim (they pass above and below three lengthwise threads, even though it is less than a full Sit); he is liable.

ובנפש מסכת כמאן דהוא בתחילה.

In Nefesh ha'Maseches (the end of the garment itself) it is like at the beginning. (Since it will be joined to the edge, the Shi'ur of Kolshehu for the end does not apply. We explained these like PNEI MEIR.)

וההן בדא אפילו בסוף כאריג הוא וההן לסוטה אפילו בסוף כאריג הוא.

(k)

A strip [of material from which one hangs needles - PNEI MOSHE], even at the end of weaving, [its Shi'ur] is like [during the] weaving (two threads). A chain worn around the neck, even at the end of weaving, is like [during the] weaving.

הכל מודין בכותב את השם עד שעה שישלים.

(l)

All agree about one who writes Hash-m's name that [he is not liable] until he completes it.

כתב אות אחת להשלים את השם ואות אחת להשלים את הספר חייב.

(m)

If one wrote one letter to complete Hash-m's name, or one letter to complete a Sefer, he is liable.

כתב אות אחת בחול ואות א' בשבת רבי אליעזר מחייב חטאת ור' יהושע פוטר.

(n)

If one wrote one letter on a weekday (Friday) and one letter on Shabbos, R. Eliezer obligates a Chatas, and R. Yehoshua exempts.

למה או משום קיום מלאכה או משום שאינו ראוי להצטרף עמו.

(o)

Question: Why [does R. Yehoshua exempt] - because [on Shabbos he did not do] Kiyum Melachah (an amount that people normally do), or because it is not proper to join? (One letter is not important enough to join to what is written on Shabbos.)

איתא חמי אילו ארג חוט אחד בחול וחוט אחד בשבת שמא אינו פטור. שמא אינו ראוי להצטרף עמו. אלא משום קיום מלאכה.

(p)

Answer: Let us see. If he wove one thread on a weekday and one thread on Shabbos, is he not exempt? Is it not proper to join with it?! (Even if much was woven before Shabbos, and it is proper to join, he is liable only for two threads on Shabbos!) Rather, [he is exempt] due to Kiyum Melachah. (We explained this like MASA D'YERUSHALAYIM.)

Assertion: What R. Yakov bar Acha cited from R. Yosah citing R. Lazar, that if one wrote one letter in Tiverya, and one in Tziporin, he is liable, is unlike R. Eliezer. (R. Eliezer obligates even when he wrote one letter on a weekday and one on Shabbos, and all the more so if he wrote both on Shabbos is different places! We explained this like SHA'AREI TORAS ERETZ YISRAEL.)

כתב אות אחת בשבת זו ואות אחת בשבת הבאה ר' אליעזר מחייב חטאת ור' יהושע פוטר.

(r)

If one wrote one letter on this Shabbos and one on the coming Shabbos, R. Eliezer obligates a Chatas and R. Yehoshua exempts.

Question: Let us see! If one wrote one letter on a weekday and one letter on Shabbos, R. Eliezer obligates a Chatas. If he wrote between (i.e. one on) this Shabbos and the coming Shabbos, all the more so! (Why was there a need to teach this?)

מפני חכמים שהן פטורין:

Answer: [It was taught] to teach about Chachamim (R. Yehoshua), that they exempt.

3)

LIABILITY FOR MAKING BATEI NIRIM AND FOR SEWING (Yerushalmi Perek 13 Halachah 2 Daf 72a)

מתני' העושה שתי בתי נירין בנירין ובקירוס ובנפה ובכברה ובסל חייב

(a)

(Mishnah): If one makes two Batei Nirim (rings to hold the warp threads holes in a frame that lifts and lowers warp threads) b'Nirim or b'Kirus (these will be explained), [or weaves a reed in and out when making a] sieve or basket, he is liable;

התופר שתי תפירות וקורע על מנת לתפור שתי תפירות:

(b)

If one sews two stitches or tears in order to sew two stitches [he is liable].

גמ' בנירין. ניריא. בקירוס. קירומה.

(c)

(Gemara): B'Nirim (means that he made the rings from) threads. B'Kirus is from soft shoots.

ר' בא רב ירמיה בשם רב הממתח צדדיו בשבת חייב משום תופר.

(d)

(R. Ba bar Yirmeyah citing Rav): One who stretches the sides [of a garment in which the stitching came loose, to tighten it,] he is liable for sewing.

נימר משום תופר ומשום קושר:

(e)

[If we would say that one is liable for sewing only if he tied, Rav] should say that [he is liable] for sewing and for tying! (We explained this Gemara like PNEI MOSHE.)

A MITZVAH DONE THROUGH CHILUL SHABBOS (Yerushalmi Perek 13 Halachah 3 Daf 72a)

מתני' הקורע בחמתו ועל מתו כל המקלקלין פטורין

(a)

(Mishnah): If one tore out of anger or due to his Mes - all who ruin are exempt;

והמקלקל על מנת לתקן שיעורו כמתקן:

(b)

If one ruined something in order to fix it, the Shi'ur to be liable is like one who fixes.

גמ' בעון קומי רבי בא היך מה דאת אמר תמן השוחט חטאתו בשבת כיפר ומביא אחרת ואמר אוף הכא (לא - נועם ירושלמי מוחקו) יצא ידי קורעו.

(c)

(Gemara) Question (to R. Ba): Do you not say [like the Tosefta] "if one slaughtered his Chatas on Shabbos [and the blood was thrown], he atoned, and he brings another [for Chilul Shabbos]''? You should say also here that he was Yotzei his Mitzvah to tear [and is liable for Chilul Shabbos! Why did they say here that he was not Yotzei, in order that he will not be liable for Shabbos, but did not say so about Shechitas Chatas?]

אלא כרבי שמעון דר' שמעון אמר עד שיהא לו צורך בגופו של דבר.

Rather, [our Mishnah] is like R. Shimon, who says [that one is not liable] unless he needs the matter (Melachah she'Tzerichah l'Gufah. Even though he was Yotzei Keri'ah, he is exempt for Shabbos.)

[דף פח עמוד ב (עוז והדר)] אמר לון תמן הוא גרם לעצמו. ברם הכא את גורמת לו.

(d)

Answer (R. Ba): (It is even like R. Yehudah.) There, he caused himself [to do Melachah, i.e. Shechitah. Therefore, we are not concerned if Zerikah is done and he is liable for Chilul Shabbos.] Here, you (Chachamim, through enacting Keri'ah) caused him [to do Melachah. Therefore, we enact that he was not Yotzei, lest we cause him to be liable for Chilul Shabbos.]

אמר רבי יוסי ואפי' תמן את גורמת לו שאילו לא שאמרת לו (שיבא) [צ''ל שכיםר - נועם ירושלמי] היאך היה מתכפר לו. הוי צורך מימר דרבי שמעון היא.

(e)

Rebuttal (R. Yosi): Even there (Shechitah) you caused him. Had you not said that he was Yotzei, [Kohanim would not throw the blood, and] he would not atone! Rather, we must say that [our Mishnah] is like R. Shimon.

חברייא בעון קומי רבי יוסה לא כן אמר רבי יוחנן בשם ר' שמעון בן יוצדק [דף עב עמוד ב] מצה גזולה אינו יוצא בה ידי חובתו בפסח.

(f)

Question (Talmidim, to R. Yosi): Didn't R. Yochanan say in the name of R. Shimon ben Yehotzadak that one is not Yotzei with stolen Matzah on Pesach? (Why do you say that he was Yotzei Keri'ah?)

אמר לון תמן גופה עבירה. ברם הכא הוא עבר עבירה. כך אני אומר הוציא מצה מרשות היחיד לרשות הרבים אינו יוצא בה ידי חובתו בפסח.

(g)

Answer (R. Yosi): There, [the Matzah] itself is an Aveirah. However, here he did an Aveirah (he tore). Will I say that if one was Motzi Matzah from Reshus ha'Yachid to Reshus ha'Rabim, one is not Yotzei with it on Pesach?!

תני מצה גזולה אסור לברך עליה.

(h)

(Beraisa): One may not bless on stolen Matzah.

אמר רב הושעיה על שם [תהילים י ג] ובוצע ברך נאץ ה'.

(i)

Source (R. Hoshayah): This is due to "u'Votze'a Berech Ni'etz Hash-m.''

(אמר ר' יונה הדא דאת אמר) [צ''ל הדא דתימר - רא''ש פסחים ב:יח] בתחילה אבל בסוף לא דמים הוא חייב לו.

(j)

Limitation: This refers to l'Chatchilah, but not at the end. He owes [only] money to [the owner, so he was Yotzei b'Di'eved].

Note: Even if he stole baked Matzah, he acquires it through Shinuy (chewing it), so it is already his before he swallows it.

רבי יונה אמר אין עבירה מצוה. רבי יוסה אמר אין מצוה עבירה.

(k)

R. Yonah says that an Aveirah is not a Mitzvah. R. Yosah says that a Mitzvah is not an Aveirah.

א''ר אילא [ויקרא כז לד] אלה המצות אם עשיתן כמצוותן הן מצות ואם לאו אינן מצות:

(l)

(R. Ila): "Elu ha'Mitzvos'' - if you do them like the Mitzvos should be, they are Mitzvos. If not, they are not Mitzvos. (Perhaps R. Yonah, R. Yosah and R. Ila argue with R. Hoshayah, and say that even b'Di'eved he was not Yotzei. We explained this like ROSH, Pesachim 2:18.)

SHI'URIM FOR MELACHOS DONE TO GARMENTS (Yerushalmi Perek 13 Halachah 4 Daf 72b)

מתני' שיעור המלבן והמנפס הצובע והטווה שיעורו כמלוא רוחב הסיט כפול האורג שני חוטין שיעורו כמלוא הסיט:

(a)

(Mishnah): The Shi'ur for laundering, Menapetz (banging wool, or separating clumps into fibers, or brushing and combing it), dying and spinning is double Malei ha'Sit. One who weaves two threads, the Shi'ur is Malei ha'Sit.

גמ' תמן תנינן המוציא עצים כדי לבשל ביצה קלה והכא את אמר הכין. תמן במוציא לצבוע. ברם הכא בצובע:

(b)

(Gemara) Question: A Mishnah there (above, 9:5) teaches that one who is Motzi wood, the Shi'ur is cook a light egg... [The Shi'ur for nutshells, pomegranate peels, Istis and Pu'ah is enough to dye a small garment in the middle of the headdress], and here you say so (the Shi'ur for dying is twice Malei ha'Sit)?!

Answer: There it discusses dying. Here it discusses one who is Motzi in order to dye.
