ESTEEMED SPECIES THAT LOST THEIR IMPORTANCE (Yerushalmi Orlah Perek 3 Halachah 6 Daf 19b)

îúðé' ðúôöòå äàâåæéí ðúôøãå äøéîåðéí ðôúçå äçáéåú ðçúëå äãìåòéï ðúôøùå äëëøåú éòìå áàçã åîàúéí:

(a)

(Mishnah): If the nuts broke, the pomegranates were cleaved, the barrels were opened, the gourds were cut, or the loaves were sliced, they are Batel in 201.

âî' ðôìå åàçø ëê ðúôöòå áéï ùåââ áéï îæéã ìà éòìå ãáøé øáé îàéø.

(b)

(Gemara): If [the nuts] fell and afterwards broke, whether this was Shogeg or Mezid, they are not Batel. R. Meir says so;

øáé éåãä àåîø áéï ùåââ áéï îæéã éòìå.

(c)

R. Yehudah says, this was Shogeg or Mezid, they are Batel.

(d)

R. Yosi says, if they fell b'Shogeg, they are Batel; b'Mezid, they are not Batel.

What is the reason of R. Meir? They fined Shogeg due to Mezid. (If you will say that b'Shogeg it is permitted, people will do so b'Mezid, and say that they were Shogeg.)

What is the reason of R. Yehudah? He already was 'fined' (they are not as esteemed as they were).

Answer: It is like R. Avahu citing R. Yochanan said - all Isurim [that became mixed], if one added [Heter so that now there is a Shi'ur of Bitul], b'Shogeg it is permitted, b'Mezid it is forbidden.

(R. Yosi bei R. Bun citing Shmuel): If figs and grapes shriveled while attached, they receive Tum'as Ochlim, and [in another respect they are attached, for] one who detaches them on Shabbos is liable for reaping.
