TITHING FROM TEMED WINE (Yerushalmi Ma'asros Perek 5 Halachah 3 Daf 24b)

(a)

(Mishnah): One who makes Temed wine by pouring a measured amount of water (on un-tithed grape sediment) and then found the same measure as he had added, it is exempt (as it's water rather than wine) R. Yehuda obligates it.

(b)

If he found more than that measure (meaning that the water absorbed from the sediment), he separates Ma'asros for it from elsewhere according to the proportion (of wine in the water).

(c)

Ant holes that remained overnight next to a pile of grain that was obligated in Ma'asros - the grain inside them is obligated, since they certainly dragged it all night from that pile.

Baal-Bechi garlic, onions from Richpa, Kilki beans and Egyptian lentils (are exempt from Ma'asros).

(R. Yosi): Even Kartanis lentils are exempt from Ma'asros and may be bought from anyone in Sheviis. (All of these species come from Chutz La'Aretz and are therefore exempt from Ma'asros and Sheviis. Another explanation is that they all come from Hekfer.)

Seed of the wild Luf, of leek, of onions, of turnip and radishes and other garden seeds that are not eaten are exempt from Ma'asros and may be bought from anyone in Sheviis; and even though the seed is Terumah, the plant (that grows from it is not Terumah and) may be eaten.

(Mishnah in Maseches Chulin): Temed - before it ferments, it may not be acquired with Maaser money and it can disqualify a Mikveh. After it ferments, it may be acquired with Maaser money and it cannot disqualify a Mikveh.

That Mishnah is the opinion of R. Yehuda in our Mishnah - as it taught, "One who makes Temed wine by pouring a measured amount of water and then found the same measure as he had added, it is exempt (from tithing). R. Yehuda obligates it.''

(R. Yosi): (Disagreeing with the statement that the Mishnah in Chulin is the opinion of R. Yehuda) All agree (to the Mishnah in Chulin), as even salt water may be acquired with Ma'aser Sheni money (since it can be used as a dip). (So too for fermented Temed, even if it's not considered wine, it is can be acquired with Maaser money since it can be used as a dip).

(The Mishnah taught that if he found more than that measure (meaning that the water absorbed from the sediment), he separates Ma'asros for it from elsewhere according to the proportion (of wine in the water). What must he separate? Ma'asros, but not Terumah, as the Mishnah taught earlier that when a person separates Terumah, he has in mind to include the unthreshed stalks, the grain at edges of the pile and the grain mixed with the straw. (Similarly, when a person separates Terumah from wine, he has in mind the sediment.)
