BURIAL CUSTOMS AND TEARING (Yerushalmi Halachah 8 Daf 18b)

משנה אין מניחין את המטה ברחוב שלא להרגיל את ההספד

(a)

(Mishnah): One may not leave a body in the town square, in order not to accustom the people to eulogize.

ולא של נשים לעולם מפני הכבוד נשים במועד מענות אבל לא מטפחות

(b)

One may never leave the body of a woman in the town square, out of respect for women. On Chol Hamoed, they do Inuy but they do not clap.

רבי ישמעאל אומר הסמוכות למטה מטפחות

(c)

R. Yishmael: The women who are close to the body may clap.

גמרא על כל המתים כולן הוא דוחה במטה ואינו מרבה בעסקיו.

(d)

(Gemara): One must rush to bury all bodies and not spend a long time eulogizing.

על אביו ועל אמו מרבה בעסקיו ואינו דוחה במטה.

(e)

For one's father or mother, one spends a long time eulogizing and one does not rush the body out for burial.

אם היה שעת דוחק או עונות גשמים אפילו על אביו ועל אמו מרבה בעסקיו ודוחה במטה שכל המרבה בעסק על אביו ועל אמו הרי זה משובח.

(f)

In a pressured time (such as on a Friday) or in the rainy season, even for one's father or mother, one spends a long time eulogizing but one also rushes out the body, as whoever spends a long time eulogizing his father or mother, he is praiseworthy.

על כל המתים אינו מבדיל קנה שפה שלו אלא על אביו ועל אמו דברי רבי מאיר

(g)

For all other relatives except for one's father or mother, one does not tear until the edge of the garment. These are the words of R. Meir.

רבי יהודה אומר כל קרע שאינו מבדיל קנה שפה הרי זה קרע של תפלות.

(h)

R. Yehudah: Any tear that does not reach the edge of the garment is worthless.

ר' יוחנן פליג עם רבי יודה בתרתיי.

(i)

R. Yochanan disagrees with R. Yehudah in two ways (as follows).

רבי יוחנן שמע דרבי חנינה תשיש סלק בעי מבקרתה גו איסרטא שמע דדמך.

R. Yochanan heard that R. Chaninah was sick. He went to visit him and while on the way, he heard that R. Chaninah had died.

נחת מן חמריה ואפיק מנא טביי דשובתא ובזעין

R. Yochanan got down from his donkey, took out his Shabbos clothing and tore it.

[דף יט עמוד א] כיי דתנינן תמן כהן גדול פורם מלמטן וההדיוט מלמעלן.

It is like the Mishnah in Maseches Horiyos that teaches, "A Kohen Gadol tears below, but a regular Kohen tears above (like all other mourners).

רבי לעזר בשם כהנא למעלן למעלן מקנה שפה למטן למטה מקנה שפה.

R. Elazar quoting Kahana: 'Above' means above the hem (including it) 'below' means below the hem (not including it).

רבי יוחנן אמר למטה ממש ואתיא דרבי ליעזר בשם כהנא כר' יודה.

R. Yochanan: 'Below' means at the bottom of the garment (not below the hem) and R. Eliezer in the name of Kahana is following R. Yehudah.

אין כרבי יודה לא יפרום כל עיקר

i.

If he would agree with R. Yehudah, he would not be permitted to tear at all (as without the hem it is worthless)?!

מאי כדון. חומר הוא בכהן גדול שאינו מבדיל קנה שפה.

ii.

Rather, it is a stringency that applies to the Kohen Gadol, that he does not tear through the hem.

2)

RESEWING AFTER TEARING (Yerushalmi Halachah 8 Daf 19a)

על כל המתים הוא שולל לאחר שבעה ומאחה לאחר שלשים על אביו ועל אמו אינו מאחה עולמית.

(a)

For all other relatives, one may sew up the tear with a wide seam after 7 days and with a proper seam (Ichui) after 30 days. For a father and mother, one may never sew a proper seam.

תני בשם רבי נתן האשה שוללת מיד ומאחה לאחר שלשים על אביה ועל אמה אינה מאחה עולמית.

(b)

Beraisa (quoting R. Noson): A woman may sew a wide seam immediately and sew a proper seam after 30 days. For her father or mother, she may never sew a proper seam.

אי זהו איחוי כאריג.

(c)

What is Ichui? As if it was woven.

הסולם והקפש אין מעכבין.

(d)

It is permitted to sew up like 'a ladder' or by folding over and sewing.

על כל המתים אינו קורע אלא העליון בלבד על אביו ועל אמו אפילו עשרה זה על גבי זה.

(e)

For all other relatives one only tears one's upper garment; for one's father or mother, one must tear even 10 layers down.

אין אפיקרסים מעכבת האשה אינו קורעת אלא העליון בלבד.

(f)

The Apikarsim need not be torn and a woman (for reasons of modesty) only tears her upper garment. (Some explain that an Apikarsin is an undergarment and some explain that it is a garment used to cover the head.)

תני רבי שמעון בן אלעזר אומר האשה קורעת את הפנימי והופכתו לאחוריה וחוזרת וקורעת את השאר.

(g)

Beraisa (R. Shimon ben Elazar): Upon the death of a parent, a woman tears her lower garment and turns it round to the back of her. Therefore, when she then tears her upper garments, her skin will not become visible.

על כל המתים הוא אסור בגיהוץ עד שלשים על אביו ועל אמו עד שנים עשר חדש.

(h)

After the death of other close relatives, a person may not press his clothing (Gihutz) for 30 days. For a parent, he may not press his clothing for 12 months.

אי זהו גיהוץ כלי צמר מגוהצין חדשים וכלי פשתן מגוהצין לבנים.

(i)

Question: What is Gihutz? New woolen (even colored) pressed garments. For linen garments, it is only prohibited when they are white.

על כל המתים הוא אסור בתגלחת עד שלשים על אביו ועל אמו עד שישלח פרע או עד שיגערו בו חביריו.

(j)

For all other close relatives, he may not take a haircut for 30 days. For a parent, he may not take a haircut until his hair becomes so overgrown that his friends chide him because of his appearance.

רבי שמואל בר אבודמי דמכת אימיה קומי מועדא תמניא יומין אתא שאל לר' מנא אמר ליה כל דבר שהוא תלוי בשבעה ושלשים הרגל מפסיק ברם הכא עד שישלח פרע או עד שיגערו בו חביריו.

(k)

R. Shmuel bar Avudimi lost his mother 8 days before the festival. He came and asked R. Mana what to do. R. Mana told him that anything that is dependent on 7 and 30 days is stopped by the festival. However, here, he may not take a haircut until his hair becomes so overgrown that his friends chide him.

על כל המתים אינו מגלה את לבו אלא על אביו ועל אמו דברי רבי מאיר

(l)

R. Meir: Except for a parent, a person does not reveal his heart when tearing.

רבי שמואל בשם רבי אבודמי בר תנחום מפני שבטלת ממנו מצות כבוד.

(m)

R. Shmuel quoting R. Avudimi bar Tanchum: This is because one is no longer able to fulfill the Mitzvah of honoring one's parent.

על כל המתים אסור לילך בסחורה עד שלשים יום על אביו ועל אמו עד שיגערו בו חביריו ויאמרו לו צא עמנו.

(n)

For all close relatives, it is prohibited to travel on business during the first 30 days; for a parent, it is until his friends chide him and tell him to join them.

על כל המתים הוא אסור לילך בסעודה עד שלשים יום על אביו ועל אמו עד שנים עשר חדש אם היתה חבורת מצוה או קידוש החדש מותר.

(o)

For all close relatives he may not attend a banquet for the first 30 days; for a parent, he may not attend for 12 months. If it is a gathering for a Mitzvah or for declaring the new month, it is permitted.

הרי שהיה מחליף בגדים כל שבעה חייב לקרוע את כולן.

(p)

If he changes his clothes during the 7 days of mourning, he must tear the replacement clothing.

רבי חייה רבא ור' חמא אבוי דרבי הושעיה תריהון אמרין כולהן אסורין באיחוי

(q)

R. Chiya Rabbah and R. Chama, the father of R. Hoshiyah: For the entire 7 days, one may not close up the tear with a proper seam (Ichui).

בר קפרא אמר אין לך אסור באיחוי אלא יום הראשון בלבד.

(r)

Bar Kafra: The prohibition of Ichui only applies to the first day.

אמר רבי חונא פלוגא אחרת ביניהון מאן דמר כולהן אסורין באיחוי עושה שאר הימים כיום הראשון אפילו יש עליו כמה בגדים חייב לקרוע את כולן

(s)

R. Chuna: There is another dispute between them - one says that Ichui is prohibited; he considers the other days like the first day. Also, even if he is wearing a number of garments, he must tear them all.

מאן דמר אין לך אסור באיחוי אלא יום הראשון בלבד עושה שאר הימים תוספת אפילו יש עליו כמה בגדים אינו קורע אלא העליון בלבד

(t)

The other opinion says that only the first day is prohibited in Ichui; he considers the other days as a mere addition. Also, even if he is wearing a number of garments, he must only tear the top garment.
