WHY CHILDREN ARE OBLIGATED MORE THAN A CHERESH (Yerushalmi Perek 1 Halachah 1 Daf 1b)

Source (R. Lazar): [We learn from] "Atah Hareisa La'da'as''. (HA'GAON RAV C. KANIEVSKY, SHLITA - the Yerushalmi holds that even though a lunatic is exempt from all Mitzvos, if not for a Drashah, he would be obligated, like a minor.)

(Mishnah): A child [is exempt].

רבי ירמיה ור' אייבו בר נגרי הוון יתיבין אמרין תנינן אי זהו קטן כל שאינו יכול לרכוב על כתיפו של אביו

R. Yirmeyah and R. Eibo bar Nagri were sitting and saying our Mishnah. Who is a child [who is exempt]? It is anyone who cannot ride on his father's shoulder...

וקטן שומע וקטן [דף ב עמוד א] מדבר

Question: A child [who can ride on his father's shoulder] - can he hear (understand)?! Can [such] a child speak?! (He is not better than a Cheresh!)

חזרון ואמרון [דברים טז טז] כל זכורך לרבות את הקטן

Answer: "Kol Zechurcha'' includes [even such] a child.

ויימר כל זכורך לרבות את החרש

Question: We should say that "Kol Zechurcha'' includes a Cheresh! (We explained this like PNEI MOSHE.)

למען ישמעון ולמען (ילמדון) [צ''ל ילמדו] פרט לחרש

Answer: "Lema'an Yishme'un u'Lema'an Yilmedu'' excludes a Cheresh.

ויימר למען ישמעון ולמען (ילמדון) [צ''ל ילמדו] פרט לקטן

Question: We should say that "Lema'an Yishme'un u'Lema'an Yilmedu'' excludes [such] a child!

אמר ר' יוסה מאחר שכתוב א' מרבה וכתוב א' ממעט מרבה אני את הקטן שהוא ראוי לבוא לאחר זמן ומוציא את החרש שאינו ראוי לבוא לאחר זמן

Answer (R. Yosah): Since one verse includes, and one verse excludes, I include a child, who is proper to come [to be obligated] later, and I exclude a Cheresh, who is proper to come [to be obligated] later.

שמואל בר אבא בעא קומי רבי זעירה קטן חרש מהו שיהא חייב

Question (Shmuel bar Aba, to R. Ze'irah): Is a child Cheresh obligated?

א''ל איתא חמי יציבא בארעא וגיורא בשמי שמייא אילו גדול חרש פטור קטן חרש לא כ''ש

Answer (R. Ze'irah): See - is the native on the ground, and the convert in Shamayim?! (This is absurd!) An adult Cheresh is exempt. Is a child Cheresh not all the more so [exempt]?!

א''ר ירמיה בדין היה קטן ולא חרש יהא פטור גזירת הכתוב הוא כל זכורך לרבות את הקטן

Objection (R. Yirmeyah): We should have said that a child who is not a Cheresh is exempt. A Gezeiras ha'Kasuv "Kol Zechurcha'' includes a child;

הייתי אומר אילו גדול חרש יהא חייב שלא לחלוק בהילכות זכורך

I would say that [even a child Cheresh is included, and even] an adult Cheresh should be obligated, lest we distinguish in the laws of "Zechurcha''!

הוי צורכה לההוא דאמר רבי יוסה מאחר שכתוב א' מרבה וכתוב א' ממעט מרבה אני את הקטן שהוא ראוי לבוא לאחר זמן ומוציא אני את החרש שאינו ראוי לבוא לאחר זמן:

Therefore, we need R. Yosah's teaching. Since one verse includes, and one excludes, I include a child who is proper to come to Chiyuv later, but not a Cheresh (even if he is a child), who is not proper to come [to be obligated] later. (We explained this like PNEI MOSHE.)
