NEDARIM 85 - Two weeks of study material have been dedicated by Mrs. Estanne Abraham Fawer to honor the Yahrzeit of her father, Rav Mordechai ben Eliezer Zvi (Rabbi Morton Weiner) Z'L, who passed away on 18 Teves 5760. May the merit of supporting and advancing Dafyomi study -- which was so important to him -- during the weeks of his Yahrzeit serve as an Iluy for his Neshamah.

A WIFE WHO FORBADE HER EARNINGS (Yerushalmi Perek 11 Halachah 4 Daf 38a)

מתני' קונם שאיני עושה על פי אבא ועל פי אביך ועל פי אחי ועל פי אחיך אינו יכול להפר

(a)

(Mishnah): If a woman forbade, to her father, father-in-law, brother or brother-in-law, what she will earn, her husband cannot annul the vow;

שאיני עושה על פיך אינו צריך להפר

(b)

If she forbade her earnings to her husband, he need not annul (the vow is void anyway);

רבי עקיבה אומר יפר שמא תעדיף עליו יותר מן הראוי לו

R. Akiva says, he should annul it, lest she earn more than is proper (required) for him [to receive];

רבי יוחנן בן נורי אומר יפר שמא יגרשנה ותהא אסורה לחזור לו:

R. Yochanan ben Nuri says, he should annul it, lest he divorce her, and she will be forbidden to return to him.

גמ' תמן תנינן המקדיש מעשה ידי אשתו הרי זו עושה ואוכלת.

(Gemara - Mishnah): One who was Makdish his wife's earnings, she works and eats;

המותר ר' מאיר אומר הקדש. רבי יוחנן הסנדלר אומר חולין.

The excess - R. Meir says, it is Hekdesh. R. Yochanan ha'Sandlar says, it is Chulin.

רבי שמעון בן לקיש אומר במותר חמש סלעים פליגין

(Reish Lakish): They argue about [a wife who spins] more than five Sela'im (her quota).

דו פתר לה במעלה לה מזונות ואינו נותן לה מעה כסף לצרכיה.

(f)

[Reish Lakish] explains that he feeds her, but does not give to her Ma'ah Kesef (a sixth of a Dinar each week) for her needs.

ותנינן אם אינו נותן לה מעה כסף לצרכיה מעשה ידיה שלה.

Support (Mishnah): If he does not give to her Ma'ah Kesef for her needs, her earnings are hers. (This is like R. Meir, who holds that [he receives] her [basic] earnings in exchange for Ma'ah Kesef, and her excess earnings in exchange for feeding her. R. Yochanan ha'Sandlar says that he gets basic earnings for feeding her and for Ma'ah Kesef, and her excess earnings are always hers.)

רבי יוחנן אמר במותר לאחר מיתה פליגין

(R. Yochanan): They argue about her excess after death.

דו פתר לה בשאינו מעלה לה מזונות. אבל במעלה לה מזונות דברי הכל קידש

[R. Yochanan] explains that he does not feed her (therefore he has no rights to her earnings in her lifetime), but if he feeds her, all agree that it became Hekdesh.

(וכא אינו יכול להפר - קרבן העדה מוחקו) ר' מאיר אומר אינו צריך להפר. רבי יוחנן הסנדלר אומר שלה. ר' עקיבה אומר שלה. ר' יוחנן בן נורי אומר שלו

(Our Mishnah discusses when he feeds her.) R. Meir holds that [all her earnings are his, so] he need not annul, like the first Tana. R. Yochanan ha'Sandlar holds that [her excess earnings] are hers, [just like] R. Akiva holds that [they are] hers (therefore, he annuls due to excess earnings). R. Yochanan ben Nuri holds that [even her excess earnings] are his (therefore, he annuls only due to after divorce).

(Mishnah - R. Akiva): He annuls.

אמר רבי בא בשאסרה מעשה ידיה מלעשות עד ה' סלעים הוא כופה. מיכן ואילך אינו כופה שמתיירא שמא תעשה יתר ונמצא נהנה מן האסור לפום כן רבי עקיבה אומר יפר שלו

(R. Ba): When she forbade her earnings - he can force her to produce only until five Sela'im. From here and above he cannot force her (so her vow takes effect), and he fears lest he benefit from Isur, therefore R. Akiva says that he annuls [even though her basic earnings are] his.

(רבי יוחנן בן נורי אמר יפר). אמר רבי הילא איפשר לה לעשות חמש סלעים מצומצמות עד ה' סלעים כופה מיכן ואילך אינו כופה

Question (R. Heila): It is possible for her to produce exactly five Sela'im! Until five Sela'im he forces her; from here and above he cannot force her! Why must he annul?)

שמתיירא שמא תעדיף כל שהוא ונמצא נהנה מן האסור לפום כן (רבי יוחנן בן נורי אמר יפר) [צ"ל יפר שלו - פני משה]

Answer: He fears lest she produce Mashehu (any amount) extra, and it turns out he benefits from Isur. Therefore [R. Akiva says that] he annuls his. (We explained this like PNEI MOSHE.)

Note: There is an implied question. R. Yochanan ben Nuri says, he annuls, lest he divorce her and cannot remarry her. Since this applies only after divorce, it is not between him and her! Why can he annul?

אמר רבי הילא טעמא דרבי יוחנן בן נורי שמתוך שיודעת שאם מגרשה היה אסורה לחזור לו ואף מקניטתו (והוא) [נראה שצ"ל אינו, ע"פ קרבן העדה] מגרשה:

Answer (R. Heila): R. Yochanan ben Nuri's reason is, since she knows that if he divorces her, it is forbidden for her to return to him, she even provokes him, and he does not divorce her. (Therefore, this is between him and her; he annuls, and she fears to provoke him, lest he divorce her.)
