*********************GIRSA SECTION*********************

We recommend using the textual changes suggested by the Bach and the marginal notes of the Vilna Shas. This section is devoted to any other important corrections that Acharonim have pointed out in the Gemara, Rashi and Tosfos.

[1] Gemara 74b [line 3]

In Dikdukei Sofrim the words "Nishadyei Min"

appear as "v'Lishadyei Minei" ולשדייה מיניה

*******************************************************

AFILU CHURVAH... AFILU BI'SHEVIL SHEL KERAMIM- that is, a Mavoy that has a Churvah or a Shevil Shel Keramim (see next entry) on one side and a Chatzer containing one house on the other

SHEVIL SHEL KERAMIM- a path through vineyards (that opens onto a Chatzer on one side and a Mavoy on the other side)

(a)King Shlomo decreed that transferring objects from a Reshus ha'Yachid owned by one person or group to a Reshus ha'Yachid owned by another person or group is forbidden, unless an Eruv Chatzeros (lit. a mixing of the courtyards, Rambam Hil. Eruvin 1:6; or fraternization of the courtyards, Eruvin 49a) is created on Friday, before Shabbos begins (Shabbos 14b, Eruvin 21b).

(b)Aside from houses, there are three categories of Reshus ha'Yachid: Gagos (privately owned roofs), Chatzeros (jointly owned courtyards), and Karpifos (privately owned fenced-in areas that are used for storage or corrals, but not lived in). Tana'im argue as to whether it is permitted to carry from one of these types of Reshus ha'Yachid to another when they are owned by different people. Rebbi Meir (Mishnah Eruvin 89a) rules that it is prohibited to transfer between these different types of Reshuyos, the Rabanan (ibid., and Gemara 91a) prohibit transferring from a Karpaf to one of the other two, and Rebbi Shimon (ibid.) rules that it is permitted to transfer between all of these Reshuyos.

1.All of these opinions agree that it is prohibited to carry from houses to courtyards or Karpifos, or to roofs and houses owned by another person, since houses are used on a very regular basis and are therefore considered separate from all other Reshuyos ha'Yachid (RASHI Eruvin 91a DH v'Karpifos).

(c)The above argument applies only to utensils that were in a roof, courtyard, or Karpaf when Shabbos began ("she'Shavsu l'Sochan"). Utensils that were in a house when Shabbos began and then taken out on Shabbos to a Chatzer through the use of an Eruv Chatzeros may not be transferred to one of the other two types of Reshuyos even according to Rebbi Shimon.

DILMA ASI L'AFUKEI MANI D'CHATZER L'CHURVAH- It is forbidden to transfer any objects from the Mavoy to the Churvah since the Churvah did not join in the Shituf. The fact that the owner of the Churvah did not contribute to the Shituf does not prevent the other inhabitants from carrying in the Mavoy since it is not a Beis Dirah (defined as a place where people sleep or eat, depending on the differing opinions).

5)[line 21]אמר שמואל הכי?AMAR SHMUEL HACHI?- did Shmuel indeed say that a Mavoy with a house open to it on one side and a Chatzer (containing one house) on the other may make a Shituf?

ACHVI LI USHPIZEI- show me where he is staying (lit. his inn)

b)[line 22]אחוי ליACHAVEI LEI- he showed him

7)[line 25]לחצירותL'CHATZEROS- the plural form of "Chatzeros" would appear to imply that there are at least two Chatzeros present in the Mavoy

8)[last line]לחייאLICHYA- a pole or plank used to permit carrying in a Mavoy (see Background to 73:18)

74b----------------------------------------74b

ASA RAV ANAN- Rav Anan (who was the son of Rav) came (after Shmuel's death)

10)[line 1]שדיהSHADYEI- he threw it down (because that Mavoy contained only a house and a Chatzer)

V'ASINA MI'SHMEI D'MAR SHMUEL- that was authorized by Mar Shmuel

12)[line 3]נישדייה (מן) [מיניה]NISHADYEI (MIN) [MINEI]?!- and throw it down (from the Mavoy)!?

13)[line 5]חזנאCHAZANA- a sexton

V'ASI BAYEIS B'VEI KENISHTA- and he would spend the night in a synagogue [that opened into the Mavoy]. When Rav Anan threw the Lechi down, it was because the sexton no longer slept in the synagogue.

SHE'TZIDO ECHAD OVED KOCHAVIM- that is, on one side of the Mavoy there is a Chatzer which contains many houses belonging to Nochrim (TOSFOS).

EIN ME'ARVIN OSO DERECH CHALONOS- that is, if the Jew living in the Chatzer off of this Mavoy is joined by a window to the house of another Jew whose house opens into a Reshus ha'Rabim, they may not make an Eruv together in order to allow the Jew whose house does not open into the Mavoy to carry his utensils into the Mavoy through the window that joins their houses (RASHI DH Ein). (Alternatively, they may not make an Eruv together due to the fact they are only joined by virtue of their doors — TOSFOS; see Insights.)

17)[line 12]אמר רב אפילו בחצר?AMAR RAV AFILU B'CHATZER?- did Rav say that this ruling applies in the identical case where a Chatzer is substituted for the Mavoy?

D'IY LO AMAR, MAI?- if Rav would not have said that a Chatzer has the same law, why would I have thought that it is different?
