WHICH GIRLS CAN RECEIVE THEIR OWN GET? (Yerushalmi Perek 6 Halachah 2 Daf 35b)

מתני' האשה שאמרה התקבל לי גיטי צריכה שני כיתי עדים שנים שיאמרו בפנינו אמרה ושנים שיאמרו בפנינו קיבל וקרע

(a)

(Mishnah): If a woman told a Shali'ach 'receive my Get for me', to remarry, she needs two pairs of witnesses. Two must testify that they heard her command the Shali'ach, and two testify that they saw the Shali'ach receive the Get and tear it up (this will be explained).

אפילו הן הראשונים והן האחרונים או אחד מן הראשונים ואחד מן האחרונים ואחד מצטרף עמהן

The first two can be the last two (they testify about both of these), or one of the first and one of the last, and one [who testifies about both] joins with them.

נערה מאורסה היא ואביה מקבלין את גיטה

(b)

A Na'arah Me'urasah (during Eirusin), she or her father can receive her Get;

רבי יהודה אומר אין שתי ידיים זוכות כאחת אלא אביה מקבל גיטה בלבד

(c)

R. Yehudah says, two people do not merit the same matter. Rather, only her father can receive her Get.

וכל שאינה יכולה לשמור את גיטה אינה יכולה להתגרש

(d)

Any girl who cannot guard her Get cannot be divorced.

קטנה שאמרה התקבל לי גיטי אינו גט עד שיגיע גט לידה לפיכך אם רצה הבעל להחזיר יחזיר שאין הקטן עושה שליח

If a minor told [a Shali'ach] 'receive my Get', it is not valid until it reaches her hand. Therefore, if her husband wanted to retract, he can retract, for a minor cannot make a Shali'ach.

ואם אמר לו אביה צא וקבל לבתי גיטה אם רצה להחזיר לא יחזיר:

If her father told [a Shali'ach] 'receive for my daughter her Get', [her husband] cannot retract.

גמ' שנים שאמרו בפנינו אמרה ושנים שאמרו בפנינו קיבל וקרע. הוא מודה יצטרף השליח.

(Gemara) Question: [Why do we require] two that say 'she said in front of us', and two say 'in front of us he received and tore'? [Presumably,] the [Shali'ach] admits. The Shali'ach should join [with one witness]!

תיפתר שהיה קרוב.

(h)

Answer: The case is, he is a relative [who cannot testify].

הדא אמרה שהקרוב נעשה שליח.

Inference: A relative can be a Shali'ach.

נערה מאורסה היא ואביה מקבלין גיטה.

(i)

(Mishnah): A Na'arah Me'urasah, she or her father can receive her Get;

ריש לקיש אמר כמחלוקת בגיטין [דף לו עמוד א] כך מחלוקת בקידושין.

(j)

(Reish Lakish): Just like [Chachamim and Rebbi Yehudah] argue about Gitin, so they argue about [who can receive her] Kidushin.

אמר רבי יוחנן הכל מודין בקידושין שאביה מקדשה ולא היא.

(k)

(R. Yochanan): All agree about Kidushin, that her father [can receive it], and not she.

מודה ר"ל בנישואין לא הכל ממנה להשיא את עצמה ולהפסיד מעשה ידיה לאביה.

Reish Lakish agrees about Nisu'in. She cannot make Nisu'in by herself, [and remove herself from her father's Reshus] and make her father lose her earnings.

על דעתיה דרבי יוחנן אין לה דעת אצל אביה ואינה עושה שליח. על דעתיה דריש לקיש יש לה דעת אצל אביה והיא עושה שליח.

According to R. Yochanan, she does not have Da'as with respect to her father, and she cannot make a Shali'ach. According to Reish Lakish, she has Da'as with respect to her father, and she can make a Shali'ach;

מתניתא פליגא על ר' יוחנן האיש מקדש בו ובשלוחו והאשה מתקדשת בה ובשלוחה.

Question (against R. Yochanan - Mishnah): A man can be Mekadesh [a woman] through him, or through his Shali'ach. A woman can become Mekudeshes through herself, or through her Shali'ach. (This implies even a Na'arah!)

פתר לה בגדולה.

Answer: He explains that it refers only to a Gedolah (Bogeres).

והתנינן קטנה שאמרה התקבל לי גטי אינו גט עד שיגיע גט לידה

Question (Mishnah): If a minor said 'receive my Get', it is not valid until it reaches her hand. (This implies that a Na'arah's Shali'ach can receive her Get!)

פתר ביתומה.

Answer: He explains that it refers to an orphan. (Her father died.)

והא תנינן אם אמר לו אביה צא והתקבל לבתי גיטה אם רצה להחזיר לא יחזיר.

(p)

Question (Mishnah): If her father told [a Shali'ach] 'receive for my daughter her Get', [her husband] cannot retract. (This implies that her father is alive!)

פתר לה לצדדין היא מתניתא. רישא ביתומה. וסיפא בשיש לה אב.

(q)

Answer: The clauses of our Mishnah discuss different cases. The Reisha discusses an orphan, and the Seifa discusses one who has a father.

מתניתא פליגא על ריש לקיש האיש מקדש את בתו כשהיא נערה בו ובשלוחו

(r)

Question (against R. Yochanan - Mishnah): A man can be Mekadesh his daughter when she is a Na'arah, by himself or through his Shali'ach. (This implies that he cannot be Mekadesh her through herself, or through her Shali'ach!)

פתר לה כרבי יהודה דרבי יהודה אמר אין שתי ידיים זוכות כאחת.

Answer: He explains it like R. Yehudah. R. Yehudah says, two people do not merit the same matter;

דאמר רבי יוסי חד רב נפק מבית וועדא אמר נפק עובדא כר' יוחנן.

(R. Yosi): One of the Rabanan left the Beis Midrash, and said that they ruled about an episode like R. Yochanan, and all agreed with him.

וסמכין עלוי.

Question: May we rely on him? (PNEI MOSHE)

לא הוה צריכה מיסמוך עליו אלא דהות מן ימא לטיגני.

Answer: We need not rely on him (that he does not forget. There was no time to forget. He said this immediately after leaving, like) from the sea to Tigni (a city on the coast).

חברייא אמרין בחצר ובארבע אמות פליגין רבי יוחנן אמר יש לה חצר ויש (להן) [נראה שצ"ל לה] ארבע אמות. ריש לקיש אמר אין לה חצר ואין (להן) [צ"ל לה - קרבן העדה] ארבע ארבע אמות.

(Talmidim): They argue about [whether or not a Ketanah can be divorced through her] Chatzer and the four Amos (around her). R. Yochanan said that she has a Chatzer and four Amos (she can receive her Get in them), and Reish Lakish said that she does not have a Chatzer and four Amos.

רבי אלעזר אמר בחצר פליגין ואין לה ארבע אמות.

(R. Elazar): They argue about [whether or not she has] a Chatzer, but [all agree that] she does not have four Amos.

Question: Does R. Yochanan say [that she can receive her Get] within the range of her outstretched arm?

ר' אלעזר שאל חצירו של שליח מהו שתיעשה כידו.

(w)

Question (R. Elazar): Is the Chatzer of a Shali'ach like his hand?

נישאת היא לא אביה.

If [a Na'arah] had Nisu'in, she [receives her Get], and not her father.

קטנה אביה לא היא. (ניסית) [צ"ל ואם יש בה דעת - ספר ניר] בין היא בין אביה

(y)

A minor (Arusah), her father [receives her Get], and not she (if she has no Da'as). If she has Da'as, either she or her father [can receive it];

[צ"ל נישאת לא היא לא אביה - ספר ניר] אם יש בה דעת היא לא אביה.

If she had Nisu'in, neither she or her father [can receive it]. If she has Da'as, she and not her father. (We explained this like SEFER NIR.)

אי זו היא קטנה שהיא צריכה להתגרש

(z)

Question: Which minor [orphan has enough Da'as to receive Kidushin,] that she needs to be divorced [or do Mi'un, if she wants to leave her husband - OR GADOL 41]?

אמר רבי יוחנן כל שנותנין לה גיטה ודבר אחר עמו והיא מוציא' אותו לאחר זמן:

Answer (R. Yochanan): It is anyone that they give to her her Get and something else with it, and she takes it [her Get] out later (she knows to guard it).
