WHEN WE CONSIDER A THROWN OBJECT AS IF IT RESTED (Yerushalmi Perek 11 Halachah 1 Daf 65a)

ר' יצחק בי רבי אלעזר שאל זרק מרשות היחיד לרשות הרבים ונזכר עד שהוא ברשות הרבים. על דעתיה דר' עקיבה יעשה כמי שנחה בר''ה ויהא חייב (שתים - קרבן העדה מוחקו).

Question (R. Yitzchak bei R. Elazar): If one threw from Reshus ha'Yachid to Reshus ha'Rabim [b'Shogeg], and remembered when it was in Reshus ha'Rabim [before Hanachah], it should be as if there was Hanachah, and he should be liable! (Mishnah 9:6 exempts, and does not say that R. Akiva argues.)

Answer (R. Chunah): R. Akiva obligates [due to Kelutah k'Mi she'Hunchah] only when in later landed in a second Reshus ha'Yachid.

רבי אבהו אומר בשם ר' אלעזר בשם ר' יוחנן היה עומד בר''ה וזרק למעלה מעשרה. רואין שאם תפול אם נחה בתוך ד' אמות פטור ואם לאו חייב.

(R. Acha citing R. Elazar citing R. Yochanan): If one was standing in Reshus ha'Rabim and threw above 10, we see - if it would fall, if it would land within four Amos, he is exempt. If not, he is liable [even though it went through Mekom Petur].

והתני שמואל מרה''ר לרה''ר ורה''י באמצע רואין שאם תפול נחה בתוך ד' אמות פטור ואם לאו חייב.

(d)

Shmuel taught that if one threw from Reshus ha'Rabim to Reshus ha'Rabim and Reshus ha'Yachid is in the middle, we see - if it will fall, if it will land within four Amos, he is exempt. If not, he is liable.

תמן את אמר אין (ר''ה) [צ''ל רה''י - פני מאיר] מצטרפת. והכא את אמר ר''ה מצטרפת.

Question: There you say that Reshus ha'Yachid does not join, and here you say that Reshus ha'Rabim joins! (He is liable if it went a total of four Amos in the two Reshus ha'Rabims, but we do not count the amount it went in Reshus ha'Yachid.)

Answer (R. Chunah): There (in Reshus ha'Yachid), if it would fall, the land underneath it is Reshus ha'Yachid. However, here (above Reshus ha'Rabim), if it would fall, the land underneath it is Reshus ha'Rabim.
