KORBANOS OF AN ANNULLED NEZIRUS (Yerushalmi Perek 4 Halachah 4 Daf 17b)

(a)

(Mishnah): If a woman accepted Nezirus and designated an animal for her Korban, and her husband annulled her Nezirus:

If it was his animal, it may graze with the flock (it has no Kedushah);

If it was her animal, if it was a Chatas, it must die. If it was an Olah, it is offered for an Olah. If it was a Shelamim, it is offered for a Shelamim, but it may be eaten only for one day (like Shalmei Nazir), and bread (Lachmei Nazir) is not brought with it.

(b)

If she had Ma'os Stumim (coins set aside for the Korbanos, without specifying how much for each Korban), they go to Nedavah (to buy Olos Tzibur to offer when the Mizbe'ach is idle);

(c)

If she specified money for each Korban, the Demei (money for the) Chatas is thrown into the Dead Sea. We may not benefit from it. If one benefited, he did not transgress Me'ilah;

(Gemara) Question: [This implies that if her husband did not annul her Nezirus, the animal] becomes Kadosh [even if it is her husband's. One cannot be Mekadesh what is not his!]

Answer: The case is, someone else gave to her a gift and told her 'on condition that your husband has no rights in it.'

Answer (R. Masniyah): She has authority to use his property [for what is needed]. If he came and protested (annulled her, it is not needed, so) it is not Kadosh. If not, it is Kadosh.

Question: There you say that [if one separated an animal and permitted his Nezirus,] it may graze with the flock, and here you say so (if it was her animal, if it was a Chatas, it must die...)?!

Answer (R. Yosi ben Chaninah): It is a Gezeiras ha'Kasuv - "v'Hafar Es Nidrah [Asher Aleha". We expound as if it said] v'Hafar Es Mah she'Aleha. The one who he annuls her vow [of Nezirus], he annuls [the Chiyuv Korbanos] upon her.
