ARE ORNAMENTS FORBIDDEN IN THE CHATZER? (Yerushalmi Halachah 1 Daf 34a)

ולא בעיר של זהב.

(a)

(Mishnah): She may not go out with Ir Shel Zahav.

רב יהודה אמר כגון ירושלים דדהב.

(b)

(Rav Yehudah): This is like Yerushalayim of gold.

רבנן דקיסרין אמרין פרוש טוק טקלין.

Rabanan of Kisarin: It is Pros Tok Taklin (the form of Yerushalayim is on it, but it is not in the shape of the city).

מעשה בר' עקיבה שעשה לאשתו עיר של זהב. חמתיה איתתיה דרבן גמליאל וקניית בה. אתת ואמרת קומוי בעלה.

(d)

A case occurred in which R. Akiva made for his wife Ir Shel Zahav. R. Gamliel's wife saw it, and envied her. She told her husband [who was the Nasi, so he would make one for her].

אמר לה הכין הווית עבדת לי כמה דהוית עבדה ליה דהוות מזבנה מקליעתא דרישא ויהבה ליה והוא לעי באוריתא.

He told her "would you do for me like she did for him? She sold her braided hair (PNEI MOSHE) and gave [the money] to him, so he could learn Torah!''

תמן תנינן שנים משם ר' אליעזר יוצאה אשה בעיר של זהב.

A Mishnah there [in Eduyos records three laws said in front of R. Akiva.] Two of them were in the name of R. Eliezer. [One of them is that] a woman may go out with Ir Shel Zahav. (Some texts say that the second is "people who race [or incite] birds are Pasul for testimony mid'Oraisa.'')

תני רבי מאיר מחייב.

(Beraisa): [If she went out with Ir Shel Zahav,] R. Meir obligates her.

בין רבי מאיר לרבנן ניחא רבי מאיר מחייב. וחכמים פוטרין.

Question: Granted, [the argument] between R. Meir and Rabanan is reasonable. R. Meir obligates, and Chachamim exempt;

בין ר' אליעזר לרבנן ניחא ר' אליעזר מתיר וחכמים אוסרין.

[The argument] between R. Eliezer and Rabanan is reasonable. R. Eliezer permits, and Chachamim forbid.

בין ר''מ לרבי אליעזר קשיא [דף לד עמוד ב] ר' מאיר מחייב רבי אליעזר מתיר.

[However, the argument] between R. Meir and R. Eliezer is difficult (it is too big). R. Meir obligates, and R. Eliezer permits?!

רבי איניינו בר סיסיי אמר משום רבי ליעזר כל מקום שאמרו לא תצא ואם יצתה חייבת חטאת אסורה לצאת בו בחצר.

Answer (R. Inyeino bar Sisai citing R. Liezer): [R. Meir obligates only in Reshus ha'Rabim, and R. Eliezer forbids there. He permits only in a Chatzer, for he holds that] wherever Chachamim said "she may not go out, and if she went out, she is Chayav Chatas'', it is forbidden to go out with it to a Chatzer. (We explained this like NO'AM YERUSHALMI);

כל מקום שאמרו לא תצא ואם יצתה אינה חייבת חטאת מותרת לצאת בו בחצר.

Wherever they said "she may not go out, and if she went out, she is not Chayav Chatas'', she may go out with it to a Chatzer.

רבי בא בר כהן בשם רב ששת מתניתא אמרה כן. ובכבול ובפיאה נכרית בחצר.

Support (R. Ba bar Kohen citing Rav Sheshes - Mishnah): She may go out with Kevul or a wig to a Chatzer.

רבי לייא בשם ר''ש בר חייא אפילו במקום שאמרו לא תצא ואם יצאת אינה חייבת חטאת אסורה לצאת בו לחצר.

(R. Liya citing R. Shimon bar Chiya): Even where they said "she may not go out, and if she went out, she is not Chayav Chatas'', she may not go out with it to a Chatzer.

והאיש על ידי שאינו שחוץ מותר.

(k)

Implied question: A man, since he is not haughty (he will not remove it to show to his friend), is he permitted?

נשמעינה מן הדא רבן גמליאל ברבי ירד לטייל בתוך חצירו בשבת ומפתח של זהב בידו וגערו בו חביריו משום תכשיט.

Answer: We learn from the following. R. Gamliel b'Ribi descended to stroll in his Chatzer on Shabbos, with a gold key in his hand. His colleagues rebuked him due to an ornament. (MEICHAL HA'MAYIM - a key is not an ornament, but the decree against ornaments, lest one carry four Amos in Reshus ha'Rabim, applies to it.)

[דף מב עמוד ב (עוז והדר)] הדא אמרה העשוי לשם תכשיט אסור.

Inference #1: What is made for an ornament is forbidden.

הדא אמרה עשוי לכך ולכך הדא אמרה אחד האיש ואחד האשה.

(m)

Limitation: This teaches [only] about what is made for this (men) and this (women. For such ornaments,) a man and a woman are the same. (We cannot learn to ornaments special for men. Perhaps there was no decree about them! We explained this like the ROSH (6:10) and HA'GAON RAV C. KANIEVSKY, SHLITA.)
