TOSFOS DH HACHI GARSINAN B'CHOL HA'SEFARIM V'CHEIN GARSINAN B'SIFRI (PARSHAS BEHA'ALOSCHA) MAH TAMEI SHE'EIN SIPEK B'YADO ETC

(SUMMARY: Tosfos first explains the Machlokes Rebbi Eliezer and Rebbi Akiva there and then the Machlokes Rav Sheishes and Rav Nachman in our Sugya.)

(a)

Clarification: It is learned there in connection with the Machlokes between Rebbi Eliezer and Rebbi Akiva. Rebbi Akiva there brings a proof for his opinion 'Just as a Tamei cannot manage to do the Pesach because he is Tamei, so too, can someone who is far away not manage to bring the Pesach because he is so afar away that he cannot arrive in time to Shecht it, according to Ula, and to eat it, according to Rav Yehudah.

1.

Rav Sheishes: Rav Sheishes brings a proof since it speaks where he is unable to do it, it implies that he is not Yotzei, because he learns Derech Rechokah from Tamei in all regards.

(b)

Rav Nachman: And Rav Nachman answers that Rebbi Akiva holds 'Ein Shichtin ve'Zorkin', and that is why he learns Derech Rechokah from Tamei, since both are fit at the time of eating, but not at the time of Shechitah, and according to him also, even if one sprinkled the blood, one is not Yotzei. Whereas he (Rav Nachman), holds 'Shochtin ve'Zorkin'.

1.

Rav Nachman (cont.): In that case, one cannot learn that one is not Yotzei by Derech Rechokah like by Tamei Meis, since Tamei Meis is different, in that he is not fit at the time of eating.

(c)

Rav Sheishes: Rav Sheishes too, holds 'Shochtin', since it is not logical to say that they argue over this point. Only he holds that Rebbi Akiva learns (Derech Rechokah) from Tamei Meis even though it is not completely similar to it.

(d)

Clarification: The Ri explains that it is not from a Hekesh that they learn Derech Rechokah from Tamei but from a Mah Maztinu.

1.

Proof: Because if they learned it from a Hekesh, how can Rav Nachman answer that he holds 'Shochtin', he ought nevertheless to learn it from there due to the principle 'Ein Mashivin al ha'Hekesh'.

(e)

Question: The Ri asks that if (on the other hand) it is not a Hekesh, there are many questions that one can ask (on the Mah Matzinu).

2)

TOSFOS DH REBBI AKIVA SAVAR EIN SHOCHTIN V'ZORKIN

(SUMMARY: Tosfos queries Rav Nachman's source for saying this.)

(a)

Question: From where does Rav Nachman know this ...

(b)

Source: Bear in mind that above (on Daf 90:) the Gemara said that the one who holds 'Ein Shochtin' holds like Rebbi Yitzchak who maintains that the Teme'im were Teme'ei Meisim ... , because he Darshens "On that day" they were unable to do it, but on the following day they would have able to.

1.

Source (cont.): Whereas Rebbi Akiva in Perek ha'Yashein (in Succah, Daf 25.) does not hold like Rebbi Yitzchak?

3)

TOSFOS DH D'I BA'I LEMEBAD LO SHAVKINAN LEIH

(SUMMARY: Tosfos explains the statement in view of the fact that the Tana holds that the owner is not fit to eat it anyway.)

(a)

Question: Since this Tana holds Shochtin al Tamei Sheretz', since he says 'to exempt him from Kareis, implying that he is Patur from Kareis, but that if the blood is sprinkled, he is Yotzei. And we concluded earlier (Daf 81.) that the opinion that holds that one is Yotzei, holds 'Shochtin ve'Zorkin'.

1.

Question (cont.): In that case, the 'Tamei' mentioned in the Pasuk speaks where one is unable to eat it at nighttime. How can the Gemara then say that the Torah writes it to teach us that even if he wants to bring it we do not let him? It is obvious that we do not let him, seeing as he is not fit to eat it, which we learn from "L'fi Ochlo" ...

2.

Conclusion: From which we learn a Tamei as well, as the Gemara says in the second Perek of Zevachim (Daf 23.)?

(b)

Answer: We certainly do not need the Pasuk for this. And the Gemara is asking on the Lashon of the Tana 'Why does the Pasuk say "Tamei", to exempt him from Kareis', implying that that he is Patur from Kareis, but that if he so wishes, he is permitted to bring it.

1.

Answer (cont.): Therefore the Gemara asks, that if he wants to bring it, we will not let him?

(c)

Conclusion: It now transpires that it does not need to write Tamei, other than to teach us that an individual is deferred but not the Tzibur.

(d)

Clarification: The Ri explains that from the Mishnah which says 'because these are Patur from Kareis', one cannot extrapolate like Rav Nachman does - 'that since it says 'Peturin', we can see that if the blood is sprinkled, he is Yotzei ...

1.

Clarification (cont.): Because we can even say that he is not Yotzei, and it is only because it says in the Seifa 'Chayavin', that it says in the Reisha 'Peturin'.

(e)

Conclusion: And this fits well, in that earlier, the Gemara brought a proof from the Mishnah for Rav Sheishes.

4)

TOSFOS DH ELA LAMAH NE'EMAR DERECH RECHOKAH ETC.

(SUMMARY: Tosfos explains why the Torah needs to write "Derech Rechokah" even according to Rav Yehudah.)

(a)

Question: According to Rav Yehudah who later defines Derech Rechokah as someone who is unable to enter during the time of eating ...

1.

Question (cont.): Why does the Torah need to mention Derech Rechokah? It is obvious that he is Patur, seeing as he is not fit to eat it?

(b)

Refuted Answer: And if it is because he is able to enter with horses and mules ...

1.

Refutation: If so, later when the Tana says 'If he is outside Modi'in and is able to enter with horses and mules, we might have thought that he is Chayav, therefore the Torah writes "u'va'Derech Lo Hayah".

2.

Refutation (cont.): Why do we need this Pasuk, the Torah in the first place only writes Derech Rechokah because of where he is able to enter with horses and mules?

(c)

Refuted Answer: Nor can one answer that we night otherwise have thought that he is Chayav for distancing himself ...

1.

Refutation: Because if so, what does the Gemara explain that the Torah writes Tamei to teach us that even if he wants to bring the Pesach, we do not let him.

2.

Refutation (concl.): The Tana is right to explain that it is said to exempt him from Kareis, since we might otherwise have thought that he is Chayav for rendering himself Tamei in the first place?

(d)

Answer: The Rashba therefore explains that the Torah needs to mention Tamei and Derech Rechokah, so that we should not say that since he was not fit to bring the Pesach Rishon, he is also Patur from Pesach Sheini too. And he holds like Rebbi Nasan, that Pesach Sheini comes to make up for Pesach Rishon.

5)

TOSFOS DH LO KASHYA HA REBBI YOSSI

(SUMMARY: Tosfos reconciles this with the Gemara in Keitzad Tzolin, where we conclude that Rebbi Yossi holds 'Ein Shiochtin ve'Zorkin ... ')

(a)

Question: Here we establish the Beraisa that holds 'Shochtin ve'Zorkin ... ' like Rebbi Yossi, whereas in Perek Keitzad Tzolin (above, Daf 81.) in connection with Tum'as ha'Tehom, the Gemara concludes that Rebbi Yossi holds 'Ein Shochtin ve'Zorkin ... '?

(b)

Answer: The Gemara here only establishes the Beraisa like Rebbi Yossi regarding what he holds 'Nashim ba'Sheini Chovah'.

TOSFOS DH ULA L'TA'AMEIH

(SUMMARY: Tosfos queries Ula's source for the Din that the time of Shechitah ends with Sheki'ah.)

(a)

Question: From where does Ula know that already from the beginning of the Sheki'ah it is no longer the time of Shechitah?

1.

Question (cont.): Since the fact that the blood becomes Pasul with Sheki'as ha'Chamah he learns from "be'Yom Hakrivo es Zivcho" ...

2.

Question (concl.): And we Pasken in the second Perek of Megilah that daytime lasts until Tzeis ha'Kochavim?

7)

TOSFOS DH RAV YEHUDAH AMAR KOL SHE'EINO YACHOL LIKANEIS B'SHA'AS ACHILAH

(SUMMARY: Tosfos reconciles the seemingly huge time-discrepancy between Rav Yehudah and Ula.)

(a)

Question: According to Rav Yehudah one is not able to enter from the Modi'in and outwards in half a day and a night, whereas according to Ula, he cannot enter during the time of Shechitah - Why can we not time it for ourselves?

(b)

Answer #1: The roads have closed, as we learned in Rosh ha"Shanah (daf 23:).

(c)

Answer #2: Moreover, the Sugya goes like to Rebbi Akiva who holds Techumin are d'Oraysa, in which case, according to Rav Yehudah, one will be able to enter from the Modi'in until close to the T'chum by the beginning of nightfall. Consequently, the difference is not so great.

(d)

Support: And this explanation is implied in the Yerushalmi.

8)

TOSFOS DH V'KA'AMRAT SHOCHTIN V'ZORKIN AL TAMEI SHERETZ

(SUMMARY: Tosfos explains why this is La'v Davka.)

(a)

Clarification: The Gemara says this to strengthen the Kashya, because even if he holds 'Ein Shochtin ... ', the Gemara could still ask from a T'vul-Yom ...

(b)

Clarification (cont.): This is because everyone agrees that and may Shecht and sprinkle on him, even though is not permitted to enter during the time of Shechitah.

9)

TOSFOS DH DERECH RECHOKAH L'TAHOR ETC.

(SUMMARY: Tosfos explains the Gemara's answer.)

(a)

Clarification: Since this depends on doing, as the Pasuk writes " ... and he was not on the way, and he desists from doing the Pesach".

(b)

Implied Question: Even though in that very Pasuk it mentions Tum'ah - "And the man who is Tahor" ...

(c)

Answer: From the fact that it mentions "Tamei Nefesh" and not Tamei Sheretz, we see that the Torah renders Chayav a Tamei Sheretz, a proof that we go after the eating.
