ONE WHO IS MUDAR MA'ACHAL (Yerushalmi Perek 4 Halachah 1 Daf 13a)

מתני' אין בין המודר הנאה מחבירו למודר ממנו מאכל אלא דריסת הרגל וכלים שאין עושין בהן אוכל נפש

(a)

(Mishnah): The only differences between one who is Mudar Hana'ah from his friend (Reuven vowed not to benefit from Shimon, or Shimon vowed 'Reuven may not benefit from me') and one who is Mudar Ma'achal (the vow forbids food) are Drisas ha'Regel (walking through the Madir's property) and [borrowing] Kelim not used for food. (They are permitted to a Mudar Ma'achal.)

המודר הנאת מאכל מחבירו לא ישאילנו נפה וכבר' וריחים ותנור אבל משאיל לו חלוק וטלית נזמים וטבעות וכל דבר שאין עושין בו אוכל נפש

(b)

One who is Mudar Ma'achal from his friend, [the Madir] may not lend to him a sifter, grinder or oven, but he may lend to him cloaks and rings, and anything not used for food;

מקום שמשכירין כיוצא בהן אסור:

In a place where such matters are rented, it is forbidden.

גמ' הא דבר שעושין בו אוכל נפש אסור. ולא ממאכל נדר.

(d)

(Gemara) Question: [Our Mishnah implies that] matters used for food are forbidden [even to a Mudar Ma'achal. What is the reason?] Did he not vow from food?!

אמר רשב"ל כיני מתניתא אין בין מודר הנייה מחבירו למודר הניית מאכל מחבירו.

Answer (Reish Lakish): Our Mishnah means 'the only differences between one who is Mudar Hana'ah from his friend and one who is Mudar Hana'as Ma'achal (benefit that brings to food)...' (CHON ASHIR on our Mishnah - surely this means like the Bavli concludes, Hana'ah that leads to food, just the Yerushalmi does not elaborate to explain as much as the Bavli does.)

תניי דבית ר' כן המודר הניית מאכל מחבירו לא ישאילנו נפה וכברה ריחים ותנור.

(f)

(D'Veis Rebbi - Beraisa): One who is Mudar Hana'as Ma'achal from his friend, [the Madir] may not lend to him a sifter, grinder or oven.

תני אבל משאילו כוסות וקערות ותמחויין. שאינן מהנין את האוכל אבל מכנסין את האוכל.

(g)

(Beraisa): However, he may lend to him cups, bowls and plates. They do not improve the food, just one enters the food [in them].

לפסים וקדירות אסור. לטחון ולדרוך אסור.

(h)

Pans and pots are forbidden. To grind or stomp [grapes, for the Mudar] is forbidden.

לקצור צריכא ולבצור צריכא.

(i)

Questions: To harvest [grain for the Mudar Hana'ah], this is a question. To pick grapes [for him], this is a question. (Perhaps it is permitted, for much work remains before the food will be ready.)

הניית (מהו) [צ"ל מאכל מהו כגון קורדום לבקוע עצים - פני משה]

(j)

What is Hana'as Ma'achal? E.g. it is an axe to cleave wood.

תני אבל משאילו קורדום.

(k)

(Beraisa): However, he may lend to him an axe.

הוינן סברין מימר בקורדום של בקעי'.

(l)

Question: We are thinking that this is a chopping axe. (If so, it is forbidden!)

תיפתר בקורדום של מכוש ולית שמע מינה כלום.

(m)

Answer: The case is, it is a weeding axe. (You cannot learn from here about a chopping axe.)

ר' אבונא אמר ר' ירמיה בעי אהן יוסטה מכיון די מרחק וחשר בה קמחא אסור מישאל ליה.

(n)

Question (R. Avuna citing R. Yirmeyah): Yusta (a kind of sieve), since [the holes] are far apart, and it can be used to sift flour one may not lend it? (Or, since normally it is not used for this, it is permitted?)

ר' בא בשם ר' זעירא שהוא [דף יג עמוד ב] כנותן לו מעות ליקח בהן ככר.

(o)

Answer (R. Ba citing R. Ze'ira): It is like giving to him coins to buy a loaf. (These are normally rented. Our Mishnah forbids this, for it is like pardoning the rental. With the money saved, he can buy food.)

ר' בון בר חייה בעי מעתה אסור להשאיל לו מעות שהוא כנותן לו מעות ליקח בו ככר.

Question (R. Bun bar Chiyah): If so, it should be forbidden to lend to him coins, for it is like giving to him coins to buy a loaf!

ר' אבינא אמר ר' ירמיה בעי (אילון) [צ"ל אילין עולימתא מכיון דאינון אכלין ושתיין מחמת - ירושלמי כפשוטו] קוזמידייא דאית עליהון אסור מישאל לון:

Question (R. Avuna citing R. Yirmeyah): These youths, since they [are given to] eat and drink due to the ornaments on them, is it forbidden to lend to them? (We explained this like YERUSHALMI KI'PESHUTO.)

2)

FULFILLING OBLIGATIONS OF A MUDAR HANA'AH (Yerushalmi Perek 4 Halachah 2 Daf 13b)

מתני' המודר הנייה מחבירו שוקל לו את שקלו ופורע לו את חובו ומחזי' לו אבידתו

(a)

(Mishnah): If one is Mudar Hana'ah from his friend, [the Madir] may give the half-Shekel (that every person must give to Hekdesh each year for Korbanos) on behalf of him, and pay his debt, and return his Aveidah (something he lost);

מקום שנוטלין עליה שכר תפול הנייה להקדש:

In a place where people pay for returning Aveidos (compensation for wages that the finder lost while occupied with the Aveidah), the money goes to Hekdesh.

גמ' רבי בא בר ממל בעי הפורע שטר חובו של חבירו שלא מדעתו תפלוגתא דחנן ובני כהנים גדולים.

(b)

(Gemara - R. Ba bar Mamal) Question: (Chanan taught that if David went overseas and another fed David's wife, he is not reimbursed. Bnei Kohanim Gedolim said that he is reimbursed.) If one pays another's loan document without his knowledge - do Chanan and the sons of Kohanim Gedolim argue about this?

אמר רבי יוסי טעמא דבני כהנים גדולים. תמן לא עלת על דעתו שימות אשתו ברעב. ברם הכא מפייס הוינא ליה והוא מוחל לי.

(c)

Answer (R. Yosi): The reason for Bnei Kohanim Gedolim is, there, it never crossed his mind that his wife will starve to death. However, here he can say 'I would have appeased [my creditor], and he would pardon me!'

הגע עצמך דהוה גביה משכון.

(d)

Question: Exert yourself [and you will find the answer]! If he had a security [how can we answer]?

מפייס הוינא ליה והוא יהיב לי משכוני.

(e)

Answer: [He can say] 'I would have appeased him, and he would return my security to me.'

עד כדון בבעל חוב שאינו דוחק. ואפי' בבעל חוב שדוחק.

(f)

Question: This applies to a creditor who is not Dochek (pressing to be paid). Do we say so even about a Dochek creditor?

נישמעינה מן הדא [צ"ל ושוקל את שקלו - קרבן העדה]

(g)

Answer: We learn from [our Mishnah]. If one is Mudar Hana'ah from his friend, he may give the half-Shekel on behalf of him;

[צ"ל ולא שקל אין ממשכנין אותו הדא אמרה ואפילו בבעל חוב שהוא דוחק - קרבן העדה]

If one did not give his Shekel, do they not take a security from him?! This teaches that we say so even about a Dochek creditor [like Hekdesh].

תדע לך שהוא כן דתנינן ומקריב עליו קיני זבין קיני זבות קיני יולדות חטאות ואשמות

(h)

Support (Mishnah): He may offer for him Kinim (Korbanos ha'Of) of a Zav, Zavah, Yoledes (one who gave birth), Chata'os and Ashamos. (OHR SOMAYACH Hilchos Nedarim 6:5 - the Yerushalmi explains that the Madir offers his own birds or animals for the Mudar, unlike the Bavli, which explains that the Madir (a Kohen) offers the Mudar's Korban.)

בשלא נכנס לתוך ידיו כלום. וכא בשלא נכנס לידיו כלום.

Is this not when [the Mudar] did not give anything to him? Also here, [he pays another's debt] even though he did not receive anything from him (and he cannot demand to be repaid).

ר' יהושע בן לוי אומר אין לך נתפס על חבירו וחייב ליתן לו אלא בארנון ובגולגולת.

(i)

(R. Yehoshua ben Levi): The only case in which one is Nitfas (needs to pay) for his friend, and [the latter] must give to him (what he paid), is the king's tithe and head-tax. (It is customary to force one to pay these for another.)

רב אמר כל הנתפש על חבירו חייב לו.

(j)

(Rav): Anyone who is Nitfas for his friend, he must give to him.

חייליה דרב מן הדא הגוזל שדה (ונטלוה מסיקין) [צ"ל מחבירו ונטלוהו מסיקין אם מכת מדינה אומר לו הרי שלך לפניך ואם מחמת הגזלן חייב להעמיד לו שדה - רא"ש כתוהות יג:ח]

(k)

Source (for Rav - Mishnah): If one stole a field and extortionists took it - if [extortion] is rampant in the area, he says 'your field is in front of you.' If [they took it] due to the Gazlan, he must give to him another field [of the same value. We explained this like the ROSH.]

לא שמע דאמר רבי יוחנן קנס קנסו בגזלן.

(l)

Rebuttal: Did he not hear that R. Yochanan said, they made a fine for a Gazlan? (According to letter of the law, he need not pay, for land is not stolen.)

ר' אבין בעי דהוה (רביה) [צ"ל רבה - ספר משביח]

(m)

Question (R. Avin): The great Dahavah (if one was Nitfas for it, what is the law? This is a tax that the king takes when needed, like "Madhevah" - Yeshayah 14:4.)

ר' יוסי בי רבי בון ורבי חייה בר לולייני תריהון אמרין בשם ר' שמואל חד אמר בארנון ובגולגולת [צ"ל וחרנה אמר אינה בארנון ובגלגולת - קרבן העדה]

(n)

Answer: R. Yosi bei R. Bun and R. Chiya bar Lulainu, both citing Shmuel, [argued about this]. One said that it is like the king's tithe and head-tax, and one said that it is not like the king's tithe and head-tax. (We explained this like SEFER NIR, Kesuvos 13:2.)
