MINCHAS SOTAH (Yerushalmi Perek 2 Halachah 1 Daf 8b)

מתני' היה מביא את מנחתה בכפיפה מצרית ונותנה על ידה כדי לייגע'

(a)

(Mishnah): Her husband would bring her Minchah (flour-offering) in a Mitzri basket (made of shoots that grow around a palm tree). He (the Kohen) puts it in her hands, to weary her [to encourage her to admit her guilt].

כל המנחות תחילתן וסופן בכלי שרת וזו תחילת' בכפיפ' מצרית וסופה בכלי שרת

(b)

All other Menachos, their beginning and end is in a Kli Shares (a Kodesh Kli used for the Avodah). This one starts in a Mitzri basket and ends in a Kli Shares;

כל המנחות טעונות שמן ולבונה וזו אינה טעונה לא שמן ולא לבונה

(c)

All other Menachos require oil and frankincense. This one does not require oil or frankincense;

כל המנחות באות מן החיטים וזו אינה באה אלא מן השעורים

(d)

All other Menachos are from wheat. This one is from barley;

מנחת העומר אף על פי שהיא באה מן השעורים היא באה גרש וזו היתה באה קמח רבן גמליאל אומר כשם שמעשיה מעשה בהמה כך קרבנ' מאכל בהמה:

R. Gamliel says, just like her actions were like those of an animal, also her offering is animal food.

גמ' כתיב [במדבר ה יח] וביד הכהן יהיו מי המרים המאררים [דף ט עמוד א] מעתה כדי (ליגעה) [צ"ל ליגעו - קרבן העדה] .

(Gemara) Question: It is written "uv'Yad ha'Kohen Yihyu Mei ha'Marim ha'Me'ararim" - is this in order to weary [the Kohen?! Surely it is not. If so, we need not say that the Minchah is in her hands to weary her!]

אלא כדי להטיל אימה עליה.

Answer: Rather, it is in order to impose fear on her.

מנחתה מלמד שהיא קדשה לשמה.

[Our Mishnah calls it] "Minchasah" (it is attributed to her, even though her husband pays for it) to teach that it is made Kodesh for her sake.

(כשם שהיא קדשה לשמה כך היא קדשה לשמו - שערי תורת ארץ ישראל מוחקו מכאן וגורסו לקמן) ותני ר' חייה (ופליג - רידב"ז מוחקו) לקרב כליל אינה יכולה מפני שותפותה של אשה. לאכל אינה יכולה מפני שותפותו של איש. (אמר ליה) [צ"ל אלא - פני משה] הקומץ יקרב לעצמו והשיריים קריבין לעצמן.

Question (R. Chiyah's Beraisa): [If her husband is a Kohen], it cannot be offered Kalil (totally burned on the Mizbe'ach) due to her partnership in it (only a Kohen's Minchah is Kalil. The Shirayim) cannot be eaten due to his partnership in it. Rather, the Kometz is offered by itself, and the Shirayim are offered by themselves.

[צ"ל כשם שהיא קדשה לשמה כך היא קדשה לשמו - גליוני הש"ס, שערי תורת ארץ ישראל]

Answer: Just like it is made Kodesh for her sake, it is made Kodesh for his sake. (We explained this like GILYONEI HA'SHAS, SHA'AREI TORAS ERETZ YISRAEL.)

ואת אמר מנחתה.

Question: [Since they are like partners in it,] why do you say (call it) Minchasah?

ואלא מה דאישתעי קריא אישתעי' מתניתא. [במדבר ה טו] והביא את קרבנה עליה.

Answer: Like the Torah speaks, so our Mishnah speaks - "v'Hevi Es Korbanah Aleha" (the Torah calls it hers).

בעלה מהו שיפריש עליה חוץ מדעתה.

Question: May her husband separate it for her without her Da'as (knowledge, or consent)?

אחר מהו שיפריש עליה חוץ מדעתה.

Question: May someone else separate it for her without her Da'as?

ייבא כיי דרבי יוחנן ארבעה מחוסרי כפרה מפרישין עליהן שלא מדעתן. ואילו הן הזב והזבה והמצורע והיולדת

Answer #1: This is like R. Yochanan said, that Mechusarei Kaparah (they need a Korban to complete their Taharah), we may separate [their Korban] without their Da'as. These are [the Mechusarei Kaparah] - a Zav, Zavah, Metzora and Yoledes.

שכן אדם מפריש על בנו הקטן והוא נתון בעריסה.

Source: One may separate [the Korban] for his minor son (a Zav), even if he is in a crib (and has no Da'as. Since his Da'as is not needed, anyone may separate the Korban.)

ניחא זב וזבה ומצורע. (ויולדת. ויש קטנה יולדת )[צ"ל יולדת מכיון שהשיאה כבר יצאה מרשות אביה - שערי תורת ארץ ישראל]

(p)

Question: Granted, [this is a source for] a Zav, Zavah, and Metzora (they can apply even to a baby. However,) a Yoledes - once he married her off, she already left her father's Reshus!

[צ"ל שכן אדם מפריש על אשתו קטנה - שערי תורת ארץ ישראל]

(q)

Answer: Rather, a man separates for his minor wife.

[צ"ל ויש קטנה יולדת - שערי תורת ארץ ישראל] לא כן אמר רבי רדיפה ר' יונה בשם רב הונה עיברה וילדה עד שלא הביאה שתי שערות היא ובנה מתים. משהביאה שתי שערות היא [צ"ל ובנה חיים עיברה עד שלא הביאה שתי שערות וילדה משהביאה שתי שערות היא - קרבן העדה] חיה ובנה מת.

Question: Can a minor be a Yoledes? Did not R. Redifah citing R. Yonah citing Rav Huna teach that if she became pregnant and gave birth before bringing two hairs, she and her baby will die. If [both occurred] after bringing two hairs, she and her baby will live. If she became pregnant before bringing two hairs, and gave birth after bringing two hairs, she will live and her baby will die!

מאי כדון. (שכן אדם מפריש על בתו קטנה. מכיון שהביאה לו כבר יצאה מרשות אביה - שערי תורת ארץ ישראל מוחקו)

Question: How can we resolve this? (We explained this like SHA'AREI TORAS ERETZ YISRAEL.)

אלא שכן אדם מפריש על אשתו חרשת.

Answer: Rather, a man separates for his wife, a Chereshes (who has no Da'as).

וכאן סוטה קטנה אין את יכול. דמר ר' זעירא רבי יסא בשם ר' יוחנן קטנה שזינתה אין לה רצון להיאסר על בעלה.

Question: (You cannot learn from there, for you cannot find a Sotah without Da'as!) Here, there cannot be a minor Sotah, for R. Ze'ira citing R. Yosa citing R. Yochanan said that a minor who was Mezanah does not have Ratzon to become forbidden to her husband. (It is considered Ones.)

וחרשת אין את יכול דכתיב [שם כב] ואמרה האשה אמן אמן.

And you cannot [say that there is] a Chereshes [Sotah - even if she was healthy when he warned her and she was secluded, and afterwards she became deaf - based on OHR SOMAYACH Hilchos Isurei Bi'ah Sof 3:2], for it says "v'Amrah ha'Ishah Amen Amen"!

אמר ר' אבין מכיון דכתיב [דברים יד כו] ושמחת אתה וביתך והוא מעוכב [דף ט עמוד ב] מלשמוח עמה מפריש עליה חוץ מדעתה.

(v)

Answer #3 (R. Avin): Since it says "v'Samachta Atah u'Veisecha", and he cannot rejoice with her [until she drinks], he separates [Minchas Sotah] for her without her Da'as. (MEICHAL HA'MAYIM - this applies only to her husband, who has a Mitzvah to be Mesame'ach her.)

KORBANOS BROUGHT BY A HUSBAND FOR HIS WIFE (Yerushalmi Perek 2 Halachah 1 Daf 9b)

רבי אחא בשם ר' אילא אינו מפריש עליה עולת העוף אלא חטאת העוף מפני שהיא מכשרתה לאכול בזבחים

(a)

(R. Acha citing R. Ila): He cannot separate for [a Zavah or Yoledes, without her Da'as] Olas ha'Of, only Chatas ha'Of, for it permits her to eat Zevachim.

תני אינו מפריש עליה אלא דבר שהוא מתירה לה בזה.

(b)

(Beraisa #1): He separates for her [without her Da'as] only something that permits her to this (Kodshim).

אמר רבי יוסי אין לך אלא זה.

(c)

R. Yosi: You have only this (Mechusar Kipurim).

תני [צ"ל אידך - פני משה] מה זה מעכבה מלאכול בזבחים (מעכבה היא מלאכול בזבחים. ומכיון) [צ"ל אף הכא מעוכב מלשמוח עמה מכיון - פני משה] שהוא מעוכב מלשמוח עמה. כמו שהוא מעכבת מלאכול בזבחים.

(d)

(Beraisa #2): Just like this (Korban Zavah or Yoledes) is Me'akev her from eating Zevachim, also this (Minchas Sotah) is Me'akev her from rejoicing (intimacy) with her. Since he cannot rejoice with her [until she drinks], it is as if it is Me'akev her from eating Zevachim (he can offer it without her Da'as).

תני אפילו הקפת נזירות על ראשה

(Beraisa): Even if she owes Korbanos due to Nezirus (he can offer them without her Da'as).

מעכבת היא מלוכל בזבחים.

(f)

Question: Are they Me'akev her from eating Zevachim?!

מכיון שהיא מנוולת והוא מעוכב מלשמוח עמה כמו שהוא מעכב' מלוכל בזבחים.

(g)

Answer: Since she is repulsive (RASHI Nazir 28a - she cannot drink wine) and he cannot rejoice with her, it is as if it is Me'akev her from eating Zevachim.

תני ר' יודה אומר מביא אדם על ידי אשתו כל קרבן שהיא חייבת אפילו אכלה חלב ואפילו חיללה שבת.

(h)

(Beraisa - R. Yehudah): One brings for his wife very Korban that she is obligated, even if she ate Chelev or was Mechalel Shabbos.

וכן היה ר' יודה אומר פטר' אינו חייב בה (שכן הוא כותב לה) [צ"ל שכך היא כותבת לו בתוך השובר שכותבת לו על קבלת כתובתה - קרבן העדה] ואחרן די אתיין לי עלך מן קדמת דנא.

And so R. Yehudah used to say - if he divorced her, he is not obligated, for so she writes to him in the receipt for receiving her Kesuvah '[you are exempt from] all responsibility [for Korbanos] that I had on you before this.'

והתני סדר מנחות כך היא מביאין מתוך ביתו בכלי כסף ובכלי זהב

(j)

Question (Beraisa): The order of [offering] Menachos - one brings from his house in a Kli of silver or gold. (Our Mishnah said that all other Menachos, their beginning is in a Kli Shares!)

וראוייה (ליקרב בכלי) [צ"ל לכלי - קרבן העדה] שרת.

(k)

Answer: [Our Mishnah means that other Menachos begin in something] proper to be a Kli Shares. (Minchas Sotah starts in a Mitzri basket, which is not proper for a Kli Shares.)

3)

KORBANOS SIMILAR TO MINCHAS SOTAH (Yerushalmi Perek 2 Halachah 1 Daf 9b)

תני ר' שמעון בן יוחי מפני מה אמרו כל החטאות והאשמות שבתורה אין טעונין נסכים שלא יהא קרבנו של חוטא נראה מהודר.

(a)

(Beraisa - R. Shimon): Why did they say that all Chata'os and Ashamos in the Torah do not require Nesachim? It is lest a sinner's Korban appear glorious.

התיבון הרי חטאתו ואשמו של מצורע.

(b)

Question: Chatas and Asham of a Metzora [require Nesachim]!

אין תימר שאינו חוטא

1.

Suggestion: Perhaps [a Metzora] did not sin.

האמר רבי יצחק [ויקרא יד ב] זאת תהיה תורת המצורע. זאת תורת המוציא שם רע.

Rejection: R. Yitzchak taught, "Zos Tihyeh Toras ha'Metzora" - this is the law of Motzi Shem Ra (one who speaks Leshon ha'Ra)!

Note: We said above that even a minor without Da'as can be a Metzora! Perhaps since normally Tzara'as comes on an adult who sinned, even for a minor, there are no Nechasim. Alternatively, Tzara'as comes on a minor due to the sins of his father, who brings the Korban. (PF)

אמר ליה מכיון שנתייסר וכתיב [דברים כה ג] ונקלה אחיך לעיניך כמי שאינו חוטא.

(c)

Answer: Since he was afflicted, and it says "v'Nikleh Achicha l'Einecha" (after he suffered, he is called your brother), it is as if he is not a sinner. (The Korban merely permits him to eat Kodshim.)

רבי יוחנן בשם ר' ישמעאל [ויקרא ב יד] מנחת מנחת מה מנחת שנאמר להלן שעורין אף כאן שעורין.

(d)

(R. Yochanan citing R. Yishmael): [There is a Gezeirah Shavah] "Minchas-Minchas" - just like Minchas said there (Sotah) is of barley, also here (ha'Omer) is of barley.

אמר רבי לעזר נאמר כאן [ויקרא ב יד] אביב ונאמר במצרים [שמות ט לא] אביב. מה אביב האמור במצרים שעורין אף כאן שעורין.

(e)

(R. Elazar): It says here (ha'Omer) "Aviv", and it says in Mitzrayim [the hail did not destroy the barley, because it is] "Aviv". Just like Aviv said in Mitzrayim is barley, also here (ha'Omer) is of barley.

ר"ע אומר נאמר לציבור הבא ביכורים בפסח והבא ביכורים בעצרת. (אם מצינו שממין שהיחיד מביא חובתו ממנו הציבור מביא ביכורים בעצרת מאי זה מין היחיד מביא חובתו מן השעורין. אף הציבור לא יביא אלא מן השעורין) [צ"ל מה מצינו שהיחיד מביא חובתו מן החטין וחובתו מן השעורין אף ציבור מביא חובתו מן החטין יביאו מן השעורין - קרבן העדה]

(f)

(R. Akiva): It says that the Tzibur must bring Bikurim (first produce) on Pesach, and bring Bikurim on Shavu'os. Just like we find that an individual brings his obligation from wheat (Minchas Chotei) and his obligation from barley (Minchas Sotah), also the Tzibur brings its obligation from wheat (Shtei ha'Lechem, so its other obligation, the Omer), it brings from barley.

[דף י עמוד א] [צ"ל דבר אחר - קרבן העדה] אם תאמר מן (החוטין) [החיטין] אין שתי הלחם ביכורין.

Another [source] - if you will say that [the Omer] is from wheat, Shtei ha'Lechem is not Bikurim (the Tzibur already brought from wheat).

תמן אמר רבי יונה חילקא לשנים. טרגיס לשלשה. טיסני לארבעה.

(R. Yonah): Chilka is wheat kernels [cut into] two. Targis is [cut into] three, Tisni is four.

Question (R. Yosi bei R. Bun): Past this (more than four), is this considered flour (and it is Kosher for Minchas Sotah), and one need not separate fine flour from it?
