TWO WHO SAW THE WRITING OR SIGNATURES (Yerushalmi Perek 2 Halachah 1 Daf 10b)

ר' יסא בשם ר' יוחנן וביוצא מתחת ידו

(a)

(R. Yosah citing R. Yochanan): (The Seifa teaches that if one says 'b'Fanai Nechtav', and two say 'b'Faneinu Nechtam', it is Kosher.) This is when he (who says b'Fanai Nechtav) holds it.

והוה רבי זעירא מסתכל ביה.

R. Ze'ira stared at him [in astonishment].

א"ל למה את מסתכל בי ואפילו יוצא מתחת ידי אחר.

(R. Yosah): Why do you stare at me? [I retract. It is Kosher] even if another holds it.

אתיא דרבי יוסי כרבי אימי עד לא יחזור ביה.

(b)

R. Yosi, before he retracted, held like R. Imi. (Only the Shali'ach is believed like two).

א"ר מנא אפילו מן דחזר ביה אתיא היא שנייה היא כתיבה בשנים וחתימה בשנים חתימה בשנים כחה מיופה וכתיבה בשנים אין כחה מיופה:

Rebuttal (R. Mana): [Even after he retracted, [we can say that] he holds like [R. Imi]. Two [who saw the] writing is unlike two [who saw the] signatures. Two [who saw the] signatures have great strength (the primary concern is Kiyum. We are not so adamant about testimony of the writing.) Two [who saw the] writing do not have great strength (we need solid testimony about the signatures. We explained this like RIDVAZ.)

MUST KESIVAH AND CHASIMAH BE ON THE SAME DAY? (Yerushalmi Perek 2 Halachah 2 Daf 10b)

מתני' נכתב ביום ונחתם ביום בלילה ונחתם בלילה בלילה ונתחתם ביום כשר

(a)

(Mishnah): If a Get was written during the day and signed the (same) day, or it was written at night and signed during the day; or it was written at night and signed at night, it is valid.

ביום ונתחתם בלילה פסול

(b)

If it was written during the day and signed at night, it is Pasul;

ור"ש מכשיר שהיה רש"א כל גיטין שנכתבו ביום ונחתמו בלילה פסולין חוץ מגיטי נשים:

R. Shimon is Machshir. He disqualifies any document written during the day and signed at night, except for a Get of divorce.

[דף יא עמוד א] גמ' אמר רבי יוחנן פסול מפני אכילת פירות.

(d)

(Gemara - R. Yochanan): It is Pasul due to eating the Peros (the date on the Get implies that he lost the rights to Peros of her property during the day, and really, they were his until it was given the next day.)

אמר ליה ריש לקיש מעתה תחוש לגיטין הבאין ממדינת הים שמא נכתבו ביום ונחתמו בלילה.

Question (Reish Lakish): If so, we should be concerned for Gitin that come from Chutz la'Aretz. Perhaps [this is like concern lest] they were written during the day and signed at night?! (There, it is predated one day, and we disqualify lest she take what he sold that day. Here, surely the date is long before she received it!)

א"ל זה זיופו מדבר אחר.

(f)

Answer (R. Yochanan): Here (Gitin from overseas), the Ziyuf (ruse) is from another matter. (There is no way to avoid this. The husband realizes, and he can request that Beis Din record when she was divorced. When it was signed the next night, he does not think that he can lose through this. Surely we should enact to protect him! We explained this like MEICHAL HA'MAYIM.)
