TOSFOS DH LEIMA KASAVRI ACHERIM EINAH LI'SHECHITAH ELA LI'BE'SOF U'CHI'D'RAVA ETC.

(SUMMARY: Tosfos explains in detail, the Machlokes between Abaye and Rava in Zevachim.)

(a)

Clarification: In the second Perek of Zevachim (Daf 30.) Abaye and Rava argue over Rebbi Meir with regard to 'Lachatzos'. According to Abaye, Rebbi Meir concedes (that we do not say 'T'fos Lashon Rishon' ...

1.

Clarification (cont.): Whereas Rava maintains that they (Rebbi Meir and Rebbi Yossi) argue there too, and Rava holds 'T'fos Lashon Rishon'

(b)

Explanation #1: According to Rashi, 'Lachtzos' means 'half Temuras Olah and half Temuras Shelamim'.

(c)

Explanation #2: However the explanation of Rabeinu Chananel, who explains 'Lachtzos' to mean that 'at midday, both (Kedushos) will take effect', is more correct.

1.

Explanation #2 (cont.): Abaye now explains that Rebbi Meir concedes there ... , seeing as they not take effect at the time of the declaration, and at midday they both take effect simultaneously

2.

Explanation #2 (cont.): Whereas according to Rava, even there Rebbi Meir disagrees ...

3.

Precedent: As he does by Shechitah, which (also) takes effect only at the end, leaving only a split second for both to take effect, yet Rebbi Meir holds that only the first one actually does.

(d)

Explanation #2 (cont.): And this is why 'la'Areilim u'le'Mulim', Areilim takes effect, because we say 'T'fos Lashon Rishon'.

1.

Explanation #2 (concl.): Whereas if we were to say 'Yeshnah li'Shechitah mi'Techilah ve'Ad Sof', since there is time for both of them to take effect, they would.

(e)

Conclusion: In short, Rebbi Meir only says 'T'fos Lashon Rishon' if he also holds Einah li'Shechitah Ela li'be'Sof', where there is no time for both of them to take effect, as Tosfos explained.

(f)

Implied Question: This is not comparable to Temuras Olah, Temuras Shelamim, where there is more reason to say 'T'fos Lashon Rishon where he did not say 'Lachtzos', where both of them are able to take effect, more than if had said 'Lachtzos' ...

(g)

Answer: Because there since he said 'Temuras Olah, even on half the animal, , it would spread to the whole animal, in which case 'Temuras Shelamim', would no longer be able to take effect.

1.

Answer (concl.): Unlike 'Mulim va'Areilim', where, if we say 'Yeshnah li'Shechitah ... ', since they are able to take effect one after the other, they do, even though Rebbi Meir generally holds T'fos Lashon Rishon'.

2)

TOSFOS DH V'LO HISPIK LOMAR L'MULIM ETC.

(SUMMARY: Tosfos asks why it is then necessary to say 'Hikdim Mulim la'Areilim'.)

(a)

Question: The Rashba asks that if that is so, why does Rebbi Meir need to mention 'Hikdim Mulim la'Areilim'; even if he mentioned Areilim first, it ought to be Kasher, as long as managed to say 'la'Mulim' before the termination of the Shechitah.

3)

TOSFOS DH REBBI MEIR SAVAR LO BA'INAN PIV V'LIBO SHAVIN

(SUMMARY: Tosfos proves that, strictly speaking, Pigul is not a P'sul Machshavah, but rather a P'sul Dibur.)

(a)

Halachah: From here the Ri deduced that when we generally refer to Pigul as a P'sul Machhavah, it is La'v Davka, seeing as it is not Pigul until one actually verbalizes it.

1.

Proof: Because if it was contingent on Machshavah alone, then even where he did not manage to say 'le'Mulim, why is it Pasul according to Rebbi Meir, seeing as in any event, he made the decision to say 'le'Mulim'.

4)

TOSFOS DH HA'MISKAVEIN LOMAR TERUMAH ETC.

(SUMMARY: Tosfos explains why 'Devarim she'ba'Leiv Einan Devarim' does not apply here.)

(a)

Implied Question: Even if we say that 'Devarim she'ba'Leiv Einan Devarim', as in the case of the man who sold his property with the intention of going to Eretz Yisrael, without stipulating this at the time of the sale (Kidushin, Daf 49:) ...

(b)

Answer: There, he did not err in his words, whereas here they remain Devarim she'ba'Leiv, and what he actually said is meaningless, seeing as he erred in his words.

5)

TOSFOS DH VE'SIMAN SHEINI AF LA'AREILIM DI'PESICHI MULIN ETC.

(SUMMARY: Tosfos explains why Rebbi Meir says 'Hikdim Mulim'.)

(a)

Question: If so, why does Rebbi Meir say 'Hikdim Mulim ... ', even if he didn't, as long as he Shechted the first Si'man for Mulimand Areilim, and likewise the second one?

(b)

Answer: He is coming to teach us that even if he did not specify 'also for Areilim', only he Shechted the second Si'man for Areilim S'tam, since he Shechted the first Si'man for Mulim, he probably had Areilim in mind as well.

1.

Answer (cont.): Similarly in the Seifa, which says 'Areilim le'Mulim, Pasul' - it will be Pasul even if he mentioned Mulim first, in the event that he Shechted the second Si'man specifically on behalf of Areilim.

(c)

Conclusion: And he is coming to teach us that, even though he Shechted the first Si'man specifically for Areilim, we do not say that if he Shechted the second Si'man for Mulim, he reveals that he meant to Shecht the first Si'man (not only for Areilim, but) also for Areilim.

6)

TOSFOS DH HA'SHOCHET PESACH AL HA'CHAMETZ OVER B'LO SA'ASEH

(SUMMARY: Tosfos proves that the Pesach is nevertheless Kasher.)

(a)

Halachah: The Riva rules that the Pesach is Kasher, seeing as the Pasuk does not repeat the prohibition, which would render it crucial).

(b)

Support: The Tosefta in this Masechta (Perek4) specifically states that 'Someone who Shechts the Pesach on Chametz on the fourteenth, trangresses a Lo Sa'aseh, but the Pesach itself is Kasher, and the owner has fulfilled his obligation.

7)

TOSFOS DH O L'ECHAD MI'BENEI CHABURAH

(SUMMARY: Tosfos proves that it cannot be owner who is Chayav.)

(a)

Halachah: The Ri explains that the owner of the Chametz is not Chayav, only the one who Shechts and the Kohen who sprinkles the blood

(b)

Source: Seeing as the Torah writes 'Lo Sichchat'.

(c)

Proof: Moreover, how can he be Chayav according to Rebbi Yochanan, seeing as it is a La'v she'Ein bo Ma'aseh?

8)

TOSFOS DH LO AMRINAN AL B'SAMUCH

(SUMMARY: Tosfos reconciles this with other Gemaros, where "al" at least means 'be'Samuch'.

(a)

Question #1: In Perek Sh'tei ha'Lechem (Menachos, 98.) the Gemara says that from "Al" at least we need to learn 'be'Samuch' ...

1.

Question #1 (cont.): Because the Tana'im there argue over the Pasuk "Venasata al ha'Ma'asreches", in connection with the bowls of the Levonah of the Lechem ha'Panim,; some hold that "al" must be taken literally, whereas according to others, it means 'next to'?

(b)

Question #2: Similarly, in 'Eilu Ne'emarin' (Sotah 37:) they argue over the Pasuk "Venasata es ha'Berachah al Har Gerizim", as to whether "al" means literally or 'next to'.

(c)

Answer: There it is logical to interpret "al" as 'next to', since they placed them (the bowls) simultaneously with the loaves, and burned them at the same time as they were removed.

1.

Answer (cont.): Likewise with regard to Har Gerizim, it is logical to say that they needed to be at least next to the mountains, because otherwise, why did the Torah mention it?

(d)

Support: And so it is implies shortly, that wherever it is a S'vara, there is no Machlokes, when the Gemara says 'But as far as the Mikdash is concerned, say that he (Rebbi Yochanan) concedes to Resh Lakish'.

9)

TOSFOS DH HASRA'AS SAFEK LO SH'MAH HASRA'AH

(SUMMARY: Tosfos initially queries Rashi's explanation as to why a Safek is not considered a warning, and finally resolves the problem.)

(a)

Clarification: From Rashi it appears that it is not a warning due to the fact we don't know (that the person sinned).

(b)

Question: This does not appear correct to the Ri, since of what significance is it that the person who is warning doesn't know, as long as the person being warned knows, since the purpose of warning is to distinguish between Shogegand Meizid?

(c)

Answer: It is possible to explain the Lashon of Rashi to mean that since we don't know, it is not considered a warning, seeing as the culprit can always contradict us and claim that he was a Shogeg.

10)

TOSFOS DH LA'V SHE'EIN BO MA'ASEH LOKIN ALAV ETC.

(SUMMARY: Tosfos refers to the Gemara in Bava Metzi'a.)

(a)

Reference: This is explained in 'ha'Socher es ha'Po'alim' (Bava Metzi'a, 90:).

11)

TOSFOS DH MIDI D'HAVI A'KELEI SHAREIS

(SUMMARY: Tosfos disagrees with Rashi's explanation of this statement, and reconciles his own explanation with the Gemara in Succah.)

(a)

Explanation #1: Rashi explains that they only sanctify what is inside them.

(b)

Question: What has that to do with the Shechitah of the Korban, that it should only sanctify something that is inside the Azarah?

(c)

Explanation #2: What the Gemara therefore means is that it is similar to K'lei Shareis, which only sanctify what is inside them when they are inside the Azarah.

(d)

Support: And this is also implied in Perek ha'Mizbe'ach Mekadesh (Zevachim 88.) where the Gemara says that 'K'lei Shareis only sanctify what is inside them, and only sanctify inside the Azarah'.

(e)

Question: From the Mishnah in 'Lulav va'Aravah' (Succah 48:),which states that 'Just as is done to it (the Aravah) on weekday, so is done to it on Shabbos, except that on Erev Shabbos, they would fill a golden barrel of water that was not sanctified'.

1.

Question (cont.): 'Why', asks the Gemara? 'Let them bring one that is sanctified?'

2.

Question (cont.): 'The Tana holds ' Rebbi Ze'iri explains 'that a. The water has no Shi'ur', and b. 'K'lei Shareis even sanctify unintentionally'.

3.

Question (cont.): In other words, were one to bring one that is sanctified, it would become Pasul be'Linah (overnight).

4.

Question (concl.): The question now is - Why not bring the water even in a sanctified barrel, and place it outside the Azarah, seeing as it only sanctifies inside?

(f)

Answer: It is preferable to bring a barrel that is not sanctified and place it inside the Azarah than one that is sanctified and to place it outside.
