VOWS OF A NA'ARAH ME'URASAH (Yerushalmi Perek 10 Halachah 1 Daf 31b)

מתני' נערה מאורסה אביה ובעלה מפירין נדריה

(a)

(Mishnah): A Na'arah (a girl in the first six months of adulthood) Me'orasah (after Kidushin but before Nisu'in), her father and husband annul her vows;

היפר האב ולא היפר הבעל היפר הבעל ולא היפר האב אינו מופר ואין צריך לומר אם קיים אחד מהן:

If her father annulled but her husband did not annul, or the husband annulled but her father did not annul, it is not annulled, and we need not say that if one of them affirmed [the vow, it is not annulled].

גמ' כתיב [במדבר ל ז] ואם היו תהיה לאיש מה אנן קיימין

(Gemara) Question: It says "v'Im Hayo Sihyeh l'Ish" - what is the case?

אם בנשואה כבר כתיב [שם יא] אם בית אישה נדרה.

If she is a Nesu'ah - [this cannot be, for] it already says "Im Beis Ishah Nadarah"!

ואם בפנויה כבר כתיב [שם ד] ואשה כי תדר נדר לי"י.

If she is a Penuyah (single) - [this cannot be, for] it already says "v'Ishah Ki Sidor Neder la'Shem"!

Note: I do not understand the Havah Amina that "Sihyeh l'Ish" can discuss a Penuyah.

מה ת"ל ואם היו תהיה לאיש ונדריה עליה. ואי זו זו זו נערה מאורסה שאביה ובעלה מפירין נדריה.

Answer: What do we learn from "v'Im Hayo Sihyeh l'Ish u'Nedareha Aleha"? Who is this? It is a Na'arah Me'orasah. Her father and husband annul her vows.

עד כדון בנדרים שנדרה משנתארסה. נדרים שנדרה עד שלא נתארסה.

Question: This refers to vows that she took after Eirusin. What is the source for vows that she took before Eirusin?

ונדריה עליה לרבות את הנדרים שבא בידה מבית אביה.

Answer: "U'Nedareha Aleha" include vows that she [took before Eirusin, and] 'brought' with her from her father's house.
