BUILDING A SUKAH ON A WAGON, A BOAT OR AN ANIMAL (Yerushalmi Halachah 4 Daf 9a)

משנה העושה סוכתו בראש העגלה או בראש הספינה כשירה ועולין לה ביום טוב

(a)

(Mishnah): If a person builds a Sukah on a wagon or on the mast of a boat, it is valid and he may climb into it on Yom Tov.

בראש האילן או על גבי הגמל כשירה ואין עולין לה ביום טוב

If he builds it in a tree or on a camel, it is valid but he may not climb into it on Yom Tov.

שתים בידי אדם ואחת באילן או שתים באילן ואחת בידי אדם כשירה ואין עולין לה בי"ט

If two walls are made by man and one is made in the tree; or two are made in the tree and one is made by man, it is valid but he may not climb into it on Yom Tov.

שלש בידי אדם ואחד באילן כשירה ועולין לה ביום טוב

If three walls are made by man and one is made in the tree, it is valid and he may climb into it on Yom Tov.

זה הכלל כל שינטל האילן והיא יכולת לעמוד בפני עצמה כשירה ועולין לה ביום טוב

The rule is - any case that if he removes the tree, the Sukah will remain standing, it is valid and he may climb into it on Yom Tov.

(Gemara): What is the Mishnah's case of building a Sukah on top of a boat?

אם בנתונה בארץ דברי הכל מותר

1.

If the boat is on dry land, all agree that it is valid.

אם במפרשת מחלוקת ר' אלעזר בן עזריה ור' עקיבה

If the boat is at sea, it is a dispute between R. Elazar ben Azaria and R. Akiva. (R"EBA says it is invalid since it cannot withstand a regular sea wind, since the mast is very high and there are no mountains to shield it.)

אלא כן אנן קיימין בנתונה באלמין

Rather, the case of the Mishnah is when it is anchored.

R. Shimon ben Carsena quoting R. Acha: R. Meir, R. Yosa and R. Elazar Ben Azariyah have the same opinion -

ר' מאיר דלחיים דתנינן מטמא משם גולל ר' מאיר מטהר

R. Meir in the case of a Lechi (a vertical plate that signifies the entrance of a Mavoi, as detailed in Maseches Eiruvin), that the Tana Kama says that even a living creature may be used as a Lechi and if it used as a cover for a grave, it is Tameh. R. Meir says that it is Tahor. (It is not permanent since it might escape and therefore it cannot serve as a partition and is Tahor.)

R. Yosa in the case of 'tents', that R. Yosa says that when there is a house on a boat, even though it covered both a corpse and vessels, it does not transfer the Tumah (since it not permanent).

ר' לעזר בן עזריה דתני מעשה בר' אלעזר בן עזריה ור' עקיבה שהיו באין בספינה ועשה לו ר' עקיבה סוכה בראש הספינה ובאת הרוח והפריחתה. אמר לו ר' אלעזר בן עזריה עקיבה איה סוכתך.

R. Elazar B"A in the Beraisa - R"EBA and R. Akiva were once travelling by boat. R. Akiva built a Sukah on the mast and a wind came and uprooted it. R"EBA said to R. Akiva - Akiva, where is your Sukah?! (See earlier (d) 2., that R"EBA disqualifies such a Sukah because it is not permanent).
