HETERIM FOR BUYING AND SELLING A SEFER TORAH (Yerushalmi Bikurim Perek 3 Halachah 6 Daf 12b)

(a)

(Mishnah): When did they say that Tosefes Bikurim are like Bikurim? It is when [the Tosefes] comes from Eretz [Yisrael]. When it comes from Chutz la'Aretz, it is not like Bikurim.

(b)

Why did they say that Bikurim are the Kohen's property? He may buy with them slaves, land, or a Tamei animal. A creditor may collect them for his debt, and a woman may collect her Kesuvah [from them, and one may use Bikurim to buy] a Sefer Torah.

R. Yehudah said 'we give [Bikurim] only to a Chaver, b'Tovah' (the Yisrael has Tovas Hana'ah, i.e. a Yisrael may pay him on condition to give it to a particular Kohen - RASHASH).

Chachamim say, we give them to people of the Mishmar, and they divide among themselves, like Kodshei ha'Mikdash.

(Gemara - R. Yosi citing R. Chiya bar Va): They asked R. Shimon ben Gamliel if one may sell a Sefer Torah to marry a woman, and he said 'yes';

[They asked him if one may sell a Sefer Torah] to learn Torah, and he said 'yes'; for needs of living, and he did not answer them.

(R. Yonah citing R. Chiya bar Va): They asked R. Shimon ben Gamliel if one may sell a Sefer Torah to marry a woman, and he said 'yes'; to learn Torah, and he said 'yes'; for needs of living, they did not ask and he did not answer them.

Question: It is fine according to R. Yonah. They did not ask [about needs of living], and he did not answer. According to R. Yosi, if they asked, why did he not answer?

Answer: When R. Chananyah came, [he said that] R. Pinchas citing R. Yochanan citing R. Shimon ben Gamliel said that one may sell a Sefer Torah to marry a woman, to learn Torah, and all the more so for needs of living. (There was no need for R. Shimon ben Gamliel to answer, since all the more so it is permitted.)

One who vows [not to benefit from] his son for (lest his son be distracted from) Talmud Torah, [even so the son] may fill a barrel of water for him and light a lamp for him;

R. Yakov bar Idi citing R. Yonason says, he may even buy things for him in the market.

Question: Do they argue?

Answer: (No.) Here (the son may not buy things for him in the market) refers to a man (he can buy for himself), and here (the son may buy in the market for the parent) refers to a woman (she does not normally go to the market).

(m)

If he was a distinguished man (who does not normally go to the market) they gave to him the law of a woman. (We explained this like R. SHLOMO SIRILIYO.)

A case occurred in which one vowed his son for Talmud Torah. The case came in front of R. Yosi ben Chalafta, and he permitted him to fill a barrel of water for him and light a lamp for him.

(Beraisa): One who sells a Sefer Torah of his father will never see a Siman of Brachah, and one who keeps a Sefer Torah in his house, it says about him "Hon v'Osher b'Veiso v'Tzidkaso Omedes La'ad."
