THE CHERESH WHO IS EXEMPT FROM RE'IYAH (Yerushalmi Perek 1 Halachah 1 Daf 1a)

[דף א עמוד א] מתני' הכל חייבין בראייה חוץ מחרש שוטה וקטן וטומטום ואנדרוגינס נשים ועבדים שאינן משוחררין החיגר והסומא והחולה והזקן וכל שאינו יכול לעלות ברגליו

(a)

(Mishnah): All are obligated in Re'iyah (to enter the Mikdash and offer an Olah), except for a Cheresh, lunatic or child, Tumtum (one whose genitals are covered, so 'his' gender is a Safek) and Androginus (one who has male and female genitals), women, slaves who were not freed, one who is, blind, sick or old, and anyone who cannot ascend with his feet.

איזהו קטן כל שאינו יכול לרכוב על כתיפו של אביו ולעלות מירושלם להר הבית דברי ב''ש

Which child [is exempt]? It is anyone who cannot ride on his father's shoulder and ascend from Yerushalayim to Har ha'Bayis. Beis Shamai says so;

וב''ה אומרים כל שאינו יכול לאחוז בידו של אביו ולעלות מירושלם להר הבית שנא' [שמות כג יד] שלש רגלים:

Beis Hillel say, it is anyone who cannot hold his father's hand and ascend from Yerushalayim to Har ha'Bayis, for it says "Shalosh Regalim.''

גמ' מתני' בראיית קרבן אבל בראיית פנים אפי' קטן חייב

(Gemara): Our Mishnah discusses Re'iyah of offering a Korban, but Re'iyas Panim (entering the Mikdash), even a [tiny] child is obligated;

מן הדא [דברים לא יב] הקהל את העם האנשים והנשים והטף ואין קטן גדול מטף

Source: "Hakhel Es ha'Am ha'Anashim veha'Nashim veha'Taf'' - is a minor [who cannot ride on his father's shoulder or hold his hand and ascend from Yerushalayim to Har ha'Bayis] not greater than Taf (babies)?!

Note: It turns out that the "Katan'' of our Mishnah, who cannot ascend with his father, is obligated in Re'iyah and exempt from Korban. An older child is obligated even in a Korban. I.e. his father is commanded to bring a Korban for him, just like he is commanded to bring him. This is unlike the Bavli.

דתניא מעשה בר''י בן ברוקה ור''א חסמא שהיו מהלכין מיבנה ללוד והקבילו רבי יהושע בבקיעין

(Beraisa): A case occurred in which R. Yochanan ben Brokah and R. Eliezer Chisma were going from Yavneh to Lud, and they went to greet R. Yehoshua in Beki'in;

אמר להן מה חדוש היה לכם בבית המדרש היום

R. Yehoshua: What Chidush did you have in the Beis Midrash today?

אמרו לו הכל תלמידיך ומימיך אנו שותים

R. Yochanan ben Brokah and R. Eliezer Chisma: [We are] all your Talmidim, and we drink your water (learn your teachings. We should not speak Chidushim in front of you!)

אמר להן אעפ''כ א''א לבית המדרש שלא יהא בו דבר חדש בכל יום [דף א עמוד ב] מי שבת שם

R. Yehoshua: Even so [I authorize you to do so]. It is impossible that there is a Beis Midrash without a Chidush every day! Who expounded today? (After R. Gamliel was deposed and reinstated, sometimes he expounded, and sometimes R. Elazar ben Azaryah did.) They told him that R. Elazar ben Azaryah did.

אמרו לו ר' לעזר בן עזריה מה היתה פרשתו

They told him that R. Elazar ben Azaryah did. He asked what he taught.

הקהל את העם האנשים והנשים והטף פתח בה אמר הואיל והאנשים באין ללמוד והנשים לשמוע הטף למה באו אלא כדי ליתן שכר למביאיהן

R. Yochanan ben Brokah and R. Eliezer Chisma: "Hakhel Es ha'Am ha'Anashim veha'Nashim veha'Taf'' - [R. Elazar] began expounding. Men come to learn. Women come to listen. Why do Taf come? It is in order to bring merit to those who bring them.

אמר להן אין הדור יתום שר' לעזר בן עזריה בתוכו

R. Yehoshua: A generation that has R. Elazar ben Azaryah is not orphaned [from Chachamim]!

אתיא דרבי לעזר בן עזריה דלא כבן עזאי

Observation: R. Elazar ben Azaryah's teaching [that women do not come to learn] is unlike Ben Azai;

דתנינן תמן מיכן אמר בן עזאי חייב אדם ללמד את בתו תורה שאם תשתה תדע שהזכות תולה לה:

(Mishnah): From here, Ben Azai said that one must teach his daughter Torah, so if she will drink [Sotah water and survive, even though she sinned], she will know that merit suspends her [punishment. She may live up to three years.]

(Mishnah): A Cheresh [is exempt].

חברייא בשם ר' לעזר [דברים לא יב] למען ישמעון ולמען (ילמדון) [צ''ל ילמדו] עד כדון במדבר ואינו שומע חרש שומע ואינו מדבר

Question (Talmidim citing R. Lazar): "Lema'an Yishme'un u'Lema'an Yilmedu'' - from here [we know to exclude] one who speaks but cannot hear. What is the source [to exclude] a Cheresh who hears, but cannot speak?

ר' אילא בשם ר' לעזר למען (ילמדון ולמען ילמדון) [צ''ל ילמדו ולמען ילמדו]

Answer (R. Ila citing R. Lazar): [We read "u']Lema'an Yilmedu'' [like u']Lema'an Yelamedu, (i.e. they will teach. This is written about Hakhel; we learn Re'iyah from Hakhel.)

Inference (R. Yonah): Rebbi's Klalim (general rules) are not true;

דתנינן תמן חרש המדבר ואינו שומע לא יתרום

(Mishnah): A Cheresh who speaks but cannot hear may not declare Terumah [but b'Di'eved it is Terumah. The Cheresh that Chachamim discussed everywhere cannot hear and cannot speak.]

וסברינן מימר מדבר ואינו שומע חרש שומע ואינו מדבר (אינו - הגר''ח קניבסקי שליט''א מוחקו) חרש

Assumption: [Our Mishnah exempts one who lacks either ability, for] one who speaks but cannot hear, is a Cheresh. [Also] one who hears, but cannot speak, is a Cheresh.

ותנינן החרש שנחלץ והחרשת שחלצה והחולצת לקטן חליצתה פסולה

Support (Mishnah): If a Cheresh did Chalitzah, or a Chereshes did Chalitzah, or one did Chalitzah to a boy (minor), it is Pasul.

א''ר יוחנן בשאין יכולין לומר ואמר ואמרה

(R. Yochanan): This is because they cannot fulfill "he will say'' and "she will say''. (This disqualifies even if they can hear!)

ותנינן חרש שדיברו חכמים בכל מקום שאינו לא שומע ולא מדבר

(Mishnah): The Cheresh that Chachamim discussed everywhere cannot hear and cannot speak.

ודא מסייעה לר' יונה דר' יונה אמר הדא אמרה לית כלליי דרבי כללין

Conclusion: This supports R. Yonah, who says that Rebbi's Klalim are not true. (Elsewhere, Cheresh includes one who is able to hear or speak, but not both. We explained this based on HA'GAON RAV C. KANIEVSKY, SHLITA.)

Question (R. Yochanan): If one is deaf in one ear, what is the law?

אמר רבי יוסי בי רבי בון מחלוקת רבי יוסי ורבנן

Answer (R. Yosi bei R. Bun): R. Yosi and Rabanan argue about this;

דתניא [שמות כח מ] ולבני אהרן תעשה כתנות רבנן אמרו שתי כתונת לכל אחד ואחד

(Beraisa): "Veli'Vnei Aharon Ta'aseh Kutanos'' - Rabanan say, they made two tunics for each;

רבי יוסי אומר אפילו כתונת אחת לכל אחד ואחד

R. Yosi says, even one tunic for each [fulfills this].

מה טעמון דרבנן ולבני אהרן תעשה כתנות

i.

What is Rabanan's reason? "Veli'Vnei Aharon Ta'aseh Kutanos'' (plural, for each one).

מה טעמא דרבי יוסי לק' בני אהרן תעשה כתנות

ii.

What is R. Yosi's reason? For 100 (i.e. many) Bnei Aharon, make tunics.

והכא [דברים לא יא] תקרא את התורה הזאת נגד כל ישראל באזניהם רבנן אמרי שתי אזניים לכל אחד ואחד

Here (regarding Hakhel, from which we learn Re'iyah) it says "Tikra Es ha'Torah ha'Zos Neged Kol Yisrael b'Azneihem'' - Rabanan say, two ears for each one (must be able to hear it).

R. Yosi says, even one ear for each one (must be able to hear it).
