FOR WHICH EATING ONE BECOMES A BEN SORER U'MOREH (Yerushalmi Halachah 2 Daf 41b)

משנה מאימתי הוא חייב משיאכל טרטימר בשר וישתה חצי לוג יין באיטלקי

(a)

(Mishnah): From when is he liable? It is after he eats Tartimar (this will be explained) of meat and drinks half an Italki Log (CHOMAS YERUSHALAYIM) of wine (a Log is four Reviyos, about a half liter);

ר' יוסי אומר מנה בשר ולוג יין

R. Yosi says, he must eat a Maneh (the weight of 100 Dinarim or 9600 barley seeds, about half a kilo) of meat and drink a Log of wine.

אכל בחבורת מצוה אכל בעיבור החדש אכל מעשר שני בירושלם

[In the following cases, he is exempt -] he ate with a group doing a Mitzvah, such as the meal to signify Ibur Chodesh (when a 30th day is added to the month), or if he ate Ma'aser Sheni in Yerushalayim;

אכל נבילות וטריפות ושקצים ורמשים

He ate Neveilos, Treifos, Shekatzim u'Rmashim (insects and swarming creatures);

אכל דבר שהוא מצוה ודבר שהוא עבירה

2.

He ate something that is a Mitzvah or a transgression;

אכל כל מאכל ולא אכל בשר שתה כל משקה ולא שתה יין אינו נעשה בן סורר ומורה עד שיאכל בשר וישתה יין שנאמר זולל וסובא

If he ate any food, but did not eat meat, if he drank any beverage, but did not drink wine, he does not become a Ben Sorer u'Moreh, until he eats meat and drinks wine, for it says "Zolel v'Sovei."

ואף ע"פ שאין ראיה לדבר זכר לדבר אל תהי בסובאי יין בזוללי בשר למו:

There is not a proof [from a verse] for this, but there is a hint - "Al Tehi b'Sov'ei Yayin b'Zolelei Vasar Lamo."

גמרא א"ר יוסי טרטימר חצי ליטרא הוא אינו חייב עד שיאכלנו מהובהב.

(d)

(Gemara - R. Yosi): Tartimar is half a Litra. He is liable only if he eats it partially roasted.

אכלו חי כלב הוא אכלו מבושל בר נש הוא.

If he ate it raw, this is like a dog! (He will not get addicted to this.) If he ate it [properly] cooked, this is like a normal person. (The Torah obligates only one who eats like thieves, who are hasty to eat before it cooks fully.)

אכלו הסוקים מהו גידים הרכים מה הן

Question: If he ate cartilage, what is the law? If he ate soft sinews (in a young animal that are hard in a mature animal), what is the law?

רבי יוחנן אמר נימנין עליהן רשב"ל אמר אין נימנין עליהן.

(f)

Answer (regarding sinews): R. Yochanan says that one may be counted [on Korban Pesach] through [buying the right to eat] them (they are considered like meat). Reish Lakish says that one may not be counted through them (they are not considered like meat).

(R. Yakov bar Acha citing R. Ze'ira): R. Yochanan and Reish Lakish argued. A Mishnah there says "the following, their skins are like their meat." R. Yochanan says, this was taught only for Isur and Tum'ah, but not to be lashed [for eating them. Since they will harden, they are not considered like meat];

ר"ש בן לקיש אמר משנה תמימה שנה רבי בין לאיסור (ולטומאה) [צ"ל בין ללקות בין לטומאה - פני משה]

(Reish Lakish): Rebbi taught a uniform Mishnah, for Isur, lashes and Tum'ah.

מחלפה שיטתי' דר"ש בן לקיש תמן הוא עבד לה בשר וכא לא עבד לה בשר

Question: Reish Lakish contradicts himself! There he considers [skin] like meat, and here he does not consider [sinews] like meat!

א"ר יודה בר פזי שנייא היא תמן שהוא עור וסופו להקשות.

(i)

Answer #1 (R. Yudah bar Pazi): There is different, for it is skin, and it is destined to harden.

כל שכן מחלפה שיטתיה דרשב"ל ומה תמן שסופו להקשות הוא עבד לה בשר כאן שאין סופו להקשות כל שכן.

Objection: All the more so, Reish Lakish's opinion is difficult! There, [skin] is destined to harden [more than sinews], and he considers it like meat. Here, it is not destined to harden [so much], all the more so he should consider it like meat!

א"ר אבהו טעמא דרשב"ל אכלו את הבשר לא גידים:

Answer #2 (R. Avahu): Reish Lakish learns from "v'Achlu Es ha'Basar", and not sinews.

אכל בחבורת מצוה אכל בעיבור בחדש אכל מעשר שני בירושלם. ויסרו אותו ואיננו שומע [דף מב עמוד א] בקולם יצא זה שהוא שומע בקול אביו שבשמים.

If he ate with a group doing a Mitzvah, such as the meal to signify Ibur Chodesh, or Ma'aser Sheni in Yerushalayim [he is exempt. We learn from] "v'Yisru Oso" and "Einenu Shome'a [b'Kol Aviv uv'Kol Imo" - he does not heed] b'Kolam. This excludes [one who does a Mitzvah], who heeds his Father in Heaven.

אמר ר' יוחנן אם הזכירוך לבולי יהיה ירדן בעל גבולך.

(m)

(R. Yochanan): If empty people invite you [to eat with them, distance greatly from them;] the Yarden (the end of Eretz Yisrael) should be your border.

א"ר יוחנן לווין בריבית לחבורת מצוה ולקידוש החודש

(n)

(R. Yochanan): One may borrow with Ribis [mid'Rabanan, for a Seudah] for a group doing a Mitzvah or for Kidush ha'Chodesh.

ר' יוחנן הוה עליל לכנישתא בצפרא ומלקט פירורין ואכיל ואמר יהא חלקי עם מאן דקדש ירחא הכא רומשית:

R. Yochanan went to the Beis ha'Keneses in the morning [after Kidush ha'Chodesh was done there] and collected crumbs [left over from the Seudah] and ate them, and said "may my portion be with those who were Mekadesh the month here last night!"

אכל נבילות וטריפות שקצים ורמשים (ויסרו אותו ולא ישמע בקולם) [צ"ל איננו שומע בקולינו - קרבן העדה] יצא זה אפילו בקול אביו שבשמים אינו שומע:

If he ate Neveilos, Treifos, Shekatzim u'Rmashim [he does not become a Ben Sorer u'Moreh] - "Einenu Shome'a b'Kolinu" - this excludes this one, who does not heed even his Father in Heaven.
