CALLING OTHERS TO COME TO SAVE (Yerushalmi Halachah 4 Daf 80b)

מתני' מצילין סל מלא ככרות [דף צח עמוד ב (עוז והדר)] אף על פי שיש בו מאה סעודות ועיגול של דבילה וחבית של יין

(a)

(Mishnah): We may save a whole basket of loaves [from a fire], even if it has enough for 100 meals, or a [big] ring of figs or barrel of wine;

ואומר לאחרים בואו והצילו לכם אם היו פקחין עושין עמו חשבון לאחר שבת

(b)

One may tell others 'come save for yourselves.' If they are clever, after Shabbos they will make a calculation with him.

ולאיכן מצילין אותן

Question: To where may we save them?

לחצר המעורבת

Answer #1: We may save to a Chatzer that has an Eiruv;

בן בתירה אומר אף לשאינה מעורבת:

Answer #2 (Ben Beseira): We may save even to a Chatzer without an Eiruv.

גמ' מתני' דרבי יוסי דאמר לעולם מצילין מזון שלש סעודות.

(f)

(Gemara): Our Mishnah [permits saving a big basket, ring or barrel. It] is like R. Yosi, who says that always one may save food for three meals.

מכיוון שכולה גוף אחד כמי שכולה סעודה אחת:

Rebuttal: (It is even like Rabanan.) Since it is all one body, it is as if it is all one meal.

ואומר לאחרים בואו והצילו לכם.

One may tell others 'come save for yourselves.'

שכן (דרכן) [צ''ל דרכו - רשב''א קכ:א] להזמין אורחים בשבת:

(i)

This is because he is wont to invite guests on Shabbos [it is as if they save for themselves].

אם היו פקחין עושין עמו חשבון לאחר השבת.

(j)

If they are clever, after Shabbos they will make a calculation with him.

תמן תנינן מניח טליתו אצלו ועושה עמו חשבון לאחר שבת.

(k)

(Mishnah 23:1): [One may borrow wine, oil or loaves on Shabbos. If the lender does not trust him,] he leaves his Talis with him, and he makes a calculation with him after Shabbos.

תמן את אמר משכוני' גביה. הכא מה אית לך.

(l)

Question: There you say [properly that he makes a calculation with him, for] his security is with [the lender]. Here, what do you have?! (The owner himself said "save for yourselves'', i.e. it is Hefker!)

אמר רבי אבא מרי לכך שנינו נקרא פיקח:

Answer (R. Aba): Therefore, we learned that he is called clever. (If the one who saved fears Shamayim, and realizes that the owner did not make it Hefker with a full heart, just he said so in order that others will save, he pays for what he took - PNEI MEIR.)

Note: If the owner was forbidden to save, it is truly Hefker! It seems that since he has a possibility to save more, through inviting guests, it is not truly Hefker.

SAVING KELIM FROM A FIRE (Yerushalmi Perek 16 Halachah 5 Daf 81a)

[דף פא עמוד א] מתני' ולשם הוא מוציא את כל כלי תשמישו

(a)

(Mishnah): Also, to there (a Chatzer with an Eiruv, and according to Ben Beseira, even without an Eiruv) he may take out all Kelim that he uses [for eating and needs for Shabbos];

ולובש כל מה שהוא יכול ללבוש ועוטף כל שהוא יכול לעטוף

(b)

He may wear and cover himself with as much as he can cover himself;

ר' יוסי אומר שמונה עשר כלים.

(c)

R. Yosi says, he may not wear more than 18 garments;

וחוזר ולובש ומוציא ואומר לאחרים בואו והצילו עמי:

(d)

He may remove the clothes [in a safe place] and return to wear other clothes [standing to be burned], and he may tell others 'come save with me.'

גמ' רבי יוסי אומר שמנה עשר כלים. ואלו הן מקטורן נוקלי ופונדא ופיליון ומעפורת וקולבין של פשתן וחלוק של צמר ושתי אמפליות. שני סבריקין ושני אבריקין. שני מנעלין וכובע שבראשו וחגור שבמתניו וסודרין שעל זרועותיו:

(Gemara): R. Yosi says, [he may not wear more than] 18 garments - a cloak, a wide garment, a hollow belt worn over one's clothes, a sheet to wrap his entire body, a hood, a linen undershirt, a wool cloak, two socks, two handkerchiefs (one for his face and hands, and one to clean his nose), two garter belts, two shoes, a hat on his head, a belt on his loins, and scarves on his arms. (They were joined, so they count like one. Alternatively, the text should say "a scarf on his neck', like the Bavli (120a) - HA'GAON RAV C. KANIEVSKY, SHLITA.)

ואומר לאחרים בואו והצילו עמי.

(f)

(Mishnah): He may tell others 'come save with me.'

שכן דרכן להשאיל כלים בשבת:

This is because he is wont to lend garments on Shabbos [it is as if they save for themselves].

HOW ONE MAY STOP A FIRE FROM SPREADING (Yerushalmi Halachah 6 Daf 81a)

מתני' ר''ש בן ננס אומר פורשין עור של גדי ע''ג שידה תיבה ומגדל שאחז בהם את האור מפני שהוא מחרך

(a)

(Mishnah - R. Shimon ben Nanas): One may spread a kid's skin over a box that caught fire, because it gets charred [but does not burn, it will save the rest of the box];

עושין מחיצה בכל הכלים בין מלאים בין ריקנים בשביל שלא תעבור הדליקה

(b)

One may make a Mechitzah with any Kli, whether it is full [of water] or empty, to prevent the fire from spreading;

ר' יוסה אוסר בכלי חרש חדשים מלאים מים שאינן יכולים לקבל בהן את האור והן מתבקעין ומכבין את הדליקה:

(c)

R. Yosi forbids new Klei Cheres full of water, for they cannot bear the fire, and they break and extinguish the fire.

גמ' כיני מתני' משיאחוז האור בהן.

(d)

(Gemara): [The Reisha of] our Mishnah discusses after [the box] caught fire [therefore one may spread a skin over it, but he may not make a Mechitzah with Kelim full of water. The Seifa permits that only for before the matter caught fire. We explained this like SEFER NIR.]

[דף צט עמוד א (עוז והדר)] רבי ירמיה רבי בא בר ממל בשם רב ספר שאחז בו האור מצד אחד נותן מים מצד השני ואם כבה כבה.

(e)

(R. Yirmeyah citing R. Aba bar Mamal citing Rav): If a Sefer caught fire from one side, one may put water on the other side. If it extinguishes, it extinguishes.

אחז בו האור משני צדדין פושטו וקורא בו ואם כבה כבה.

If it caught fire from both sides, one opens it and reads in it. If it extinguishes, it extinguishes.

טלית שאחז בו האור מצד אחד נותן מים מצד שני ואם כבה כבה. אחז בה האור מב' צדדין נוטלה ומתעטף בה ואם כבתה כבתה.

(f)

If a Talis caught fire from one side, one may put water on the other side. If it extinguishes, it extinguishes. If it caught fire from both sides, he takes it and wraps himself in it. If it extinguishes, it extinguishes.

Note: The Bavli (Zevachim 94b) says that soaking a garment is considered laundering. Tosfos (111a-b) says that this is only when there is blood or filth on the garment. One opinion in the Rema (OC 302:9) permits putting a small amount of water on a clean garment. However, Rav did not stipulate that he permits only a small amount of water, and only if the Talis is clean! The Rashbam (in Tosfos 120a DH Nosen) says he does not put water on the garment [rather, near it]. The Tur (OC 334) permits putting wine or other liquids on the garment, but not water.

ר' שמואל בשם ר' זירא דר' יוסה היא.

(g)

(R. Shmuel citing R. Zeira): Our Mishnah [at the end of Perek 3, which forbids water in a Kli under a lamp to catch sparks, for this extinguishes] is like R. Yosi [in our Mishnah, who forbids causing to extinguish].

א''ר יוסה הוה סברינן מימר מה פליגין מימר ר' יוסה ורבנן בשעשה מחיצה של כלים. אבל אם עשה מחיצה של מים לא.

(h)

(R. Yosah): We wanted to say that R. Yosah and Rabanan argue about when one made a wall of Kelim [full of water around a fire], but a wall of water (e.g. snow or hail), no (all forbid).

ממה דמר ר' שמואל בשם ר' זעירא דר' יוסה היא הדא אמרה אפי' עשה מחיצה של מים היא המחלוקת:

Retraction: However, since R. Shmuel said in the name of R. Ze'ira that [our Mishnah] is R. Yosah, this teaches that they argue even about one who made a wall of water.
