1)

BURIAL CUSTOMS ON SPECIAL DAYS (Yerushalmi Halachah 9 Daf 19a)

משנה ובראשי חדשים בחנוכה ובפורים מענות ומטפחות בזה ובזה אבל לא מקוננות

(a)

(Mishnah): On Rosh Chodesh, Chanukah and Purim, the women do Inuy and clap, but they do not lament.

נקבר המת לא מענות ולא מטפחות

(b)

After the burial, they do not do Inuy and they do not clap.

אי זה הוא העינוי שכולן עונות כאחת וקינה שאחת מדברת וכולם עונות אחריה שנאמר (ירמיהו ט) ולמדנה בנותיכם נהי ואשה רעותה קינה

What is Inuy? They all respond together in lament. A Kinah (lament) is when one leads and the others respond, as the Pasuk states (Yirmiyah 9, 19), "teach a dirge to your daughters, each woman a lament to her friend".

אבל לעתיד לבוא מהו אומר (ישעיהו כה) בלע המות לנצח ומחה ה' אלהים דמעה מעל כל פנים וגומר

But in the future, what does the Pasuk state (Yeshaya 25, 8), "And He will eradicate death forever and Hash-m Elokim will wipe away tears from all faces etc."

גמרא רבי תנחום ברבי עילאי דמך בחנוכתא רבי דוסא דמך בריש ירחא דניסן. עבדין ליה איברייא. סברין מימר מן דעתון דרבנן ובדקו ואשכחון דלא מן דעתון דרבנן.

R. Tanchum b'R. Ilai passed away on Chanukah. R. Dosa passed away on Rosh Chodesh Nisan. They brought the mourners the Seudas Havra'ah (the first meal after the burial, given to the mourners). They thought that this practice was with the approval of the Rabbanan but they discovered that it was not with their approval (as this meal is not given on a festival).

רבי קרוספי דמך במועדא ועבדון ליה איברייא. סברין מימר מן דעתיה דרבי אמי. ובדקון ואשכחון דלא מן דעתיה דר' אמי.

(f)

R. Kruspi passed away on a festival and they brought the mourners the Seudas Havra'ah. They thought that R. Ami approved but they discovered that he did not approve.

רבי חלבו רבי בא בר זבדא בשם רב אפילו לשעה מן הדא (במדבר כ) ותמת שם מרים ותקבר שם.

R. Chelbo/ R. Ba bar Zavda quoting Rav: (The ruling of the Mishnah that one does not leave the body of a woman in the street, applies) even for a small period of time. This is learned from the Pasuk that states (Bamidbar 20,1), "Miryam died there and was buried there".

ואנן חמי רבנן ענין בדיבור'.

(h)

Question: (The Mishnah taught that they do not lament on a festival, lest one come to eulogize) But we see the Rabbanan lamenting responsively?

אמר ר' ירמיה חבירים זריזין הן ואינן באין לידי הספד.

(i)

Answer (R. Yirmiyah): Chaveirim (Chachamim) are careful, so they will not come to eulogize.

תני אין מוליכין חלילין לבית האבל אבל מוליכין חלילין לבית השמחה ולבית המשתה

Beraisa: (On Chol Hamoed) one may not take flutes to a house of mourning but one may take them to a house of celebration or to a wedding feast.
