12th CYCLE DEDICATION
SOTAH 26-28 - A week of study material has been dedicated by Mrs. Rita Grunberger of Queens, N.Y., in loving memory of her husband, Reb Yitzchok Yakov (Irving) ben Eliyahu Grunberger. Irving Grunberger helped many people quietly in an unassuming manner and is dearly missed by all who knew him. His Yahrzeit is 10 Sivan.

ONE WHO WAS RAPED (Yerushalmi Perek 4 Halachah 4 Daf 20a)

[דף כ עמוד א] מתני' אשת כהן שותה ומותרת לבעלה

(a)

(Mishnah): A Kohen's wife drinks, and is permitted to her husband;

אשת סריס שותה

(b)

The wife of a Seris (one who does not develop like a normal male) may drink.

על ידי כל העריות כולן מקנין חוץ מן הקטן וממי שאינו איש:

A husband can warn his wife not to be secluded with any Ervah (forbidden relationship), except for a minor (less than nine years old - his Bi'ah is not considered Bi'ah) or one who is not [and will never become] an Ish.

גמ' דלכן מה אנן אמרין שתת ולא בדקו אותה המים טהורה היא

(Gemara) Question: If not [that our Mishnah taught that a Kohen's wife drinks, and is permitted to her husband], what would we say? She drank, and the water did not test (kill) her. Surely she is Tehorah!

(אני אומר הזכות תולה לה. ניחא כמאן דאמר הזכות תולה ואינה ניכרת. ברם כמאן דמר הזכות תולה וניכרת - ספר ניר מוחקו מכאן וגורסו לקמן) אמר רבי יצחק (כן אנן קיימין כששתת ולא היו המים בודקין אותה - ספר ניר מוחקו) שלא תאמר הואיל ואין המים בודקין באנוסה אלא במפותה וזו אנוסה היא. (מה אנוסה) [צ"ל ואנוסה - שערי תורת ארץ ישראל] שבכהונה כרצון שבישראל

Answer (R. Yitzchak): You should not say that since the water does not test one who was raped, only one who was enticed (consented), and [perhaps] this woman was raped, and rape for Kehunah is like willing [adultery] for Yisrael;

לפום כן צריך מימר מותרת לביתה.

Therefore, [our Mishnah] needs to say that she is permitted to her husband.

Note: There is an implied question. She drinks in order to clarify her status. If she lives, surely she is permitted!

[צ"ל אני אומר הזכות תולה לה - ספר ניר]

Answer: I would say that merit suspends [her death] for her. (Even though a Yisrael need not be concerned, perhaps a Kohen must wait the three years that merit can suspend.)

Note: Even though she drinks primarily due to concern for willing adultery, through Gilgul, she is tested also for rape (SEFER NIR). Why should the water kill her? She is not liable for rape! Perhaps it is because she feigns to be permitted, and seeks to make her husband transgress continually and profane all his future seed from her. Also, she willingly entered seclusion with the man about whom she was warned. (PF) However, OHR SOMAYACH (Hilchos Isurei Bi'ah 3:2, Hilchos Ishus 10:1) says that the water does not test her for Ones, for this is not "u'Ma'alah Vo Ma'al."

Question: This is like the opinion that merit suspends, and it is not recognized [that the water will kill her]. However, according to the opinion that merit suspends, and it is recognized [how can we answer? We explained this like SEFER NIR.]

ומניין שאונסין פוסלין בכהונה באשת איש.

(h)

Question: What is the source that rape disqualifies for Kehunah regarding a married woman?

מה אם שרצים הקלים עשה בהן את האונס כרצון. סוטה חמורה לא כל שכן.

(i)

Answer: Regarding [Tum'as] Sheratzim which is lenient, [touching] b'Ones is like willingly. Regarding a Sotah, which is stringent, all the more so!

תני ר' יעקב בר אידי קומי רבי יונתן [במדבר ה כ] ואת כי שטית תחת אישך וכי נטמאת פרט לאונסין.

(R. Yakov bar Idi, in front of R. Yonason): "V'At Ki Satis Tachas Ishech v'Chi Nitmeis" excludes rape.

מה את שמע מינה.

Question: How do you learn from this?

אמר ליה מה תחת אישך לרצון אף כאן לרצון.

Answer (R. Yakov bar Idi): Just like "Tachas Ishech" is willingly, also this ("v'Chi Nitmeis") is willingly. (OHR SOMAYACH - this is even for an Eshes Kohen.)

[שם יג] והיא לא נתפשה. הא נתפשה מותרת.

(m)

"V'Hi Lo Nispasah" implies that if she was forced, she is permitted;

ויש לך תפוסה בישראל והיא אסורה ואי זו זו זו שתחילתה ברצון וסופה באונס

There is a case of one who was forced in (i.e. an Eshes) Yisrael, and she is forbidden. Which is this? It is one who was initially willing, and at the end she was forced;

ויש לך שאינה תפוסה בישראל והיא מותרת ואי זו זו זו שתחילת' באונס וסופה ברצון.

2.

There is a case of one who was not forced in Yisrael, and she is permitted. Which is this? It is one who was initially forced, and at the end she was willing.

כהדא איתתא אתת לגביה רבי יוחנן אמרה ליה נאנסתי. אמר לה ולא ערב לך בסוף

This is like a woman who came in front of R. Yochanan, and said 'I was raped.' He said to her, was it not pleasant for you at the end?

אמרה ליה ואם יטבול אדם אצבעו בדבש ויתננה לתוך פיו ביום הכיפורים שמא אינו רע לו ובסוף אינו ערב לו. וקיבלה.

The woman: If someone would dip your finger in honey and put it in your mouth on Yom Kipur, perhaps it is not bad (displeasing) for you, and it is pleasant for you at the end? He accepted her claim.

ואת כי שטית תחת אישך וכי נטמאת (פרט) [לרבות] לאשת סריס ויתן איש בך את שכבתו (לרבות את הסריס. חוץ מן) [צ"ל למעט את הסריס ואת - קרבן העדה] הקטן וממי שאינו איש:

"V'At Ki Satis Tachas Ishech v'Chi Nitmeis" includes the wife of a Seris. "Va'Yiten Ish Becha Es Shechavto" excludes a Seris and a minor (less than nine) and one who is not a man (human - PNEI MOSHE).
