TEMURAH 22 (Tisha b'Av) - Dedicated by Rabbi Dr. Eli Turkel of Ra'anana, Israel, in memory of his father, Reb Yisrael Shimon ben Shlomo ha'Levi Turkel. Isi Turkel, as he was known, loved Torah and worked to support it literally with his last ounce of strength. He passed away on 10 Av 5740.

1)

(a)Why did the Tana present ...

1. ... the five Chata'os ha'Meisos in two groups (V'lad Chatas, T'muras Chatas and Chatas she'Meisah Ba'alehah in one group, and Chatas she'Ibrah Shenasah and Chatas she'Avdah ve'Nimtza'as Ba'alas-Mum in the other)?

2. ... the entire Mishnah both here and in Me'ilah?

2)

(a)What does Resh Lakish say about a Chatas whose year passed?

(b)What is the problem with Resh Lakish's ruling?

(c)We initially answer that Im mi'she'Kipru ha'Ba'alim Tamus refers exclusively to she'Avdah ... , but not to she'Ibrah Shenasah. Why is this answer inadequate?

(d)What Kashya does this leaves us with from the Seifa ve'Im ad she'Lo Kipru ha'Ba'alim, Tir'eh ad she'Tista'ev ... . What is the problem with that?

3)

(a)Rabah tries to solve the problem by establishing Ba'alas Mum as a temporary blemish. How will that answer the Kashya? What is to be gained by sending it in the field to obtain another Mum?

(b)Rava raises two objections to Rabah's explanation however. Firstly, he asks, the Tana ought then to have said 'Yishmor' (he should wait). What should he wait for?

(c)What is Rava's second objection?

(d)To accommodate Resh Lakish therefore, Rava amends the Mishnah to read 'Ibrah Shenasah ve'Avdah, O Avdah ve'Nimtza'as Ba'alas-Mum'. How does this now comply with Resh Lakish?

4)

(a)Why does the Tana find it necessary to teach us both cases of Avdah? What would we have thought had he only inserted the Din of Avdah and ...

1. ... Ibrah Shenasah?

2. ... Nimtza'as Ba'al-Mum?

(b)What does Rava say about a Chatas that got lost during the night?

(c)How do we reconcile this with his previous ruling (that Avudah of Ibrah Shenasah and of Nimtza'as Ba'alas-Mum of a Chatas seals its fate for Misah)?

5)

(a)We query Rava however, from the Mishnah in Yoma, which rules that if the Sa'ir la'Azazel dies, they bring another pair of goats, on which they draw lots to determine which one goes to Azazel. What happens to the second goat?

(b)Rebbi Yochanan explains that they bring the second goat of the second pair for the Sa'ir la'Hashem, rather than of the first pair. Why is that?

(c)What can we extrapolate from the Tana, who says that the reason that the latter goat does not die is because 'Ein Chatas Tzibur Meisah'?

(d)What problem does this create for Rava, who requires two disadvantages for the Chatas to die?

6)

(a)To solve the problem, what distinction do we draw between Avudin and Dechuyin? Why do Avudin alone not die, whereas Dechuyin alone, do?

(b)But does Resh Lakish not require Avudin together with Ibrah Shenasah (which is Dechuyin)?

22b----------------------------------------22b

7)

(a)We cited Rava, who holds Avudah de'Laylah Lo Sh'mah Avudah. We initially think that he cannot say this according to the Rabbanan. Why not? What do the Rabbanan say about Avudah de'Yom be'Sha'as Hafrashah (at the time when the owner designated the replacement)?

(b)So how do we initially establish Rava?

(c)Alternatively, we establish him even like the Rabbanan. How is this possible?

(d)What does this mean, bearing in mind that there is no Kaparah at night-time?

8)

(a)What does Abaye say about Genuvah or Gezulah be'Sha'as Kaparah?

(b)Rebbi Oshaya defines Avudah as a Chatas that is mixed up in the flock and unidentifiable. What is the minimum number of animals that needs to be in the flock?

(c)How does Rebbi Yochanan define Avudah?

9)

(a)We ask whether, according to Rebbi Yochanan, this incorporates outside. What does outside mean?

(b)Why might this not be considered Avudah, even though behind the door is?

(c)Why, on the other hand, might outside be even worse than behind the door?

(d)Rav Papa takes for granted that if the Chatas is Avudah from the owner but not from the shepherd, and certainly vice-versa, it is not considered Avudah. What is he not so sure about?

(e)What is the outcome of both She'eilos?

10)

(a)What does Rav Papa mean when he asks 'Avudah be'Kos Mahu'? What is the case?

(b)Why do we initially think that the She'eilah cannot go according to Rebbi?

(c)On the other hand, according to the Rabbanan, seeing as the Kaparah has not yet taken place, why does Rav Papa think that the Chatas may have to die?

11)

(a)Alternatively, we establish the She'eilah even according to Rebbi, but in a case where the Kohen received the blood of the one Chatas in two bowls, and one of them got lost and is only found after the first one has been sprinkled. What exactly are the two sides to the She'eilah (see Shitah Mekubetzes 25)?

(b)Why is it not feasible to learn the She'eilah with regard to whether the Korban is Kasher or not?

(c)The She'eilah does not go according to the opinion in Yoma that one Kos renders the other Kosos Dachuy (rejected). What is the case there?

(d)What happened there to the blood in the other three Kosos?

12)

(a)The She'eilah therefore goes according to the opinion that holds that one Kos renders the other Kosos Shirayim, in which case they are poured on to the Y'sod. Why does Rav Papa then thinks that the Din in the current case might be different?

(b)What is the outcome of the She'eilah?

13)

(a)What does our Mishnah rule, in a case where after its replacement has already been brought on the Mizbe'ach ...

1. ... the Chatas that got lost is found?

2. ... the lost money that one originally designated for one's Chatas is found?

(b)And what does the Tana say about someone who loses the money that he designated for his Chatas, and finds it before he manages to purchase a Chatas with the replacement money? What happens to the money that is leftover?

(c)What would he do with the lost money if it is found only after he has already purchased his Chatas?

(d)And what will do if he lost the money that he designated for his Chatas and found it again before he has managed to bring the replacement Chatas on the Mizbe'ach, assuming that the Chatas is found to be ...

1. ... a Tam?

2. ... a Ba'al-Mum?

(e)Who is the author of the current rulings?

14)

(a)What does the Tana rule in a case where both the Chatas which he lost and found after designating a replacement, and the replacement are found to be ...

1. ... Ba'alei-Mumin?

2. ... Temimin, according to Rebbi?

3. ... Temimin, according to the Chachamim?

(b)Under which circumstances will they hold ...

1. ... Meisah by a Chatas that got lost?

2. ... Holchin le'Yam ha'Melach by the money for a Chatas that got lost?

(c)What does the Mishnah say about a Chatas that one designates and then finds to be a Ba'al-Mum?

(d)What does Rebbi Elazar b'Rebbi Shimon say in a case where the replacement Chatas has been Shechted before the first one (that was lost and found) has been Shechted to be eaten?

15)

(a)Who is the author of ...

1. ... the opening case of the Mishnah, which rules that the lost Chatas is Meisah, provided the replacement Chatas has been brought?

2. ... the subsequent case where the designated money that was lost is found before a Chatas has been purchased with the replacement money, implying that ... (as we explained in our Mishnah)?

(b)What is the problem with this?

(c)How do we indeed explain it in light of the Seifa?

16)

(a)In fact, we could establish the Seifa like the Rabbanan too, according to Rav Huna Amar Rav. Why is that? In which case, according to Rav Huna, will the Rabbanan concede that even by Avudah be'Sha'as Hafrashah, there is a Din of Meisah?

(b)What will be the Din if it is the Avudah that he brought? What will then happen to the replacement Chatas?

(c)And it is according to Rebbi Aba Amar Rav that we need to establish the Mishnah according to two Tana'im. Why is that? According to Rebbi Aba Amar Rav, in which case do Rebbi and the Rabbanan argue?

(d)In which case do the Rabbanan nevertheless concede that Misah applies in a case of Avudah be'Sha'as Hafrashah?

(e)Then why did we not establish the latter case like this, even according to the Rabbanan?
