ONE WHO MAY NOT KEEP THE ENTIRE GET (Yerushalmi Perek 2 Halachah 3 Daf 12a)

הרי זה גיטיך על מנת שתתנהו לי פסול. ע"מ שתחזירהו לי כשר.

(a)

If one said 'this is your Get on condition that you give it [back] to me', it is Pasul; 'on condition that you return it to me', it is Kosher.

ולא דא היא קדמייתא.

(b)

Question: Is this not the same as the first case?! (Why is the latter Kosher?)

אמר רבי יוסי (לכשתדיני) [צ"ל לכשתרצה - ספר משביח, משרידי הירושלמי]

Answer #1 (R. Yosi): [He said] when you will want [you will return it to me. She need not return it, e.g. if she never wants. - HAMASHBI'ACH, SERIDEI HAYERUSHALMI]

אמר רבי יוסי בי רבי בון לכשתזכה בו (ובמצוותו - הגהות ר' יוסף דיננער מוחקו) תח]זירהו לי.

Answer #2: (R. Yosi bei R. Bun): [In the latter case, he means] when you will acquire it [and be divorced, afterwards] you will return it to me. (HAGAHOS R. DINAR)

כהדא תרונגא הוון מצפצפים תמן והוה רב נחמן בר יעקב יהב תרנגא מתנה לבריה ואמר ליה לכשתזכה בו ובמצוותו תחזירהו לי.

Support: This is like the case in which Esrogim were scarce there (in Bavel), and Rav Nachman bar Yakov gave his Esrog for a gift to his son, and said 'when you will acquire it and its Mitzvah, you will return it to me.'

ר' ירמיה בעי כתבו על כוס של זהב ואמר לה מקום הכתב שליך ובין השיטים שלי. ויש כתב.

Question (R. Yirmeyah): If one wrote [a Get] on a gold cup, and said to her 'the place of the writing is yours, and between the lines is mine', and there is writing [that joins the lines, i.e. letters that extend to the lines above and below - what is the law]? (HAMASHBI'ACH)

עור הנקרע הרי כשר. נתקרע הרי זה פסול.

(g)

If a hide [on which one wrote a Get] Nikra (was torn by itself), it is Kosher. If Niskara (someone tore it), it is Pasul.

בשלא (נתקרע) [צ"ל נקרע - הגהות ר' יוסף דיננער] כקרע בית דין. אבל נקרע כקרע בית דין [צ"ל פסול - הגהות ר' יוסף דיננער] אי זהו קרע של בית דין בין כתב לעדים.

[Nikra is Kosher] when it was not torn the way Beis Din tears, but if it was torn the way Beis Din tears, it is Pasul. How does Beis Din tear? Between the writing and the witnesses.

על העלה של זית. ולא כמקורע הוא.

(i)

Question: [Our Mishnah is Machshir] on an olive leaf. (Surely, it cannot fit on one leaf.) Is it not as if it was torn?!

אמר רבי זעירא תנא בונה בר שילא אפילו כותב אני פלוני מגרש את אשתי כשר

Answer #1 (R. Ze'ira): Bunah bar Shila taught that even if he writes 'I, Ploni, divorce my wife', it is Kosher.

ואתייא כיי דמר רבי אילא אם פירש פסול. ואם לא פירש כשר.

Answer #2: This is like R. Ila said. (Really, it is written on more than one leaf.) If [the leaves] separated from the branch, it is Pasul. . If they did not separate, it is Kosher. (We explained this like ME'IRI, 20b.)
