WHEN ONE MAY SELL A SLAVE IN CHUTZ LA'ARETZ (Yerushalmi Perek 4 Halachah 6 Daf 24b)

תני יוצא עבד עם רבו בחוצה לארץ לפיכך אם מכרו לשם מכור.

(a)

(Beraisa): A slave goes with his master in Chutz la'Aretz. Therefore, if he sold him there, he is sold.

בא מחוצה לארץ על מנת לחזור כופין אותו (למחר - הגהות ר' יוסף דיננער מוחקו) לחזור. על מנת שלא לחזור אין כופין אותו לחזור.

(b)

If he came from Chutz la'Aretz with intent to return, we force [the slave] to return [with his master]. If he came with intent not to return, we do not force [the slave] to return.

ברח מחוצה לארץ רשאי להחזירו.

(c)

If he fled from Chutz la'Aretz to Eretz Yisrael, [his master] may return him;

ברח מארץ לחוצה לארץ רבי יאשיה בשם ר' חייה רבא אמר מותר. ר' הושעיה רבה אמר מותר.

(d)

If he fled from Eretz Yisrael to Chutz la'Aretz, R. Yoshiyah citing R. Chiyah Raba permits [to sell him there. Also] R. Hoshayah Rabah permits;

רבי מרינוס בריה דר' הושעיה רבה אמר אסור.

(e)

R. Merinus brei d'R. Hoshayah Rabah forbids.

א"ר זעירא לא פליגין מ"ד מותר בלמוד לברוח לשם. ומאן דאמר אסור בשאינו למוד לברוח לשם.

(f)

(R. Ze'ira): They do not argue. The one who permits discusses one who is wont to flee to there (he has done so before). The one who forbids discusses one who is not wont to flee to there.

אמר ר' יוסי ולא פליגין מאן דאמר מותר (ביכול) [צ"ל בשאינו יכול - קרבן העדה] להביאו משם. ומ"ד אסור (בשאינו יכול) [צ"ל ביכול - קרבן העדה] להביאו משם.

(g)

(R. Yosi): They do not argue. The one who permits discusses when [his master] cannot bring him back [to Eretz Yisrael]. The one who forbids discusses when he could bring him back.

(ניתני) [צ"ל תני - הגהות ר' יוסף דיננער] ואם התנה עמו מותר.

(h)

(Beraisa): If he stipulated [with the slave when he bought him that he may sell him to Chutz la'Aretz], it is permitted.

עד כדון בגדולים. בקטנים ניתני עם רבהון.

(i)

This refers to [one who bought] adult slaves. [If he bought] minors, he can stipulate with their masters [who sold them].

עד כדון בשהיה רבו ישראל. היה רבו גוי.

(j)

Limitation: This applies only when his master [who sold him] was a Yisrael. If he was a Nochri (it does not apply. We explained this like HAGAHOS R. DINAR.)

רבי טבלא זבין עבדיה ומתני עם רבהון.

R. Tavla bought slaves, and stipulated with their masters.
