ARE BENOS GERIM PERMITTED TO KEHUNAH? (Yerushalmi Bikurim Perek 1 Halachah 5 Daf 3b)

(a)

(Mishnah - R. Eliezer ben Yakov): A woman, the daughter of Gerim, may not marry into Kehunah unless her mother was from Yisrael.

(b)

The same applies to converts and freed slaves, until 10 generations. [Females may not marry into Kehunah] unless her mother was from Yisrael.

All of [the Tana'im who argue about this] expound the same verse - [Kohanim will marry] "Ki Im Besulos mi'Zera Beis Yisrael";

Rebbi Yehudah expounds that her father must be from Yisrael;

Rebbi Yosi says, she must be conceived in Kedushas Yisrael;

R. Shimon says, she must bring Besulim in Kedushas Yisrael (when her Besulim finish growing at the age of three, she must be a Yisrael. A Kohen may not marry her if she converted after this.)

(Beraisa - in the name of R. Shimon): A convert who converted below three years old and one day, she is Kosher to Kehunah, for it says [about the captives from Midyan] "v'Chol ha'Taf ba'Nashim... Hachayu Lachem", and Pinchas (a Kohen) was among them.

Rebuttal (Rabanan): Keep them alive - for [RASHASH, Kidushin 78a - wives for your] male slaves, and for female slaves.

Note: It would have sufficed to say 'for Shefachos', and I know that they can be wives for your male slaves! Would one have thought that one may keep them only until the age of three, and then one must kill them, lest they seduce Bnei Yisrael to Aveirah, like the older females of Midyan did? (PF) Alternatively, perhaps it is not worth taking and raising infant girls just for the labor they will do when they mature; it is worth it only because they are destined to give birth to more slaves, including males.

(R. Yosi citing R. Yochanan): The Halachah follows R. Yosi, Kohanim conduct stringently like R. Eliezer ben Yakov.

One Kohen married a daughter of converts. The case came in front of R. Avahu, and he laid him on a bench to lash him.

Question (Rav Bivi): Didn't Rebbi (i.e. you) teach us that the Halachah follows R. Yosi?!

R. Avahu: If you see that it is so (he should not be lashed), appease him (so he will forgive me), and I will raise him.

After he raised him, [Rav Bivi] said 'since the strap (to lash) was released, even I (a Kohen) am permitted to her (such a woman)!'

(R. Yakov bar Idi bar Oshaya): A case occurred of a family in the south, that there were allegations against it. Rebbi sent R. Ruminis to check it, and found that the grandmother converted before three years and one day, and he was Machshir [the family] to Kehunah.

The Aseh is "v'Hu Ishah bi'Vsuleha Yikach", not a Bogeres, and any Lav derived from an Aseh is [like] an Aseh.

And similarly, "Ki Im Besulah me'Amav Yikach Ishah", and not a convert. Any Lav derived from an Aseh is an Aseh.

Question (R. Hoshayah): The second generation of a Mitzri (the child of a Mitzri convert) - this is a Lav derived from an Aseh ("Dor Shelishi Yavo Lahem bi'Kehal Hash-m"), which is an Aseh (and her children from a Kohen are Chalalim - KORBAN HA'EDAH Kidushin 4:6)!

Answer (R. Hoshayah): An Aseh of Yisrael is unlike an Aseh of Kohanim. An Aseh of Yisrael is forbidden to everyone. An Aseh of Kohanim is forbidden to Kohanim and permitted to Leviyim and Yisrael (so it is more lenient).
