PEOPLE WHO MAY RECEIVE DEMAI (Yerushalmi Perek 3 Halachah 1 Daf 11a)

(Mishnah): One may feed Demai to the poor and to passing guests. (This often refers to the king's soldiers who travel around and must be supported by the local populace.)

Rabban Gamliel would feed Demai to his workers (as they were poor).

Charity collectors - Beis Shammai say - give the tithed produce to those that do not tithe; and untithed produce to those that tithe; so that everyone ultimately eats tithed produce.

(Chachamim): We collect and distribute to all and whoever wants to tithe, let him tithe.

Baraisa: Once, R. Yehoshua followed R. Yochanan ben Zakkai to Berur Chayil and the local townspeople brought them fruits from the field.

(R. Yehoshua to the people): Once we have already slept here, we are obligated to tithe; before that, we are exempt.

(R. Yosi): (Disagreeing with R. Yona) The Mishnah is referring to poor Amei HaAretz. If you would say that it refers to poor Chaverim, you have closed the door in front of the Amei HaAretz.

Question: How does R. Yosi explain the case of the passing guests?

Answer: Like the Baraisa - the pasuk states (Vayikra 25:6), "(And [the produce of] the Shabbos of the land {Shemittah) shall be yours to eat for you, for your male and female slaves, and for your hired worker and resident) who live with you" - this includes the passing guest (meaning that you may feed those workers Shemittah produce, even though it is as if you are paying off a debt with the produce).

(R. Elazar): This refers to gentile passing guests.

Question: According to R. Yona who said that the Mishnah refers to poor Chaverim, it is fine; but according to R. Yosi who said that they are poor Amei HaAretz, even if you inform them, what would it help?

Support (Baraisa): With Sheviis or Maaser Sheni money, a person may not pay off a debt, nor provide a meal of mere friendship, nor pay back (a favor), nor pledge from them charity in the Shul; but one may use them to pay for any matter of kindness, and he must inform them that the produce is from Sheviis or Maaser Sheni.
