THE SOURCE FOR HAFARAH FOR A NA'ARAH ME'URASAH (Yerushalmi Perek 10 Halachah 1 Daf 31b)

תני בשם רבי לעזר אם היו תהיה לאיש. בבוגרת ארוסה הכתוב מדבר.

(a)

(Beraisa - in the name of R. Lazar): "V'Im Hayo Sihyeh l'Ish" discusses a Bogeres (after the six months of Na'arus) Arusah.

חברייא אמרי [דף לב עמוד א] יאות אמר ר' לעזר.

(Talmidim): R. Lazar said properly! (Hayo Sihyeh l'Ish" discusses one who can be Mekadesh herself to a man, i.e. a Bogeres.)

וקשיא על דר' לעזר מכיון שבגרה לא כבר יצאת מרשות אביה. יתומה שמת אביה מי מפר לה הבעל מיפר.

(c)

Question (against R. Lazar): Since she became a Bogeres, did she not already leave her father's Reshus? An orphan whose father died, who annuls for her? Her husband annuls [alone. The same should apply here! We assume that R. Lazar agrees with our Mishnah, that her father and husband annul together];

וקשיא על רבנין אם עד שלא נכנסה לרשותו הוא מיפר לה. נכנסה לרשותו לא כל שכן.

(d)

Question (against Rabanan): If before she entered his Reshus, [her Arus] annuls her, after she entered his Reshus, all the more so! (Above, we said that they expound "u'Nedareha Aleha" to teach this.)

מה מקיימין רבנן ונדריה עליה. מה אנן קיימין

Question: How do Rabanan establish "u'Nedareha Aleha" - what is the case?

אם בנדרים שנדרה עד שלא נתארסה ונתארסה כבר נראה לאב ולבעל להפר.

If it refers to vows that she took [in Na'arus] before Eirusin and she became Mekudeshes - [this cannot be,] for it was proper for the father and husband to annul [together. If so, her husband cannot annul alone, even after Nisu'in!]

אלא כי נן קיימין בנדר שנדרה עד שלא מת אביה ומת אביה והיא בוגרת.

Answer: Rather, the case is, she vowed before her father died, and [before Eirusin] her father died, or she became a Bogeres. (We explained this like PNEI MOSHE.)

מנן לר' לעזר נערה מאורסה אביה ובעלה מפירין נדריה.

Question: What is R. Elazar's source that a Na'arah Me'urasah, her father and husband annul her vows [together]?

בין איש לאשתו עד כדון בבעל. באב. בין אב לבתו.

Answer: "Bein Ish l'Ishto" teaches about [Hafaras] ha'Ba'al. [What is the source that he joins to annul with] the father? [The verse continues] "Bein Av l'Bito."

Question: What do Rabanan [learn from the verse]?

בין איש לאשתו ולא שבינה לבין אחרים. בין אב לבתו לא שבינה לבין אחרים.

Answer: "Bein Ish l'Ishto", but not between her and others (a husband cannot annul such vows). "Bein Av l'Bito", but not between her and others.

Question: Does R. Elazar disagree (since he used the verse for joint Hafarah)?

אית ליה. כולה מתמן אית ליה בין איש לאשתו לא מה שבינה לבין אחרים. בין אב לבתו ולא שבינה לבין אחרים.

Answer: He learns all of these from there (the verse). "Bein Ish l'Ishto", but not between her and others. "Bein Av l'Bito", but not between her and others. (Since the Torah wrote them together, this teaches that they annul together, i.e. vows of a Na'arah Me'urasah. - PNEI MOSHE)
