1)

PROFANING SHABBOS TO GIVE TESTIMONY (Yerushalmi Halachah 5 Daf 8b)

משנה על שני חדשים מחללין את השבת על ניסן ועל תשרי שבהן השלוחין יוצאין לסוריא ובהן היו מתקנין את המועדות

(a)

(Mishnah): The Shabbos may be profaned for two months, Nisan and Tishrei. This is because on those months messengers travel to Suria and the festivals are established.

וכשבית המקדש קיים מחללין אף על כולן מפני תקנת' הקרבן.

(b)

And when the Temple stood, they would profane Shabbos for all of the months so that the Rosh Chodesh sacrifice would be brought at the correct time.

בין שנראה בעליל ובין שלא נראה בעליל מחללין עליו את השבת

(c)

Whether or not the moon was seen Be'alil, they may profane the Shabbos for it.

רבי יוסי אומר אם נראה בעליל אין מחללין עליו את השבת.

(d)

R. Yosi: If it was seen Be'alil, they may not profane the Shabbos for it.

מעשה שעברו יותר מארבעים זוג ועיכבן רבי עקיבה בלוד

(e)

It once occurred that more than 40 pairs of witnesses passed (on Shabbos) and in Lod, R. Akiva prevented them from continuing.

שלח לו רבן גמליאל אם מעכב אתה את הרבים נמצאת מכשלן לעתיד לבוא

Rabban Gamliel sent a message to him - if you prevent the multitudes from going, you will cause them to stumble in the future (as nobody will come even when they are the only witnesses).

גמרא מהו בעליל מפורסם כמה דאת אמר (תהילים יב) כסף צרוף בעליל לארץ מזקק שבעתים

(f)

(Gemara): What is the meaning of Be'alil? Publicly. We see this from the Pasuk that states (Tehilim 12, 7), "...like purified silver, clear (Be'alil) to the world, refined seven times''.

מעשה שעברו יותר מארבעים זוג ועיכבן ר''ע בלוד [דף יא עמוד א (עוז והדר)] מפני שהן מ' זוג אבל אם היה זוג אחד לא היה מעכבו

The Mishnah told of R. Akiva who prevented more than 40 pairs from continuing. This is because there were more than 40 pairs, but if there was only one pair, he would not have prevented them.

שלח לו ר''ג אם מעכב אתה את הרבים נמצאת מכשלן לעתיד לבוא. לא נמצאת מעכבת את הרבים מלעשות דבר מצוה וכל המעכב את הרבים מלעשות דבר מצוה צריך נידוי.

"Rabban Gamliel sent a message to him - if you prevent the multitudes from going, you will cause them to stumble in the future'' - You will prevent the multitudes from performing a Mitzvah, and whoever does so deserves to be excommunicated.

אמר ר' יהודה הנחתום ח''ו לא נתנדה ר' עקיבה אלא ראש גדר היה ושלח ר' גמליאל והעבירו מראשיתו

R. Yehuda the baker: Heaven forbid! R. Akiva was not excommunicated - it was the governor of Gader who prevented them and Rabban Gamliel removed him from his position.

2)

RELATIVES WHO SAW THE NEW MOON (Yerushalmi Halachah 6 Daf 8b)

משנה אב ובנו שראו את החדש ילכו לא שמצטרפין זה עם זה אלא שמא יפסל אחד מהן יצטרף השני עם אחר

(a)

(Mishnah): If a father and son saw the New Moon, they should both go - not because they can testify together but because if one of them is found to be invalid, the other one can join together with another witness.

ר''ש אומר אב ובנו וכל הקרובים כשירין לעדות החדש

(b)

R. Shimon: A father and son or any other two relatives may testify together about the new moon.

א''ר יוסי מעשה בטוביה הרופא שראה את החדש בירושלם הוא ובנו ועבדו משוחרר וקיבלו הכהנים אותו ואת בנו ופסלו את עבדו וכשבאו לב''ד קבלו אותו ואת עבדו ופסלו את בנו

(c)

R. Yosi: There was once a case of Tuvia the doctor who saw the new moon in Yerushalayim together with his son and his freed slave. The Kohanim accepted him and his son and disqualified his slave. When they came to Beis Din, they accepted him with his slave and disqualified his son.

גמרא טעם דר''ש כתחילתה (שמות יב) ויאמר ה' אל משה ואל אהרן החדש הזה לכם ראש חדשים וגו'.

(d)

(Gemara): R. Shimon's reasoning (for accepting relatives) is because of the first time that testimony was given for the new moon, in Egypt, as the Pasuk states (Shemos 12, 1-2), "Hash-m said to Moshe and Aharon....This month is for you the first of the months etc.'' Moshe and Aharon (who were brothers) were the two witnesses to the new moon.

קיבלו הכהנים אותו ואת בנו ופסלו את עבדו משם פסול

(e)

The Kohanim accepted him and his son and disqualified his slave because of his lack of lineage.

וכשבאו לב''ד קיבלו אותו ואת עבדו ופסלו את בנו משם קרוב

(f)

When they came to Beis Din, they accepted him and his slave and disqualified his son because he was a relative.
