DAF DISCUSSIONS - CHAGIGAH 6

Sam Kosofsky asked:

Rebbe,

R. Akiva holds that both the kellalim and the peratim of the Torah were given to Moshe Rabbeinu at Har Sinai. We find instances, however, in which Moshe clearly did not know the peratim of the halacha and had to ask Hash-m. We find the cases of bnos Tzlapchad, the punishment of the mekoshesh etzim and the inyan of Pesach sheni. How would R. Akiva reconcile these cases with his view that kelalim and peratim were given at Sinai?

Sam Kosofsky

The Kollel replies:

These Halachos were originally withheld from MOshe in order to teach them through the particular people who were involved, as per the principle of "Megalgelin Zechus Al Yedei Zakai etc." (Sanhedrin 8a).

Best wishes Sam,

Mordecai Kornfeld
