WHEN DOES ONE PAY FOR AN AVEIRAH WITH LASHES? (Yerushalmi Perek 3 Halachah 1 Daf 18a)

על דעתיה דרשב"ל מה איכא בין אילין תנאי לאילין רבנן

Question: (HA'GAON RAV C. KANIEVSKY, SHLITA, Megilah 1:6 - if one was Shogeg about an Aveirah with lashes, in Terumos, Reish Lakish exempts him from paying for the Aveirah, even though he is not lashed; R. Yochanan disagrees.) According to Reish Lakish, what is the difference between these Tana'im (R. Nechunyah and R. Shimon ben Menasiya), who exempt Chayavei Kerisos from payment, and Rabanan? (In any case he does not pay, for there is a Lav with the Kares!)

Answer: They argue about Lavim without Kares.

רבי יודן אמר הבא על הממזרת ביניהון

Explanation #1 (R. Yudan): They argue about one who had Bi'ah with a Mamzeres (a Lav without Kares);

ר' חנניה אמר המצית גדיש חבירו ביום טוב ביניהון

(d)

Explanation #2 (R. Chananyah): They argue about one who burned another's stack on Yom Tov;

על דעתיה דאילין תנאי הואיל ואין בהן כרת משלם על דעתיה דרבנין דאילו הואיל ויש בהן מכות אינו משלם

According to these Tana'im (R. Nechuniya and R. Shimon), since there is no Kares, he pays. According to [the other] Rabanan, since there are lashes, he does not pay. (OHR SOMAYACH (Hilchos Lulav 8:5) infers that the Stam Yerushalmi holds that one who burns on Yom Tov is lashed, unlike R. Yochanan in the Bavli.)

מעתה אילו נערות שיש להן קנס דלא כרבנין

Question: If so, our Mishnah 'these Na'arah have a fine...' is unlike Rabanan!

אמר רבי מתניה [דף יח עמוד ב] תיפתר דברי הכל בממזר שבא על הממזרת

Answer (R. Matanyah): You can answer that it is like everyone, e.g. a Mamzer who had Bi'ah with a Mamzeres (there is no Lav).

ואשת אחיו לאו יבמתו היא

Question: [Why is there a fine for] Eshes Achiv - is she not his Yevamah?! (It is a Mitzvah to have Bi'ah with her, even against her will! We must say that his brother died. If not, she is an Arusah, and he is Chayav Misah! Surely he had no children, for his widow was a Besulah.)

אמר רבי מתניה תיפתר שהיו לאחיו בנים ואירס אשה ומת ובא אחיו ואנסה:

Answer (R. Matanyah): The case is, his brother had children [from another wife] and was Mekadesh a woman, and he died, and his brother came and raped [or enticed] her.

THE STATUS OF A REDEEMED CAPTIVE (Yerushalmi Perek 3 Halachah 2 Daf 18b)

מתני' ואילו שאין להן קנס

(a)

(Mishnah): These girls do not receive a fine:

הבא על הגיורת ועל השבויה ועל השפחה שנפדו או שנתגיירו או שנשתחררו יתרות על שלש שנים ויום אחד

A convert, captive or slave who converted, was redeemed or was freed above three years and one day;

רבי יהודה אומר שבויה שנפדית הרי היא בקדושתה אף על פי שהיא גדולה:

R. Yehudah says, a redeemed captive retains her Kedushah (is assumed to be a virgin), even if she was a Gedolah.

גמ' אמר רבי יוחנן לא ריבה אותה רבי יהודה אלא לקנס

(b)

(Gemara - R. Yochanan): R. Yehudah includes a redeemed captive only for a fine (she is considered a Besulah, but not to be Machshir her to Kehunah or Terumah).

תני רבי חייה אף לכתובת (מנה - קרבן העדה מוחקו) מאתים

(c)

(R. Chiyah - Beraisa): It is even for a Kesuvah of 200.

רבי שמעון בן לקיש אמר אף להאכילה תרומה

(d)

(Reish Lakish): It is even to feed her Terumah (mid'Rabanan, if she is a Bas Kohen).

על דעתיה דרבי שמעון בן לקיש רבי יודה ורבי דוסא שניהן אומרים דבר אחד

According to Reish Lakish, R. Yehudah and R. Dosa said the same matter;

דתנינן תמן השבויה אוכלת בתרומה דברי רבי דוסא

(Mishnah): A captive may eat Terumah. R. Dosa says so.
